Jan. 4, 1972
Canton City louncil held a regular meeting on Jan. 4, 1972 in the City
Council Chamber. Mayor Jennings called the meeting to order at 6:30 P M.
Present for roll call: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich,
Edwards, Berry, Peak, Cook, Spencer, Yerbic, Fulton, and Kovachevich. Absent:
None.
Pledge of Allegiance was followed by Invocation by Alderman Edwards.
Minutes of previous meeting. Motion by Alderman Yerbic, seconded by Alder-
man Peak to accept same and place on file. Motion carried voice vote.
Petition requesting annexation of the Joseph Genovich property and letter
from the 'Manning and Zoning Commission recommending this annexation presented
to Council. Motion by Alderman Sepich, seconded by Alderman Wilcoxen to re-
fer the matter to the Ordinance Committee and City Attorney to have an Ordi-
nance drafted and the motion carried, voice vote. Petition No. 232.
Reports of Officers. Motion by Alderman �arr, seconded by Alderman Berry to
accept reports as submitted and the motion carried voice vote.
Standing Committee reports.
Lake Development Co. to meet Thurs. Jan. 6, IM, 6:30 P. M. announced by
Alderman Hurst.
Bills for December. Alderman Edwards moves, Alderman Yerbic seconds motion
to allow payment on all bills that are properly approved. Roll call vote.
AYE: Aldermen Kovachevich, Fulton, Yerbic, Spencer, Cook, Peak, Berry, Ed-
wards, Sepich, Hurst, Wilcoxen, il'arr, Howard, and Rupe. NAY: None.
Special Committee reports.
Junk cars. Alderman Edwards reported a large number of junked cars are accu-
mulating at the old dump grounds -- he and the Chief of Police will contact
someone about removal of same.
Alderman Howard inquired about the number of cars parked along the city streets,
Street Superintendent, Eldon Myers had no complaints to make.
Communications to Council.
Thank you note for flowers from Walter "Gene" Jenkins.
Letter from Crawford, Murphy & Tilly regarding the approval by Division of
Highways of estimate of cost, specifications, plans and contract proposal for

Old business.
Second reading of Ordinance pertaining to rezoning Big Creek Enterprises, Inc.
property. Alderman Edwards stated he had a telephone conversation with Atty.
James Elson -- a meeting was supposed to have been scheduled, but was never
made -- Ald erman Edwards moves to hold the Ordinance over until the next
Council meeting - after an interview with Mr. Elson; Alderman Farr seconds
this motion and it carried voice vote. Meeting with Mr. Elson to be held im-
mediately following the Council meeting (requesting that City Engineer, Howard
Gibhons also be present).
Land Fill Ordinance - second reading. Motion by Alderman Kovachevich to strike
"Jan 1, 1972" from Section 10 of the Ordinance, seconded by Alderman Fulton.
Roll call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich,
Edwards, Berry, Peak, Cook, Spencer, Yerbic, Fulton, and Kovachevich. NAY:
None. Motion by Alderman Kovachevich, seconded by Alderman Sepich that the
Ordinance be read by 'title only -- and voice vote carried. Title read. Alder-
man Kovachevich reported that the seven man Garbage Committee O.K.ed the Ordi-
nance completely and that it would not place a hardship on anyone - the City
needs revenue to meet the restrictions placed by the Environmental Protection
Agency. Alderman Kovachevich moves, Alderman Sepich seconds motion that the
Ordinance be placed on its passage. Alderman Fulton objected to the x1.00 per
load to be charged for residents. Roll call vote on the motion. AYE: Alder-
men Kovachevich, Yerbic, Spencer, Cook, Peak, Edwards, Sepich, Hurst, Wilcoxen,
Farr, Howard, and Rupe. NAY: Aldermen Fulton and Berry. (12 AYES and 2 NAYS) .
Motion carried. This being Ordinance No. 367.

Ordinance, second reading, regarding sale of property on E. Locust Street. Mo-
tion by Alderman Hurst, seconded by Alderman Yerbic that this item be striken
from the Agenda until a later date and the motion carried, voice vote.
