• RESOLIITION N0. 3286 A RESOLIITION APPROVING A MAINTENANCE AGREEMEATT BETWEEN THE CITY OF CANTON AND THE ILLINOIS DEPARTMENT OF TRANSPORTATION AND DIRECTING THE MAYOR AND CITY CLERK TO E%ECIITE AND DELIVER SAID AGREEMENT ON BEHALF OF THE CITY OF CANTON, ILLINOIS. WHEREAS, the Legal and Ordinance Committee has determined that it is necessary and in the best interest of the City of Canton to enter into a maintenance agreement with the Illinois Department of Transportation, hereto attached and herein incorporated as Exhibit "A"; and, WHEREAS, the Canton City Council has made a similar determination. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COIINCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the Maintenance Agreement hereto attached as Exhibit "A" between the City of Canton and the Illinois Department of Transportation is hereby approved. 2. That the Mayor and City Clerk are hereby authorized and directed to execute and deliver said maintenance agreement on behalf of the City of Canton, Illinois. 3. WITNESSETH, that far end in consideration of the covenants hereinafter mentioned, the Corporation agrees >n operate and maintain in a manner .satisfactory m the Departrnerrt, pardons of certain streets being used as extensions or parts of State highways lying within the boundaries of the Corpora- tion beginning July 1, 1995. This ~reement may be extended by the Department in 12-month increments until June 30, 2005 unless temunated Such extension shall be aocom- pGshed by a letter from the Deparment to the Corporation. The Corporation agrees to operate and maintain the streets covered by this agreement in the best interests of the people of the State of Illinois. The portions of streets to be maintained are described on the Computation Sheet attached hereto and made a part hereof. The obligations of the Department under this agreement are subject to termination and cancellation in any year for whkh the General Assembly of the State of IlUnois fails to make an adequate appropriation or reappropriation to pay such obligations. The Department reserves the right to amend this agreement at the time of extension by the addition or deduction of lane miles of streets to be main- tained. Such addendum must be approved and signed by both parties. The Corporation agrees that it wiA not terminate this agreement nor refuse to enter into subsequent agreements without giving the Department wrtten notice at least 90 days prior m such termination. If the Corporation gives the Department written notice of intent ib enter into no future agreement, the current agreement will remain in force for 90 days from the receipt of such notice. The Department may, at its discretion, release the corporation from the agreement before the expiration of the 90 days required by the above stipulation. It is further understood and agreed that the Department, at its discretion, has the right to terminate this agreement by giving written notice to the Corporation at least 90 days prior to such mrnination. To operate and maintain includes but is not limited 1n all routine surface and pothole repairs, temporary wti-depth patches, expansion bump removal on bituminous surfaces, craclt and joint sealing, cleaning and litter pidwp, snow and ice control and all other routine operational services. Median mainte- nance, when applicable, shall consist of sweeping, litter pickup, mowirp and routine surface repairs. The Corporation agrees to permit ra cuts or openings in the curbs or pavements of the streets covered by this agreement without the written approval of the Department Pavement cola, curb openings, utility frames and municlpal frames and grates or covers distrurbed by settlement, construction or repair under permit are to be restored, repaired, adjusted and maintained by the utility owner or permit hdder to the satisfaction of the b the State. Department at no expense The Corporation agrees that, except in extreme emergencles, it will not undertake or authorize repairs not covered by this agreement, at the expense of the State, without securing the approval of the Department Inconsideration of the satisfactory maintenance and operation of streets covered by this agreement, the Department will pay the Corporation Z 12 , 2 7 2.60 fa ~ first twelve mr~rtth~period covered by the agreement, payable as described bebw. The rate of compensation will be adjusted annually at the time of renewal to reflect changes in miles maintained and costs. The cost adjustment factor used to determine the rates of cmnpenaation nnll be the percent change of the Construction Cost Index published in the Engineering News Record for the preceding calendar year. On or about March 31, June 30, September 30 and December 31 of