HomeMy WebLinkAboutResolution #3328RESOLUTION NO. 3328 A RESOLUTION PROVIDING FOR THE MANNER OF SALE OF CERTAIN REAL PROPERTY OWNED BY THE CITY OF CANTON, FULTON COUNTY, ILLINOIS. WHEREAS, the City of Canton has become the owner of record of a certain parcel of real property hereinafter described; and, WHEREAS, the Legal and Ordinance Committee had determined that the real property hereinafter described is no longer necessary, appropriate, required for the use of, profitable to, or for the best interest of the City of Canton; and, WHEREAS, the City Council of the City of Canton, Fulton County, Illinois has made a similar determination. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the real property presently owned by the City of Canton, being located and legally described as follows, to-wit: Lots number Thirty-one (31) and Thirty-two (32) in Marshall and Fisher's First Addition to the City of Canton, Fulton County, Illinois. Common Address: 534 East Oak Street Canton, IL 61520 be let for sale of such property to be conducted by the staff of the City of Canton, by and with the advice of the City Attorney. 2. That public notice of the foregoing proposed sale shall be by law as made and provided. 3. The property shall be appraised by a written MAI certified appraisal or by a written certified appraisal of a State certified or licensed real estate appraiser. The appraisal shall be available for public inspection. 4. The size of the property is currently being leased to Western Illinois Special Education Cooperative as the site of an alternative school. It was designed to be used as a secondary fire station. The use of the foregoing parcel of real estate has been municipal in nature and that the future use of the aforesaid parcel is as determined by reference to the City of Canton's zoning ordinance and map, as the same may be from time to time amended. The property currently is zoned R-4, multiple family residence. 5. The City of Canton will receive contract proposals up to 5:00 o'clock P.M., on July 9, 1996. The staff of the City is available to discuss any aspects of the sale. 6. Conveyance of title to any successful bidder shall only be by a quit-claim deed. 7. The City of Canton shall show merchantable title to any successful bidder by either, in the City of Canton's sole discretion, abstract of title or a commitment to insure title in the amount of the purchase price. 8. The City of Canton reserves the right by majority vote to reject any and all proposals and with respect to the foregoing parcel of real property; or, to accept the proposal determined to be in the best interest of the City of Canton by a vote of 2/3 of the corporate authorities then holding office but in no event at a price less than 80% of the appraised value. 9. That this Resolution shall be in full force and effect immediately upon approval by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. ~• PASSED by the City Council of the County, Illinois at a regular meeting this upon a roll call vote as follows: City of Canton, Fulton 4th day of June, 1996 AYES: Aldermen Molleck, Hartford, Sarff, Phillips, Nidffer•, Shores, May.
