ORDINANCE NO. 1535
AN ORDINANCE ANNE%ING CERTAIN PROPERTY OWNED BY JOSEPHINE M.
SEAIRD, BEING THE EAST 30 FEET OF 1030 EAST LINK STREET, AND
ANNE$ING CERTAIN PROPERTY OWNED BY THE NATIONAL SANK OF
CANTON, AS TRUSTEE OF TRUST NO. 1004, BEING 1120 EAST LINN
STREET, AND DESIGNATING SUCH PROPERTY AS A B-2 ZONING
CONFIGURATION.
WHEREAS, it appears to the City Council of the City of Canton,
Illinois, that the territory hereinafter described is not located in any
municipality, but that the same is located outside the corporate limits
of said City of Canton; and
IT FURTHER APPEARING to said City Council that the territory
hereinafter described as Tract 1, being owned by Josephine M. Beaird, is
contiguous to the City of Canton along its South boundary line thereof,
and the property owned by The National Bank of Canton as Trustee of Trust
No. 1004, hereinafter described as Tract 2, is contiguous to the property
being annexed by Josephine Beaird; and
IT FURTHER APPEARING to said City Council that a Petition for
Annexation and Rezoning has been filed by the petitioners, THE NATIONAL
BANK OF CANTON, AS TRUSTEE OF TRUST NO. 1004, and JOSEPHINE M. BEAIRD,
requesting that the property hereinafter described be annexed to the City
of Canton in a B-2 zoning configuration; and
IT FURTHER APPEARING to said City Council that a public hearing was
conducted by the Planning & Zoning commission of the City of canton,
Illinois, in accordance with the laws of this State and the ordinances of
the City of Canton, Fulton County, Illinois, on February 10, 1997, and
said Planning & Zoning Commission unanimously recommended that the
property hereinafter described be annexed to the City of Canton in an B-2
zoning configuration;

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Canton, Illinois, as follows:
Section 1. That the territory described as follows:
TRACT 1: (East 30 feet in width of 1030 East
Linn)
A TRACT OF LAND LOCATED IN THE NORTHEAST QUARTER
OF THE SOUTHWEST QUARTER OF SECTION 35, TOWNSHIP
7 NORTH, RANGE 4 EAST OF THE FOURTH PRINCIPAL
MERIDIAN, FULTON COUNTY, ILLINOIS, MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
Commencing at the Northeast Corner of the
Southwest Quarter of Section 35, said point
being the center of section 35; thence South
along the West line of the Northwest Quarter of
the Southeast Quarter of said Section 35, a
distance of 692.0 feet to a point, thence West
30.0 feet to a point, thence North 692.0 feet to
a point on the North line of the Northeast
Quarter of the southwest Quarter of said Section
35, thence East 30.0 feet to the point of
beginning;
Subject to the Rights of the State of Illinois
in F.A.I. State Route Route #9;

being the center of Section 35; thence South
along the West line of the Northwest Quarter of

distance of 692.0 feet to a point, thence East
300.0 feet to a point, thence North 692.0 feet

Tract 1 being owned by Josephine M. Beaird, and Tract 2 being owned by
The National Bank of Canton, as Trustee of Trust No. 1004, be and the
same are hereby annexed to the city of canton, County of Fulton, state of

Illinois, in accordance with the applicable rules, laws and regulations
of the Illinois Municipal code.
Section 2. That the above-described property shall be and the same
is hereby designated with a s-2 zoning configuration, general commercial
district.
section 3. That the City Zoning Administrator is hereby instructed
and ordered to make the necessary adjustments to the zoning map of the
City of Canton, Illinois, to reflect the annexation and rezoning
hereunder.
Section 4. That the City Engineer of the City of Canton, Illinois,
has prepared an appropriate plat reflecting the addition of the above-
described property to the City of Canton by virtue of the annexation
herein and making same a part of the permanent records of the City of
Canton, Illinois.
Section 5. That this ordinance was passed and became in full force
and effect immediately upon its passage by a majority vote of the
aldermen holding office in the City of Canton, Fulton county, Illinois at
a regular meeting of the City Council of the City of Canton, Illinois,
this 4th day of March, 1997, upon a roll call vote as follows:
AYES: Aldermen May, Shores, Meade, Nidiffer, Phillips,
Sarff, Hartford, Molleck,
NAYS : None .

1. The undersigned, as a member of the firm, Froehling, Taylor & Weber, 167 West
Elm Street, Canton, Illinois 61520, represents The National Bank of Canton and Josephine M.
Beaird concerning the annexation of certain property which is contiguous to the City of Canton,
Fulton County, Illinois, and which is described on Exhibit A which is attached hereto and made a
part hereof by reference.

PLEASE TAKE NOTICE that a Petition for Annexation and Rezoning has been filed by
The National Bank of Canton, as trustee of Trust No. 1004, to annex certain property from the
County of Fulton to the City of Canton, said property being 1120 East Linn Street, and by
JOSEPHINE M. BEAIRD, to annex certain property from the County of Fulton to the City of
Canton, said property being the east 30 feet of 1030 East Linn Street, legally described on Exhibit A
which is attached hereto and made a part hereof by reference.
Fursuant to Section 7-1-1 of the Illinois Municipal code (65 ILCS 5/7-1-1), you are hereby
given notice of such annexation request.

Action will be taken by the City of Canton at a City Council meeting to be held on March 4,
1997, at 6:30 p.m., at the City Building, 210 East Chestnut Street, Canton, Illinois 61520, at which
time and place you are encouraged to attend.