New business.
Alderman Yerbic asked for permission for Mr. Richard Lynch to speak to the
Council. Mr. Lynch, representing the residents in his neighborhood, objected
to the City permitting laying of sewer and water lines to the Lawrence Horton
property - the proposed mobile home park property, outside the City and being
considered for rezoning by the Fulton County Zoning Commission. Discussion. Al-
derman Fulton moves, Alderman Yerbic seconds motion that no permit be given for
installing sewer and water lines to this property until the Sewer and Water Com-
mittee has investigated and reports to the City Council -- entire Council to
take any action on the matter. Voice vote carried.
Mayor Jennings made a report on the money that pays for the public parking lots,
each lot is paid for by a special account made up from receipts from meters and
fines.
Fire Station - Mayor Jennings reported on the investigation made by the state
underwriters who met with the Mayor and Chief of Fire Dept., James Woods, and
the Plumbing Inspector, Harold White. '`he truck rating was made by pulling water
.. from a well and not from hydrants. The Mayor stated there is a different type of
pump costing about $200.00 and this has been ordered. Regarding the fire station
in the east part of the City -- Asstl.Fire Chief, James Grier, has been training
volunteer firemen and later the City may be able to use more volunteers. The
V Mayor appointed a committee to work i th the Mayor, City Attorney and Treasurer
and report back to the Council as to what could be done; Aldermen Howard, Hurst,
Rupe, Edwards, Spencer, Yerbic, Fulton, and Peak.
Land Fill Anplications: Applications for permits read: Loyd Dodd (1), G & G (2),
Chester Hedges (1), Leroy Kidd (1), R. D. Kruzan (2),. Peterson & Anderson (1),
Jack Romine (1), Ronald iiidger (1); Street Superintendent, Eldon Myers, stated
he had inspected all trucks extent Loyd Doddts and Donald Widger's and had approved
all the others. Motion by Alderman Sepich, seconded by Alderman Yerbic that-all
permits 0. K.ed by the Street Superintendent be allowed to use the landfill.
toll call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst., Sepich, Ed-
wards, Berry, Peak, Cook, Spencer, Yerbic, Fulton, and Kovachevich. NAY: None.
A discussion followed regarding a trucker from transferring his truck for another
vehicle and if a new permit fee was to be obtained. . Motion by Alderman Hurst,
seconded by Alderman Farr that the Garbage Disposal Committee meet and make some
recommendations regarding transfers. voice vote. carried.
Est-!mate No. 1, Foster Jacob, Inc. for Motor Control .panel at the water plant
in the amount of $1,507-50. Motion by Alderman Edwards, seconded by Alderman
Rupe that the estimate be allowed for payment. Roll call vote. AYE: Aldermen
Kovachevich, Fulton, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst,
Wilcoxen, Farr, Howard, and Rupe. NAY: None.
Ordinance - Street Dedication - Charles : artin, owner. Motion by Alderman Hurst,
seconded by Alderman Peak to suspend the rules. Roll call vote. AYE: Aldermen
Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, teak, Cook, Spencer,
Yerbic, Fulton, and Kovachevich. NAY: None. Motion by Alderman Hurst, seconded
b,-- Alderman Sepich to place the Ordinance on its passage. Roll call vote. AYE:
Aldermen Kovachevich, Fulton, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich,
Hurst, Wilcoxen, Farr, Howard, and Rupe. NAY: None. This being Ordinance No.
368. Letter from City A ;r
Attorney Wm. Malm en to Mr. "Martin read. Motion by Alder-
man Howard, seconded by Alderman Wilcoxen that a letter stating the culverts will
be built. Roll call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst,
Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, .Fulton, and Kovachevich.
NAY: None. Mayor Jennings to write a letter to 1,1r. Martin.
Motion by Alderman Yerbic, seconded by Alderman vilcoxen to adjourn. Voice vote
carried. Canton City Council adjourns at 7:30 P. M.
