HomeMy WebLinkAbout04-11-1972 Council Meeting Minutes 384 April 11, 1972 Canton City Council held a regular meeting April 11, 1972 in the City Council Chamber. Mayor Jennings called the meeting to order at 6:30 P. M. Present for roll call: Aldermen Rape, Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Fulton and Kovachevich. Absent: None. Pledge of Allegiance was followed by Invocation by Alderman Edwards. Minutes of previous meeting. Motion by Alderman Yerbic, seconded by Alderman Peak to accept same and place on file and motion carried, voice vote. Bills for March. Motion by Alderman Edwards, seconded by Alderman Berry that all bills properly approved be allowed for payment. Roll call vote: Aldermen Kovachevich, Fulton, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen, Parr, Howard and Rupe. NAY: None. Representative from Sterling Codifiere, Inc. , Mr. Robertson W. Smith, granted permission to address the Council regarding updating the Ordinance book for the City. Mr. Smith explained the need, cost, and procedures for same. Petition: Request to rezone property in the Wright's Addition for use of mercantile establishment, selling monuments, headstones, and related fixtures by Den;el D. and Shizue Jines and Bernard and Juanita Abel. Motion by Alderman Sepich, seconded by Alderman Edwards to refer the Petition to the Planning and Zoning Commission and motion carried, voice vote. Petition No. 238. Petition - Rezoning portion of Graham Hospital Association property for use of proposed mental health facility. Motion by Alderman Sepich, seconded by Alderman Hurst to refer this Petition to the Planning and Zoning Commission and motion carried, voice vote. Petition No. 239. Petition - Mr. and Mrs. Jack Waughtel for permission to operate a beauty parlor at 449 Forth Third Avenue, signed by four of the immediate property owners. Letter from the Planning and Zoning Commission recommending issuance of A Special Use Permit as requested. Alderman Howard inquired about placing a place of business on the second floor (with only one stairway) if fire mare?)all would approve and that the Council should not grant special use permit until fire marshwll had given approval. Action deferred until the next meeting, after fire marshwll has made inspection. Alderman Edwards states that the local fire department makes inspection, then refers to the state fire marshwll for his recommendation. Motion by Alderman Hurst, seconded by Alderman Edwards that the City Attorney be authorized to draft a Resolution granting this special permit. Voice vote carried. Petition No. 240. Standirg Committee reports. Garbage Disposal Committee: Alderman Kovachevich moves, Alderman Yerbic seconds motion that the Garbage Disposal Committee be authorized to advertise for a new garbage truck and the motion carried by voice vote. Street and Alley Departments Alderman Howard reported that a look at the need for permanent streets would be in order. Special Committee reports. Landfill: Alderman Kovachevich reported on a meeting of the County Landfill Committee, landfill not ready for operation until after May 1, 1972. Clean Up Day in Canton: Alderman Edwards reported that Don Cardost had been working with the Betterment Committee on the Gabby Day project and stated he had volunteered two city tracks and the endloader for the clean-up day. Alderman Edwards moves, Alderman Howard seconds motion that city furnish two trucks and the endloader for use on April 15, 1972, clean-up day. Roll call vote. AYE: Aldermen Kovachevich, Fulton, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen, Farr, Howard and Rupe. NAY: None. Communications to Council. Thank you note for flowers sent at the time of Judy Jenkinsl death. St. Jude's Day. Request from Mrs Marilyn Davis, Chairman of the Fulton County St. Jude Committee for "Tag Day" Friday, April 28, 1972 and a teen-age drive May 7, 1972 - door-to-door solicitation. Motion by Alderman Farr, seconded by Alderman Kovachevich to grant this request. Voice vote carried. 3 8 April 11, 1972 Cont'd. (2) Resignation - C. Eugene Taylor from the Planning and Zoning Commission, effective immediately. Motion by Alderman Hurst, seconded by Alderman Yerbic to accept this resignation. Voice vote carried. Motion by Alderman Hurst, seconded by Alderman Wilcoxen to authorize the City Clerk to write a letter of thanks to Mr. Taylor for his service to the City. Raviromtental Protection Agency - Letter advising of EPA sign being sent to the City for pollution control efforts of the City through a financial grant under the 1970 Anti-Pollution Bond Act. Insurance - Letter from Prudential Insurance Co. announcing an increase for rates. Motion by Alderman Howard, seconded by Aldermani Farr recommends that the Insurance Committee investigate the insurance programs and report back to the Council and the motion carried by voice vote. Motion by Alderman Hurst to authorize the Insurance Committee to advertise for bids if they see fit. Alderman Wilcoxen seconds this motion. Voice vote carried. Recommendation from the Planning and Zoning Commission recommending rezoning the Geo. Sebree property from an R-1 to a R-4 Multiple Family Residential zone. Recbmmmendation from the Planning and Zoning Commission recommending rezoning to a 71-:4 Multiple family residential - the property of Eetea Baker to be designated as a t- nursing home. Attorney Kenneth Bath explained the petitions and Ordinances concerning same. Ordinance had been presented to Council on March 7, 1972. Motion by Alderman Hurst, seconded by Alderman Wilcoxen to place the Ordinance on its passage. Roll call ;i, vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, IIu.rst, Sepich, Edwards, Berry, C,7 Peak, Cook, Spencer, Yerbic, Fulton and Kovachevich. NAY: None. Petition No. 241 & 242. and Ordinance No. 371 & 372. Letter from