Tamarack Street ORDINANCE NO. 4022 ORDINANCE AUTHORIZING SALE OF MUNICIPALLY OWNED REAL PROPERTY LOCATED AT 160 W. TAMARACK STREET, CANTON, ILLINOIS WHEREAS, the City of Canton owns the following described real property: Part of the Southeast Quarter and Southwest Quarter of Section 34, Township 7 North, Range 4 East of the Fourth Principal Meridian, being more particularly described as follows: Beginning at a point being 38.0 feet South of the Southeast of Lot 1 of Chautauqua Addition, thence South 82 degrees 50 minutes 50 seconds East 124.61 feet to a point on a curve whose center bears South 22 degrees 53 minutes 54 seconds East 196.85 feet, thence along the arc of said curve 225.04 feet whose chord bears South 34 degrees 21 minutes 06 seconds West 212.98 feet to the P.T. of said curve, thence South 1 degree 36 minutes 06 seconds West 8.58 feet to an iron pin, thence West 48.81 feet to an iron pin, thence North 1 degree 36 minutes 06 seconds East 200 feet to an iron pin, thence East 40 feet to the point of beginning, containing 0.372 acres; EXCEPTING beginning at a point being 38.0 feet South of the Southeast Corner of Lot 1 of Chautauqua Addition, thence West 40 feet along the South edge of Tamarack Street, to an iron pin, thence South ldegree 36 minutes 06 seconds West 200 feet to an iron pin, thence East 48.81 feet to an iron pin, thence North 200 feet, more or less, to the point of beginning, situated in the County of Fulton and State of Illinois, PIN No. 09-08-34-401-015, which real property is generally located at 160 W. Tamarack Street, Canton, Illinois 61520 and is currently used as residential real property; and NLR Ordinances 02/13/2015 WHEREAS, the City Council of the City of Canton has determined that it is no longer necessary, appropriate, or in the best interest of the City of Canton that it retain title to said Real Property and that the Real Property is not required for the use of, or profitable to, the City of Canton; and WHEREAS, pursuant to Section 11-76-2 of the Illinois Municipal Code, 65 ILCS 5/11- 76-2, notice has been given of the proposal to sell the Real Property and bids have been invited for the purchase of Real Property, said notice having first been published on December 8, 2015, and having been published for three successive weeks in the Canton Daily Ledger, a newspaper published in the City of Canton; and WHEREAS, pursuant to said notice, bids were opened at the regular meeting of the Canton City Council held on January 19, 2016; and WHEREAS, only one bid for the purchase of the Real Property was received by the January 19, 2016 cutoff. WHEREAS, Andrew Hensley made the only bid to purchase said property for $100.00 and demolish it in accordance with the original request for bids; and WHEREAS, the City Council finds and determines that the best interests of the City of Canton and its residents will be served by the acceptance of the bid submitted Andrew Hensley and the sale of the Real Property to such bidder for the amount of $100.00, which amount represents the only and highest offer received on the property; and WHEREAS, it is found to be in the best interests of the City of Canton for the following reasons: 1. This property has been determined abandoned and declared unsafe. 2. The City has no interest in residential property except to help clean the City up. 3. Purchaser is required to demolish residence within 6 months of the closing. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Fulton County, Illinois, as follows: 1. The foregoing recitals are incorporated herein as findings of the City Council of the City of Canton, Fulton County, Illinois. 2. The offer to purchase by Andrew Hensley in the amount of$100.00 is hereby accepted by the City Council of the City of Canton for the sale of the Real Property. 3. The Mayor, or the City Attorney as his designee, is hereby authorized and directed to sign and the City Clerk is hereby authorized and directed to attest a contract for the sale and purchase of the Real Property, which contract shall be in the form attached hereto as Exhibit A. Upon satisfaction of the terms of the aforesaid contract and upon the payment or securing of the aforesaid bid price in the manner provided in said contract, the Mayor, or the City Attorney as his designee, is hereby authorized and directed to convey and transfer the Real Property to Andrew Hensley by proper deed of conveyance, stating therein the aforesaid consideration, and the City Clerk is hereby authorized to acknowledge and attest such deed and to affix thereto the seal of the City of Canton. 5. The Mayor, or the City Attorney as his designee, and the City Clerk are hereby authorized, respectively, to execute and attest such other documents as may be necessary to the conveyance herein authorized. 6. This ordinance shall be in full force and effect from and after its passage, by a vote of at least three fourths of the corporate authorities now holding office, and approval in the manner provided by law.
