Canton City Council held a regular meeting on Jan. 2, 1973 in the City
Council Chamber. Mayor Jennings called the meeting to order at 6:31 P.M.
Present for roll calls Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich,
Edwards, Peak, Cook, Spencer, Yerbic, Zaborac, and Kovachevich. Absent: Al-
derman Berry.
Pledge of Allegiance was followed by Tnvocation by Alderman Howard.
Mayor Jennings called for a five-minute recess at 6:32 P. T',. with the City
Attorney=, Finance Chairman and "Myor.

Council reconvened at 6:53 P. M.
I,layor Jennings requested permission from the Council to move the resignation
of Alderman Derry to the next item on the agenda. Permission granted. Letter
of resignation of Alderman r3erry read, effective immediately. Motion by Alder-
man Edwards and seconded by Alderman Sepich to accent this resignation. Roll
call vote. AYE: Aldermen Kovachevich, Zaborac, Yerbic, Spencer, Cook, Peak,
Edwards, Sepic' , Hurst, Wilcoxen, Farr, Howard, and Rupe. NAY: None. Mayor
Jennings instructed the City Attorney to send a letter of appreciation for the
work that Alderman Berry had done. Motion by Alderman Sepich, seconded by Al-
derman Yerbic to have this letter written and the motion carried by voice vote.
Mayor Jennings made the appointment of Don 0. Cardosi as Alderman to replace
Alderman Berry until such time as a special election could be held. Motion by
Alderman Edwards, seconded by Alderman Peak to confirm this appointment. Roll
call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich, Ed-
wards, Peak, Cook, Spencer, Yerbic, Zaborac, and Kovachevich. NAY: None. City
Clerk Crawford swore Don A. Cardosi in to the temporary office of Alderman of
Fourth Ward. Alderman Cardosi seated at 6:57 P. M.
City Attorney Malmgren stated that effective upon acceptance of the resignation
of Alderman by the Council, this date, a special election became necessary to
fill the seat of Alderman in Fourth 14ard because Leo Berryfs unexpired term was
f or more than twenty-seven months. Alderman Edwards moves, Alderman Hurst
seconds motion that the City Attorney draw a Resolution calling for the special_
election and also include in the election, the judges and places to hold said
election. Roll call. vote. AT : Aldermen Kovachevich, ?aborac, Yerbic, Spencer,
Cook, Peak, Cardosi, `,.dwards, Sepich, Hurst, Wilcoxen, Farr, Howard, and Rupe.
NAY: None.
Minutes of the previous meeting. *lotion by Alderman Yerbic, seconded by Alder-
man Cook to accent the minutes of the previous meeting and place same on file.
Motion carried b;- voice vote.
ikficers reports. 'Motion by Alderman Farr, seconded by Alderman Yerbic to
accent the renorts and place on file. Voice vote carried.
GarbageDisposal Department. Alderman Kovachevich stated there would be three
places for the deposit of Christmas trees: Athletic 'ark near the water
tower; north of the J nior High School, and Wallace Park area.
Special Committee reports.
B _lls for December. Piotion by Alderman Sepich, seconded by Alderman Spencer
that all. bills properly approved be allowed for payment. Roll call vote. AYE:
Aldermen Rupe, Howard, Farr., Wilcoxen, Hurst, Sepich, Edwards, Cardosi, Peak,
Cook, Spencer, Yerbic, Zaborac, and Kovachevich. NAY: None.
r--7 Alderman Sepich commended the Police Departiv:nt for the fine work done in the
crime case on Jan. 1. James Elam, Police Chief, stated his patrolman Rose was on
the job within five Minutes after receiving t1he first call and that State
Trooper' Dan Zinn from Avon worked on the case many hours after his time to be
off duty. Chief Elam stated he would send a letter of p_xai se regarding Officer
Zinn.
Communications to Council.
Annual report of the Church of God- in Christ presented. Alderman Hurst said

Cooperative Extension Service of Fulton County extended invitation to attend
Seminars regarding grants, loans,_ municipal finance, revenue sharing, street
maintenance, abandoned cars, derelect buildings, dogs, lak enforcement and
fire protection, garbage collection and disposal, open burning, cornmunity
clean-up, public health, housing, zoning, mobile homes, local planning and
regional planning and gave the dates of these seminars to be held in the Fulton
County Farm Bureau Building, north of Lewistown.
Thank you note from 111rs. Paul Spencer for flowers sent to her while ill.
Department of Transportation - re. 63CS, Second, Third Ave. and Chestnut St.
(2nd to 5th Ave. ', engineer fees clue at this time, 112,896.82. Motion by Al-
derman Sepich, seconded by Alderman Cook to allow this expenditure. Roll call
vote. AY,E: Aldermen Kovachevich, Zaborac, Yerbic, Spencer, Cook, Peak, Car-
dosi, Sepich, 'rlilcoxen, Farr, Howard, and Rupe. MAY: Aldermen 5%dwards and

