ON PUBLIC WAYS #4049
WHEREAS, the City of Canton is desirous of regulating the solicitation on public ways
including state highways and city streets to ensure the safety of the solicitors as well as the
drivers within the City of Canton; and
WHEREAS, the issue has come before the Public Safety and Traffic Committee for
discussion as to place parameters for allowing solicitation on public streets and highways within
the City limits; and
WHEREAS, the City Council has determined that it is in the best interests of the citizens
of the City of Canton to adopt such ordinance to place parameters and regulations on the
solicitation on public streets and highways within the City limits; and
WHEREAS, in furtherance of its statutory powers to amend the Municipal Code for the
City of Canton, the City Council and the Mayor have determined that it is the best interest of the
citizens of Canton to establish such parameters and regulations.
NOW THEREFORE, BE IT ORDAINED, by the Mayor and the City Council for the city of
Canton, Illinois, as follows:
SECTION I: The foregoing recitals are made a part of this Ordinance.
SECTION 2: Contributions:
1. Registration Required: No person shall stand on a public way, including a state
highway or a city street, for the purposes of soliciting contributions from the occupant of any
vehicle within the corporate limits of the city unless said individual or individuals shall have first
registered with the city on the registration form provided by the city. Registration with the city
must be requested a minimum of fourteen (14) days prior to the planned commencement of
solicitation.
2. Permitted Locations: Solicitation on the state highways or public streets within
the city shall be allowed only at intersections where all traffic is required to come to a full stop.
3. All solicitors must wear a highly visible, orange or green safety vest at all times
when in the public way.
4. All solicitors must be at least 16 years of age. No one shall be in the public way
except solicitors.
5. All solicitation on public ways shall occur between the hours of 8:00 a.m. and
5:00 p.m.

6. The soliciting agency or individual shall be restricted and limited to solicitation
on the public way to no more than two (2) dates in any given calendar month and
no more than four (4)days during any calendar year.
7. Purpose of the fundraising event must be posted to identify the soliciting
organization. Examples- readable signs on the collection container, identification
on the safety vests of the solicitors, etc.
8. Additional Requirements for Solicitation on State Highways:
a. The soliciting agency or individual shall further be registered with the Attorney
General as a charitable organization as provided by the "An Act to regulate solicitation
and collection of funds for charitable purposes, providing for violations thereof, and
making an appropriation therefore", approved July 26, 1963, as amended; and,
b. The soliciting agency or individual shall further be engaged in a statewide fund
raising activity; and,
c. The soliciting agency or individual shall further be liable for any injuries to any
person or property during the solicitation which is causally connected to any act of
ordinary negligence of the soliciting agent.
SECTION: Penalty.
1. Violations of this section shall be governed by Title 1 (Administration) Chapter 27
(General Penalty) and the fee schedule that is adopted by City Council from time to
time. Any person who is found to be in violation of this chapter shall be removed
from soliciting and at the city's determination, may be suspended from being allowed
to solicit on public ways for one(1) year.