Illinois Commerce Commission addressed to Mr. William' Malmgren, City Attorney regarding complaints of diesel engines left running while parked on tracks in residential areas in Canton and the plans of the railroad company to eliminate same. Motion by Alderman Fulton, seconded by Alderman veak to requPst the City Attorney to write to the railroad companies to $et a definite date of this plan. Motion carried by voice vote. Attorney-in-Fact: Notice that the Town and County Insurance Company have designated Robert L. Fouts or Harry P. Eaton of Canton, as having eow,-r-of-Attorney for their company. Motion by Alderman Edwards, seconded by Alderman Yerbic to place the letter on file and voice vote carried. Old business. Second reading of Ordinance Annexation and Rezoning Big Creek Enterprises, Lake View Dri^e, Annexation and Rezoning; Resolution of intent to provide good access connection to the shopping center from Ash St. through the property north of the center site and Ash St. extended; copy of letter addressed to Mayor Jennings regarding willingness to provide a sewer easement(correcting Ordinance 370 passed on March 28, 1970. Motion by Alderman Edwards, seconded by Alderman Yerbic to place the Ordinance on its passage. Roll call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Fulton and Kovachevich. NAY: None. Ordinance lei. 373. Resolution 585. Second reading of an Ordinance pertaining to truck routing through the City. Motion by Alderman Farr, seconded by Alderman Sepich to place the Ordinance on its passage. Roll call vote. AYE: Aldermen Kovachevich, Fulton, ?erbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen, Farr, Howard and Rupe. NAY: None. Ordinance No. 374. Alderman Farr requested that the Building and Grounds Committee check on the air conditioner. Resolution - Bettermen Commission for "Arbor Week in the City" - April 23 through April 30, 1972, (Apr. 28 set aside as Arbor Day). Mrs. Ursula Walter, Mrs. Mickie Estes, Mrs. Joan Westover, and Miss Rosemary Kelly attending the Council meeting and Mrs. Walter spoke to the Council. She thanked the Council for their consideration, urged everyohe to plant a tree during that week, the one-hundreth anniversary of Arbor Day. Motion by Alderman Edwards, seconded by Alderman Spencer to adopt the Resolution. Roll call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Fulton and Kovachevich. NAY: None. Resolution No. 586. 38 April 11, 1972 Contd. (3) Resolution - Special use permit for use for parking facilities for David and Sharon Smith.. Motion by Alderman Kovachevich, seconded by Alderman Fulton to adopt the Resolution. Roll call vote. AYE: Aldermen Kovachevich, Fulton, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen, Farr, Howard, and Rupe. NAY: None. Resolution No. 587. Alderman Farr asked for a report of the investigation of the Robert Wheeler property, Chief of Police stated he had told Mr. Wheeler the property would have to have cleaning-up done. New business. Resolution - Division of Highway for use of Motor Fuel Tax Funds for curb and side- walki removal and replacement on south side of Chestnut between White Court and First Avenue, estimated cost $12,000.00. Motion by Alderman Yerbic, seconded by Alderman Peak to adopt this Resolution. Roll call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Fulton and Kovachevich. NAY: None. Motion by Alderman Spencer, seconded by Alderman Yerbic recommending an rdinanee, for condemnation of property. Voice vote carried. Motion by Alderman Farr, seconded. by Alderman Spencer that the City Attorney be authorized to draft an Ordinance regarding condemnation of dangerous property and the motion carried by voice vote. Alderman Farr announced the annual dinner meeting of the Fulton County Safety Council on April 19, 1972, 6:30 P. M. in St. Mary's Gym. and urged all Coundilmen to attend. Alderman Berry moves that the street light on Fourth Avenue and Liberty Place be moved to the east side of the railroad tracks, Alderman Fulton seconds this motion and voice vote carries. Alderman Edwards reported a light pole on the parking lot on White Court driveway should be investigated. Alderman Berry complained that vision was obstructed by the vehicles on the Sprague Trailer Sales lot. James Elam, Chief of Police and Alderman Sepich investigated the problem and reported that the trailers had been set further back on the lot. Sewer and. Water Committee and Finance Committee to meet soon regarding property near Linn Street. Payroll Ordinance. Alderman Farr moves, Alderman Edwards seconds motion to allow the first reading of same, because of the urgency, at this time although the Aldermen did not have a copy of same in their possession twenty-four hours prior to the Council meeting. Motion carried by voice vote. Payroll Ordinance read. Same to]ay over. Ordinance - Annexation and Rezoning - northeast of Bradley Corner - George Sebree property. Alderman Edwards moves, Alderman Sepich seconds motion to read the. Ordinance by Title only. Voice vote carried. Title read. Attorney Ralph Froehling representing George Sebree, explained the proposed use of this property. Motion by Alderman Hurst, seconded by Alderman Spencer, that the attornies for this matter should have shown their good faith by Their presence and requests that the Ordinance be tabled. Roll call vote. AYE: Aldermen Kovachevich, Spencer, Cook, Peak, Betty, Edwards, Sepich, Hurst and Wilcoxen. NAY: Aldermen Fulton, Yerbic,. Farr, Howard pnd Rupe. (9 AYES and 5 NAY). Motion to table Ordinance carried. Mayor Jennings stated that whenever the subject of zoning or rezoning a piece of property, the ouestion of schools always comes up. First reading of an Ordinance pertaining to Boating on Lake Canton, Same to lay over. Motion by Alderman Fulton, seconded by Alderman Yerbic to adjourn. Voice vote carried.
