HomeMy WebLinkAbout#4027 - Amending Title 10 (Zoning Regulations) Chapter 3 (Conservation and Agriculture Districts) Section 2 (AG-1 District Permitted Uses) and Section 4 (Lot Area, Width, Building Height) ORDINANCE NO. 4027 AN ORDINANCE AMENDING TITLE 10 (ZONING REGULATIONS) CHAPTER 3 (CONSERVATION AND AGRICULTURAL DISTRICTS) SECTION 2 (AG-1 DISTRICT PERMITTED USES) AND SECTION 4 (LOT AREA, WIDTH, BUILDING HEIGHT) AND TITLE 10 (ZONING REGULATIONS) CHAPTER 4 (R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT) SECTION 5 (LOT REQUIREMENTS) WHEREAS, the Joint Planning & Zoning Commission has determined that it is in the best interest of the citizens of Canton, Illinois, to amend Title 10 (Zoning Regulations) Chapter 3 (Conservation and Agricultural Districts) Section 2 (AG-1 Dist4rict Permitted Uses) and Section 4 (Lot Area, Width, Building Height) and Title 10 (Zoning Regulations) Chapter 4 (R-1 Single Family Residential District) Section 5 (Lot Requirements) to also regulate the uses allowed in agricultural zones; and WHEREAS, the City of Canton is desirous amend the Canton Municipal Code; and WHEREAS, in furtherance of its statutory powers to amend the Municipal Code for the City of Canton, the City Council and the Mayor, have determined that it is the best interest of the City to amend the Code to allow livestock in agricultural zones that are on lots of certain size. NOW THEREFORE, BE IT ORDAINED, by the Mayor and the City Council for the city of Canton, Illinois, as follows: The City of Canton Municipal Code, Title 10 "Zoning Regulations," Chapter 3 "Conservation and Agricultural Districts" Section 2 ``AG-1 District Permitted Uses" and Section 4 (Lot Area, Width, Building Heights) are hereby amended to read as follows: Chapter 3: Conservation and Agricultural Districts 10-3-2: AG-1 DISTRICT PERMITTED USES: Agricultural uses, including grain storage, but o_,eluding and the raising or keeping of fowl and livestock in compliance with section 10-3-4 ( c )and (b ) and section 6.4.2 10-3-4: LOT AREA, WIDTH, BUIL"ING HEIGHT: (A) In the CO-1 districts: Lot area, lot width and building height limitations are not specified. (B) In AG-1 districts: No dwelling shall be located on a lot less than one acre in area or less than one hundred and fifty feet (150') in width. No primary building shall exceed thirty feet (30') in height. NLR Ordinances 3/28/2016 (C) If livestock is to be kept one and one half( 1 1/3 ) acres is required for the first animal and an additional one ( 1) acre is required for each additional animal. (D) Fences: In the event that livestock are kept, L---,-es shall b:. erected no closer than twenty five feet (25') from each proper-Ly line so as to provi& a source of containment. The City of Canton Municipal Code, Title 10 "Zoning Regulations," Chapter 4 "R-1 Single-Family Residential District" Section 5 "Lot Requirements" is hereby amended to read as follows: Chapter 4: R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT 10-4-5: LOT REQUIREMENTS: (A) Minimum lot area: Fifteen thousand (15,000) square feet or one and one-half(1 ''/2) acres if one horse is to be kept of tv e and ane �al t2 � ) if to ( e hefses e to kept vV Ci11U Vi1V 11CL11 /- UW_^ and one (1) additional acre for each additional horse to be kept.
