Dec. 7, 1971
Canton City Council held a regular meeting Dec. 7, 1971, in the City Council
Chamber. Mayor Jennings called the meeting to order at 6:31 P. M. Present
for Roll Call: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards,
Berry, Peak, Cools, Spencer, Yerbic, Fulton, and Kovachevich. Absent: None.
Pledge of Allegiance was followed by Invocation by Alderman Edwards.
Minutes of previous meeting. Motion by Alderman Yerbic, seconded by Alderman
. Cook to accept same and place on file and motion carried, voice vote.
Petition and Ordinance for rezoning (R-2 to R-4), George Florea property --
Lots 1 and 2 in Block 1 in Babcock's Quality Hill 1'hird Addition. Letter from
the Planning and Zoning Commission read recommending that the rezoning from I'
R-2 to R-4 be allowed. Ordinance read, same to lay over. Petition No. 229.
Petition - Stuart B. and Jeanne M. Harris - 705 N. Main St. - requesting re-
zoning from R-2 to R-4 (for use as a Nursery School presented. Motion by Al-
derman Sepich, seconded by Alderman Yerbic to refer this Petition to the Plan-
ning and Zoning Commission and the motion carried voice vote. Petition -No. 230.
Claims against the City. Motion by Alderman Sepich that all bills properly
approved be allowed for payment. Roll call vote. AYE: Aldermen Kovachevich,
Fulton, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen,
Farr, Howard, and Rupe. NAY: None.
Reports of officers presented. Motion by Alderman Yerbic, seconded by Alder-
man Cook to accept same and place on file and motion carried voice vote.
Standing Committee reports.
Garbage Disposal Committee Chairman, Alderman Kovachevich, reported on a
meeting regarding the proposed ordinance (to be read later in the meeting) .
Traffic Committee Chairman, Alderman Sepich reported on a meeting of that
committee.
Street and Alley Committee Uhairman, Alderman Howard, reported that the IHC
bulldozer was in need of repairs -- cost to be approximately $2872.00 and
moves that the repairs be made, Alderman Kovachevich seconds the motion and
roll call vote taken. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst,
Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Fulton, and Kovachevich.
NAY: None.
Special Committee reports.
Alderman Hurst reported on a meeting of the special Trailer Court Committee --
no answer yet, but another meeting to be held soon.
Communications to Council.
Invitation from the "Begi nning Teen" Center to an open house, Dec. 16, 1971,
7:00 P. M. to 9:00 P. M., to all the Aldermen read. Mayor Jennings urged all
the Aldermen to attend.
Next item on the agenda, bill from the General Communications Co., Alderman
Hurst moves, Alderman Farr seconds motion that this item be struck from the
agenda since the matter had been cleared. Motion carried by voice vote.
Resignation of Dan Holman from the Canton Youth Commission read. Motion by
Alderman Sepich, seconded by Alderman Yerbic to accept this resignation and
the motion carried 13 AYES and 1 NAY (Alderman Fulton) .
Copy of letter from City Attorney Wm. Malmgren to the railroad companies in-
viting representatives to attend the Council meeting. Three representatives h
from the Burlington Northern and Toledo, Peoria & vestern Railroads were pre-
sent; Mr. Al Polich and Mr. Ralph. Sausman (TP&W) and Mr. John Ketcham, CBBfQ) .
Explanation of the schedules and procedures of taking coal cars through Can-
ton was made; discussion and question period followed. It was recommended
that some one person from the City to act as liaison with the railroad com-
panies. Mayor Jennings recommended that Chief of Police, James Elam serve
as liaison officer, thus assisting the Fire and Police Department, ambulance
service and citizens of Canton.

Environmental Protection Agency - letter regarding inspection of the land-
fill made on Oct. 27, 1971, recommendations for corrections of violations,
`Discussion. A copy of the letter sent to the landfill operator to be made
for the Mayor.
Alderman Wilcoxen excused from the Council Chamber at 7:29 P. M.
Report from the U. S. Fidelity and Guaranty Co, of inspection of building at
114 N. Main St. and their recommendations for improving safety conditions.
Alderman Spencer inquired about the Federal Grant that was to be given for
this building and the Mayor stated he had made calls to the Governor, Lt.