each year, subject m an inspection by the Department, the Department will authorize the Corporation to invoice the Department in an amount equal to approximately one-fourth of the total annual albwance stated above. CORPORATION CERTIFICATIONS RETENTION OF RECORDS The Corporator shall maintain, for a minimum oF5 years after the completion of the agreement, adequate books, records and supportirp documents to verify the amounts, recipients and uses of all disbursements of funds passing in conjunction with the agreement; the agreement and all books, records and supporting documents related to the agreement shall be available far review and audit by the Auditor General; and the Corporation agrees to cooperate fully with any audit conducted by the Auditor Genera and to provide full access m all relevant materials. Failure to maintain the required books, records and supporting documenb shall establish a presumption in favor of the State for the recovery of any funds paid by the State under the agreement for which adequate books, records and supporting documentation are not available to support their purported disbursement 9~OOlOMe (Rev. 9/94) DRUG FREE WORKPLACE The Corporation certifies that it wiA not engage in the unlawful manufacture, distribution, d'iapensation, Possession or use of a controlled subsranoe in the perfonnanoe of the agreement if the Corporation empbya 25 or more people and the agreement is for $5,000 or more, the (olbwing requirements apply: The Corporation certifies and agrees that it will provide a drug free workplace by: (a) Publishing a statemenC (t) Notifying empbyees that the unlawful manufadure, distribution, dispensing, possession ar use of a controlled substanoa, including cannabis, is prohibited in the Corporation's workplaoa. (2) Speafying the actions that wiU be taken againct empbyees for violations of wch prohibition. (3) Notifying the employee that, as a condition of employment for this agreement, the empbyee will: (A) abide by the terms of the statement; and (B) notiy the employer of any criminal drug statute conviction for a vitiation occurring in the workplace no later than five (5) days after such conviction. (b) Establishing a drug frt~e awareness prograru to inform employees about (1) the dangers of drug abuse in the.woricplace; _ _ _ (2) the Corporation's policy of maintaining a drug free workplace; (3) any available drug counseling, rehabilitation and employee assistance programs; and (4) the penalties that may be imposed upon an employee for drug vitiations. (c) Proving a copy of the statement required by subparagraph (a) to each employee engaged in the performance of the agreement and to post the statement in a prominent place in the workplace. (d) Notifying the Corporation within ten (10) days after receiving notice under part (B) of paragraph (3) of subsection (a) above from an empbyee or otherwise receiving acWal notice of such conviction. (e) Imposing a sanction, or requiring the satisfactory partiapation in a drug abuse assistance or rehabilitation program by, any empbyee who is so convicted, as required by section 5 of the Drug Free Workplace Act (f) Assisting employees in selecting a course of action in the evert dnp counseling, treatment and rehabilitation is required and indicating that a trained referral team is in place. The adjustment factor used to determine the rates of compensation shown on the computation sheet has been amended to read 3.27. Therefore, the Department of Transportation, will pay your municipality $12,272.60 as compensation for the satisfactory maintenance and operation of the streets covered by this agreement. If the city agrees to these conditions, please sign and return the maintenance agreement to this office as soon as possible. An executed copy will be returned to you. If the city is not in agreement, please notify this office in writing, referencing any changes desired. This is to inform you the Department finds the terms of this agreement to be satisfactory and is hereby exercising its option to extend the agreement to cover the 12-month period beginning July 1, 1999. An updated computation sheet(s) for this period is attached. The adjustment factor used to determine the rates of compensation shown on the Computation Sheet has been increased to 3.58 to reflect the 1.64% increase in the Construction Cost Index published by the Engineering News Record. In addition, the computation sheet has been reviewed to insure your municipality is being compensated correctly for the state highways it maintains. Consequently, the Department will pay your municipality $ 18,795.01 as compensation for the satisfactory maintenance and operation of the streets covered by this 12-month extension of the agreement.
