A RESOLIITION APPROVING A JOINT AGREEMENT FOR THE INSTALLATION OF
ACCESSIBILITY RAMPS BETWEEN THE CITY OF CANTON AND ILLINOIS
DEPARTMENT OF TRANSPORTATION AND AUTHORIZING AND DIRECTING THE
MAYOR AND CITY CLERK TO E%ECIITE SAID AGREEMENT ON BEHALF OF THE
CITY OF CANTON, ILLINOIS
WHEREAS, the City Council of the City of Canton has
determined that it is necessary and in the best interest of the
City of Canton to enter into a 3oint agreement for the
installation of accessibility ramps with Illinois Department of
Transportation, a copy of which is attached hereto and herein
incorporated as Exhibit ~~A~~.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois as follows:
1. That the point agreement, hereto attached as Exhibit nAn
is hereby approved.
2. That the Mayor and City Clerk are hereby authorized and
directed to execute and deliver said Agreement on behalf of the
City of Canton, Illinois.
3. That this Resolution shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton, Fulton County, Illinois.
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 20th day of March,
1996, upon a roll call vote as follows:
AYES: Aldermen May, Shores, Nidiffer, Phillips, Sarff,
Hartford, Molleck.
NAYS: None.
ABSENT: Alderman Meade.

AGREEMENT
This Agreement, entered into this -day of .1996 by and between the STATE
OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION, hereinafter
called the STATE, and the CITY OF CANTON, of the State of Illinois, hereinafter called the
CITY.
WITNESSETH:
WHEREAS, the STATE and the CITY, in order to insure safety to the public and comply with
the provisions contained in the Americans with Disabilities Act (ADA), are desirous of
constructing sidewalk curb ramps at intersections along Illinois Route 9 and Illinois Route 78
(Locust Street and Main Street) and within the corporate limits of the CITY OF CANTON, this
project to be known as FA Route 685 and FA Route 22, State Section D4 Handicap Ramps
1996-3; City Section 95-00089-00-SW; and
WHEREAS, the CITY is desirous of said improvements in that same will be of immediate
benefit to the CITY's residents and permanent in nature;
WHEREAS, the CITY will be the lead agency and assume all responsibilities for coordinating
and implementing all phases of the aforedescribed construction of the sidewalk curb ramps;
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties
hereto agree as follows:

1. The CITY agrees to construct or cause to be constructed the aforedescribed sidewalk curb
ramps in accordance with the General Plan Sheet attached hereto as "Exhibit A" and made
a part hereof and with the specifications attached hereto as "Exhibit B" and made a part
hereof.
2. The CITY agrees to pay all construction and engineering costs, subject to reimbursement by
the STATE as hereinafter stipulated.
3. Upon final field inspection of the improvement by the CITY and the STATE, the CITY agrees
to maintain the accessibility ramps in their entirety.
4. It is mutually agreed by and between the parties hereto that the estimated cost and cost
proration for this improvement is as follows:

Participation and reimbursement shall be predicated on the percentages shown above for
the specified work. Cost shall be determined by the actual costs incurred by the CITY as
necessitated by the construction of the aforedescribed project.

5. Upon completion of the said project, the STATE agrees to reimburse the CITY for the
STATE's share of the actual costs incurred plus 15 percent of the STATE's share of the
actual cost incurred for preliminary and construction engineering. Said reimbursement to be
based upon percentages of the actual cost incurred as shown above, said costs not to
exceed $15,500. This cost to be paid by the STATE in a single, lump sum payment.
6. The CITY agrees, upon completion of the project and final inspection by the CITY and the
STATE, to render to the STATE a detailed statement of the actual costs incurred by it or on
its behalf.
7. The CITY agrees to abide by all local, state, and federal laws, rules, regulations, orders, or
approvals insofar as they apply to the project.
8. The CITY agrees to comply with all applicable Executive Orders and Federal Highway Acts
pursuant to the Equal Employment Opportunity and non-discrimination regulations required
by the Illinois Department of Transportation.
9. The CITY shall maintain, for a minimum of 5 years after completion of the described
improvement, adequate books, records, and supporting documents to verify the amount,
recipients, and uses of all disbursements of funds passing in conjunction with this Agreement.
All books, records, and supporting documents related to the improvement shall be available for
review and audit by the Auditor General and other STATE auditors and the CITY agrees to
cooperate fully with any audit conducted by the Auditor General and other STATE auditors and
to provide full access to all relevant materials. Failure to maintain the books, records, and
supporting documents required by this paragraph shall establish a presumption in favor of the

STATE for the recovery of any funds paid by the STATE under this Agreement for which
adequate books, records, and supporting documentation are not available to support their
purported disbursement.
10. The CITY shall exercise its franchise right to cause private utilities to be relocated at no
expense to the STATE.
11. The CITY agrees to cause its utilities located upon right-of-way acquired by the STATE or
installed within the roadway after the said roadway was taken over for maintenance by the
STATE, to be relocated and/or adjusted at no expense to the STATE.
12. This Agreement and the covenants contained herein shall be null and void in the event the
contract covering the construction work contemplated herein is not awarded within three
years subsequent to execution of the Agreement.
This Agreement shall be binding upon and to the benefit of the parties hereto, their successors
and assigns.

The following Special Provisions supplement the "Standard Specifications for the Road
and Bridge Construction," adopted Jul y 1, 1994 ,
the "Supplemental Specifications and Recurring Special Provisions," adopted
February 1, 1996 (as indicated on the check sheet included herein),
the "Standard Specifications for Traffic Control Items," adopted NovPmb r 1 , 1994
and the latest edition of the "Illinois Manual on Uniform Traffic Control Devices for
Streets and Highways" in effect on the date of invitation for bids. These special
provisions included herein apply to and govern the proposed improvement designated
as Section 95-(lfl~-f35-~0-Sw and in case of conflict with any part or parts of said
specifications, said special provisions shall take precedent and shall govern.