E.P.A. regarding confirmation of telephone conversation -- Federal grant --
ci.t-T to waive-its right to a 75% Federal grant to a 50% Federal grant and re-
tain its 25% State grant.
E.P.A. regarding Federal grant giving certification No. 19-72 -- which means
t'iat the city's project has precedence aver any project of greater certifica-
tion number.
Crawford, Murphy & Tilly Engineering Firm regarding water and sewer to the
Spoon River College -- listing the requirements necessary to partidipate
in a Federal Grant agreement.
Alderman Edwards stated he was having a meeting of the people in his ward to
talk about the proposed sewers to be laid in that ward, Thurday, Jan. 4,
6:30 P. M. Canton Dai3j Ledger to publish a picture of the proposed work.
Resignation of Michael Elam, Radio Dispatcher, to accept position as deputy
to the Sheriff presented. Motion by Alderman Sepich, seconded by Alderman {
Wilcoxen to accept the resignation. Roll call vote. AYE: Aldermen Rupe,
Howard, Farr, Wilcoxen,-Hurst, Sepich, Edwards, Cardosi, Peak, Cook) Spencer,
Yerbic, Zaborac, and Kovachevich. NAY- None.
Paving Assessments for the Katherine Lear property, E. Ash St. for 55 C. re-
questing remission of all penalties, interest and costs, other than advertising
costs accruing after the maturity date of bonds issued to finance the improve-
ment. Motion by Alderman Sepich, seconded by Alderman Wilcoxen to grant this
request. Roll call vote. AVE: Aldermen Kovachevich, Zaborac, Yerbic, Spencers
Cook, Peak, Cardosi, Edwards, Sepich, Hurst, Wilcoxen, Farr, Howard, and Rupe.
NAY: None.
Illinois Commerce Ccmm _ssion regarding Illinois Bell Telephone notice of public
hearing, Jan. 10, 1973.

First reading of .an Ordinance -- Annexation property at 1150 S. Ave. r3 (Donald
E. Edwards and Paul L. Hurst owners) . Same to .lay over:
First reading of Ordinance abolishing Land Fill Operator. Same to lay over.
First reading of Ordinance -- salary of Aldermen. Same to lay over.
First reading of Ordinance -- Salary and months of work for the Canton Lake
Custodian. Motion by Alderman Howard, seconded by Alderman ILupe to suspend the
rules. Roll call vote. AYE: Aldermen Rupe, Howard, Farr, i,iilcoxen, Hurst,
Sepich, Peak, Cook, Spencer, Yerbic, ',aborac, and Kovachevich. NAY: Aldermen
Edwards and Cardosi. (12 AYES and 2 NAYS). Alderman Hurst moves, Alderman Yer-
bic seconds motion to place the Ordinance on its passage. Discussion. Alder-
man Edwards moves Alderman Peak seconds to amend the Ordinance that the Custodian
be paid `"200.00 per month for the same period instead of 215100.00 per month that

he had received each month in the past. Alderman Hurst stated he had
complaints of the work of the custodian, Alderman Edwards reported that
the custodian did a lot of work at the lake. Roll call vote on the amend-
- ment. AYE,,: Aldermen Peak, and Edwards. NAY: Aldermen Kovachevich,
Zaborac, Yerbic, Spencer, Cook, Cardosi, Sepich, Hurst, Wilcoxen, Farr,
Howard, and Rupe. (2 AY?,S and 12 NAYS) . Amendment failed. Roll call
vote on the original motion. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen,
Hurst, Sepich, Cardosi, Cook, Spencer, Yerbic, Zaborac, and Kovachevich.
NAY: Alderman Edwards and Peak. (12 AY-�S and 2 NAYS) . Motion carried. #404.
Resolution - Primary' and General Elections (Feb. 27 and Apr. 17), naming
places for voting and judges for the various wards. Motion by Alderman
Edwards, seconded by Alderman Farr to adopt the Resolution. Roll call
vote. AYE; Aldermen Kovachevich, Zaborac, Yerbic, Spencer, Cook, Peak,
Cardosi, Edwards, Sepich, Hurst, Wilcoxen, Farr, Howard, and Rupe. NAY:
None. This being Resolution No. 614.
Anpointments of Gregg Irons and Leroy Baylor as Auxiliary- Police by Mayor
Jennings. Motion by Alderman Hurst, seconded by Alderman Kovachevich
that the appointments ',)e. confirmed. Voice vote carried.
Mayor Jennings recommended the installation of a suspended stop light at
the intersect-ion of Main and Chestnut Street. Discussion. Alderman Farr
moves, Alderman Spencer seconds motion to give this stop light a thirty-
day trial. Roll call vote. AYE: Aldermen Howard, Farr, W_i.-lcoxen, Edwards,
Cardosi, Peak, Cook, Spencer, Yerbic, Zaborac, and Kovachevich. NAY: Al-
dermen Rupe, Hi.irst, and Sepich. (11 AYES and 3 NAYS) . "lotion carried.
Tnqui.ry regarding the railroad tracks by Alderman Cook. Mayor Jennings re-
ported he had complained about the presence of diesel engines in the city
again and same were removed.
Addressograph machine. Alderman Howard reported that no bids had been re-
ceived when same was advertised, but the Burroughs Corporation made an es-
timate of cost at 4P3019.78 and the AddressoF.ranh Company estimated ",2,643.92.
Alderman Howard moves, ,alderman Spencer seconds motion that the Mayor and
City Clerk enter into an Agreement with the Addressograph Corporation for
the purchase of a 1900 machine for x$2,653.92. Roll -call vote. A*1.7:;i,: Alder-
men Kovachevich, Zaborac, Yerbic, Spencer, Cook, Peak, Cardosi, Edwards,
Sepich, Hurst, Wilcoxeni, Farr, Howard, and Rupe. NAY: None. Since there
would be no trade-in value to the oldaddressograph machine, Alderman Howard
suggested it be placed in the Canton Museum. Agreement No. 224.
Motion by Alderman Yerbic, seconded by Alderman Rupe to adjourn. Voice vote
carried. Canton City Council adjourns at 8:22 P. M.-
