AN ORDINANCE PROVIDING FOR DISCONNECTION OF CERTAIN AGRICULTURAL
LANDS FROM THE CITY OF CANTON CORPORATE LIMITS
WHEREAS,pursuant to Section 5/7-3-4 of the Illinois Municipal Code(65 ILCS§5/7-3-4),certain
property owners have petitioned City Council of the City of Canton, asking that the following parcels be
disconnected from the City of Canton corporate limits,as shown on the attached map:
1. PIN 09-08-32-200-017(Tract I)comprising approximately 5 acres south of Enterprise Drive;
2. PIN 09-08-32-200-019 Tract II)comprising approximately 5 acres south of Enterprise Drive;
3. PIN 09-08-32-200-021 (Tract III) comprising approximately 5 acres south of Enterprise
Drive;
4. PINs 09-08-32-200-022,09-08-32-200-023,09-08-32-200-024 and 09-08-32-200-025(Tract
IV)comprising of approximately 21 acres south of Enterprise Drive:
WHEREAS,the City of Canton is not currently providing any water,sewer or other utilities to any of
these parcels;
WHEREAS,all of these parcels are zoned agricultural;
WHEREAS,all of these parcels are in the County of Fulton and that portion of each of the parcels
not previously annexed into the City of Canton lies within the unincorporated area of Fulton County;
WHEREAS, disconnection will not result in the isolation of any part of the municipality from the
remainder of the municipality;
WHEREAS,disconnection of these parcels will not result in disruption to existing municipal service
facilities;
WHEREAS,the City of Canton will not be unduly harmed through a loss of tax revenue; and
WHEREAS, all of the real estate taxes and assessments for the above-described parcels have been
paid in full;
NOW,THEREFORE,BE IT ORDAINED BY THE CITY OF CANTON,COUNTY OF FULTON,
STATE OF ILLINOIS,AS FOLLOWS:
Section 1: The foregoing is incorporated as though fully set forth herein.
Section 2: This Ordinance shall be in full force and effect from and after its passage and adoption.

The Petitioners, Kenneth W. Pflederer, as Trustee of The Kenneth W. Pflederer Trust dated
April 9, 1997, Ronald L. Ludwig, David A. Smith, Lazy Day Lake, Ltd., an Illinois corporation,
James L. Wieda and Jenna L. Wieda, and Elmer E. Brockway and Kelly J. Davidson, by and
through their attorney, Nancy A. Schell, Froehling, Weber& Schell, LLP,pursuant to Section 5/7-
3-4 of the Illinois Municipal Code(65 ILCS § 5/7-3-4), state under oath:
1. Petitioner Kenneth W. Pflederer, as Trustee of The Kenneth W. Pflederer Trust
dated April 9, 1997, is the sole owner of record of PIN 09-08-32-200-017 (Tract 1) comprising
approximately 5 acres south of Enterprise Drive in Canton, Illinois.
2. Petitioner Ronald L. Ludwig is the surviving joint tenant and sole owner of PIN 09-
08-32-200-019 comprising approximately 5 acres south of Enterprise Drive.
3. Petitioner David A. Smith is the sole owner of record of Part of PIN 09-08-32-200-
021 (Tract III) comprising approximately 5.038 acres south of Enterprise Drive, and part owner of
PIN 09-08-32-200-025.
4. Petitioner Lazy Day Lake, Ltd., an Illinois corporation, is the owner of record of
Part of PINs 09-08-32-200-020 and PIN 09-08-32-200-022, PIN 09-08-32-200-025 and all of PINs
09-08-32-200-023, 09-08-32-200-024 and 09-08-33-100-018 (Tract IV) comprising
approximately 59 total acres south of Enterprise Drive:
5. Petitioners James L. Wieda and Jenna L. Wieda are the sole owners of record of
Tract V, comprising approximately 7.5 acres south of Enterprise Drive, a small portion of which
includes a Part of PIN 09-08-32-200-022 (inside the City limits), but most includes a Part of PIN
09-08-32-200-020 (outside the City limits), and are also part owner of PIN 09-08-32-200-025.
6. Petitioners Elmer E. Brockway and Kelly J. Davidson are the sole owners of record
of Tract VI, comprising approximately 7.5 acres south of Enterprise Drive, a small portion of
which includes Part of PIN 09-08-32-200-022 (inside City limits), but most includes Part of PIN
09-08-32-200-020 (outside City limits), and are also part owner of PIN 09-08-32-200-025.
7. Only a small portion of each of the parcels owned by Petitioners Lazy Day Lake,
Ltd., Smith,Wiedas and Brockways above-described parcels of land were previously annexed into
the City of Canton, with most of their acreage remaining outside the City and within the
unincorporated area of Fulton County. See attached Map.
8. None of the parcels of land contains a residence, nor do any of the landowners
intend to construct a personal residence on their parcels in the near future.
9. All of the Petitioners wish to disconnect that portion of their individual parcels
which was previously annexed into the City of Canton.
10. The City of Canton is not currently providing any water, sewer or other utilities to
any of these parcels.
11. All of these parcels are zoned agricultural.
12. All of these parcels are in the County of Fulton and that portion of each of the
parcels not previously annexed into the City of Canton lies within the unincorporated area of
Fulton County.
13. Disconnection will not result in the isolation of any part of the municipality from
the remainder of the municipality.
14. Disconnection of these parcels will not result in disruption to existing municipal
service facilities.
15. The City of Canton will not be unduly harmed through a loss of tax revenue.
16. All of the real estate taxes and assessments for the above-described parcels have
been paid in full. See attached Certificate of County Clerk James Nelson.
The Petitioners Ken Pflederer, Ronald L. Ludwig, David A. Smith, Lazy Day Lake, Ltd.,
an Illinois corporation, James L. Wieda and Jenna L. Wieda, and Elmer E. Brockway and Kelly
J. Davidson respectfully request that:
