RESOLUTION CONCERNING SALE OF SURPLUS REAL ESTATE
LOCATED AT 102 EAST ELM STREET, CANTON (65 ILCS 5/11-76-2)
WHEREAS, the City of Canton has acquired fee simple title to a vacant parcel of real
estate commonly known as 102 East Elm Street, Canton, legally described hereinafter; and
WHEREAS, the City Council of the City of Canton determined that it is no longer
necessary, appropriate, or in the best interest of the City of Canton that it retain title to said real
estate, and that said real estate is not required for the use of, or profitable to, the Municipality;
and
WHEREAS, pursuant to Section 11-76-2 of the Illinois Municipal Code (65 ILCS 5/11-
76-2) notice was been given of the proposal to sell such real estate and bids were invited for the
purchase of such real estate, said notice having first been published on September 23, 2006, and
having been published for three successive weeks in The Daily Ledger, a daily newspaper
published in the municipality; and
WHEREAS, pursuant to said notice, bids were opened at the Legal and Ordinance
Committee meeting of the City Council held on October 10, 2006; and
WHEREAS, the following bids for the purchase of said property were received;

WHEREAS, the City Council determined that the best interests of the City of Canton
and its residents were served by accepting the bid submitted by DENNIS CRAWFORD and as
evidence thereof, the City Council passed Ordinance #1887 (Ordinance -Authorizing the Sale of
Municipally Owned Real Property Located at 102 East Elm Street, Canton, Illinois) on
November 7, 2006; and
WHEREAS, Ordinance #1887 directed the sale of the aforesaid real estate to DENNIS
CRAWFORD for the amount bid of $100.00, contingent upon the City of Canton and DENNIS
CRAWFORD executing a Development Agreement within sixty (60) days of the effective date
of the ordinance with said agreement containing commercially reasonable and usual and
customary terms for similar development agreements between developers and municipalities;
and
WHEREAS, DENNIS CRAWFORD has been unable to procure all necessary
information to enter into a Development Agreement by January 7, 2007.
~ NOW, THEREFORE, BE IT RESOLVED, as follows:
SECTION ONE: The City Council finds as facts the recitals hereinabove set forth.
SECTION TWO: The deadline referenced in Ordinance #1887 is hereby extended to
February 7, 2007, representing a revised deadline of approximately ninety days from the
effective date of aforementioned ordinance.
PASSED by the City Council of the City of Canton, Illinois this 16th. day of January, 2007.
