HomeMy WebLinkAbout#5079 - letter of understanding with American Federation of state, county, and municipal employees 1ESOLUIION NO. 5079 A RESCLU ION APPROVING A LEITER OF UNDII2S1ANDING BETWEEN THE CITY OF CANTON AND AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES, AFLCIO COUNCL 31/LOCAL NO. 1372,TO MECUM SAIDLETTER OF UNDERSTANDING ON BEHALF OF THE CITY OF CANTON,DTINOIS AND AMENDING COLLECTIVE BARGAINING AGREEMENT AND RFSOl.U11ON 4038 WHEREAS, the City of Canton entered into negotiations with the AFSCME Local No. 1372 relative to the establishment of wages, benefits and other conditions of employment and currently have a collective bargaining agreement in effect until April 30, 2017; and WHERFA.S, the City of Canton and the AFSCME Local No. 1372 have discussed the impending retirement of the Public Works Director and the need to fill the positions of Street Superintendent and System Maintenance Superintendant; and WHEREAS, the City of Canton has determined that it is in the best interest of the citizens of Canton to temporarily appoint two (2) current employees to the open positions of interim Superintendent of System Maintenance and Superintendent of Street Department; and WHEREAS,the City Council of the City of Canton, Illinois has reviewed the terms of the proposed Letter of Understanding, a copy of which is attached hereto and incorporated herein, as Exhibit A; and WHEREAS, the City Council of the City of Canton, Illinois has determined that it is necessary and in the best interest of the City to approve said Letter of Understanding. NOW THEREFORE, be it resolved by the City Council of the City of Canton, Fulton County, Illinois, as follows: 1. That the Letter of Understanding between the City of Canton and American Federation of State, County and Municipal Employees, AFL-CIO Council 31/Local No. 1372, a copy of which is attached hereto and incorporated herein as Exhibit A, is hereby approved and said Letter of Understanding hereby amends the collective bargaining agreement effective May 1, 2013 through April 30, 2017. 2. That the Mayor, or his designee, is hereby authorized and directed to execute and deliver said Letter of Understanding on behalf of the City of Canton. 3. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. Pr— n a Pavley-Roc , City lerk NLR Documents/Resolutions 01/31/2017 LETTER OF UNDERSTANDING BETWEEN THE CITY OF CANTON AMERICAN FEDERATION OF STATE,COUNTY AND MUNICIPAL EMPLOYEES,AFL-CIO COUNCIL 31/LOCAL NO. 1372 The City of Canton ("City") and the American Federation of State, County and Municipal Employees, AFL-CIO Council 31/Local No. 1372 ("Union")met and discussed the City's desire, due to the retirement of the Public Works Director, to temporarily fill the positions of Superintendent of Streets and Superintendent of System Maintenance in the Public Works Department. Normally these positions are management positions that would not be covered under the collective bargaining agreement between the City of Canton and the American Federation of State, County and Municipal Employees, AFL-CIO Council 31/Local No. 1372. However, given that these appointments are temporary until the mayoral election is held and the next administration determines what it will do with the management positions in the Public Works Department, it is the City and the Union's desire to allow the City to fill the positions with current staff, but allow that staff to remain in the Union until May 31, 2017. The following was agreed to: 1. That the positions of Superintendent of Streets and Superintendent of System Maintenance in the Public Works Department will be filled by current Public Works staff to be chosen by the City. 2. That the employees will remain active members of the American Federation of State, County and Municipal Employees, AFL-CIO Council 31/Local No. 1372. 3. That each Superintendent will be paid a stipend of$500 per month starting February 1,2017 through May 31, 2017. 4. That the Superintendents will remain on the overtime list and be eligible for overtime just as the other employees in the Union are eligible. The Superintendents will not be paid overtime unless their position on the overtime list is called in for overtime. 5. The terms of this letter of understanding will terminate on May 31, 2017. At that juncture should the Mayor decide to appoint the employees on a non-interim basis, the employees will no longer remain in the Union. The parties hereto have caused their duly authorized agents to sign this Letter of Understanding this day of February, 2017, with an effective date of February 1, 2017.