Governor, Sen.Knuppel and Congressman Railsback that no funds had been re-
ceived, but that no messages had been returned. Motion by Alderman Hurst to
close the Youth Center for thirty days until a better understanding has been
reached, Alderman Farr seconds this motion. Discussion. Alderman Howard
moves to Table this motion to give the people a chance to build up the teen
group, Alderman Fulton seconds this motion. Roll call vote to table the motion
made by Alderman Hurst. AYE: Aldermen Kovachevich, Fulton, Yerbic, Cook, Peak,
Berry, Edwards, Sepich, and Howard. NAY: Aldermen Spencer, Hurst, Farr, and
Rupe. (9 AYES and 4 NAYS). Motion carried. Motion by Alderman Hurst, seconded
by Alderman Rupe that the Building and Grounds Committee not authorize the spend-
ing of any more money for the Youth Center. Voice vote carried.
U4 Division of Highways - Fifth Ave. and Locust Street railroad crossings, and
M designating detours to be made while the crossings are being repaired. Motion
by Alderman Howard, seconded by Alderman Hurst to authorize the proper detours
V and instruct the City Clerk to forward such authorization to the Division of
V Highways. Boll call vote. AYE: Aldermen Rupe, Howard, Farr, Hurst, S pick,
i'dwards, ferry, Peak, Cook, Spencer, Yerbic, Fulton, and Kovachevich. AY:None.
Alderman Hurst reported on a matter discussed at the Planning and Zoning Cam.
meeting on 'Dec. 6, 1971 -- that of rezoning a lot on East Ash Street. lie
recommended that, instead of rezoning this property, permission be given for
this one family to use the said lolk: for parking cars and then moves that the
City Attorney draft a letter stating so to the family involved. Alderman Rupe
seconds this motion. Roll call vote. AY,: Aldermen Kovachevich, Fulton, Yer-
bic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Farr, Howard, and
Rupe. NAY: None.
Department of Corrections report of inspection of the city jail and stating
the building should no longer be e-d to house prisoners.
Old business.
Second reading of Landfill Ordinance. A few changes made in the original
Ordinance read. Motion by Alderman Kovachevich, seconded by Alderman Hurst,
that the aaatin&aents: Sec. 3, Sec. 9 (d), Sec. 10 (a, b, c.) and Sec. 12 of
the original Ordinance be accepted. Voice vote. (12 AYES and 1 NAY) (Alder-
man Bury). Alderman Kovachevich moves, Alderman Yerbic seconds motion that
the Ordinance be read by Title only and the motion carried. Motion by Alderman
Kovachevich, seconded by Alderman Peak to place the Ordinance on its passage.
Alderman Berry stated the prices were too high and the Council should wait un-
til after the first of the year before making any changes. Roll call vote.
AYE: Aldermen Rupe, Howard, Farr, Hurst, Sepich, Edwards, Peak, Cook, Spencer,
Yerbic, Fulton, and Kovachevich. NAY: Alderman Berry (12 AYES and 1 NAY).
This being Ordinance No. 362.
Annexation and Rezoning, Sam Lingenfelter prooerty Ordinance up for second
reading. Motion by Alderman Howard, seconded by Alderman Hurst that the Ordi-
nance be read by Title only and the motion carried, voice vote. Title read.
Alderman Edwards moves, Alderman Berry seconds motion to place the Ordinance
on its passage. Roll call vote. AYE: Aldermen Kovachevich, Fulton, Yerbic,
Spencer, Cook, Peak, Berry, Edwards, Hurst, Farr, and Howard. NAY: Aldermen
Sepich and Rupe. (11 AYES and 2 NAYS) . Motion carried. Ordinance No. 363.
Traffic Ordinance up for Second reading. Motion by Alderman Edwards, seconded
by Alderman Cook that the Ordinance be read by Title only and the motion
carr'.ed, voice vote. Title read. Alderman Sepich moves, Alderman Peak seconds
motion to place the Ordinance on its passage. Roll call vote. AYE: Aldermen
Rupe, Howard, Farr, Hurst., :=epich, Edwards, Berry, Peak, Cook, Spencer, Yerbic,
Fulton, and Kovachevich. NAY: None. This being Ordinance No. 364.

Resolutions for Motor Fuel Tax Funds: Motion by Alderman Hurst, seconded by
Alderman Cook that the five Resolutions be read and acted on at bhe time and
the motion carried by voice vote. Resolutions read: 48 CS and 51 CS, Princi-
pal $11,869.90, Interest $563.50, Total $12,433.40; 45 CS Principal $16,760.00,
Interest $5,866.002 Total $223626.00; 46 CS Principal $13.,520.00, Interest
$4,730.00, Total $18,252.00; 59 CS Interest.$8,296.10; 61 CS Interest $15,568.20.
Motion by Alderman Edwards, seconded by Alderman Spencer to adopt the Resolutions.
Roll call vote. AYE: Aldermen Kovachevich, Fulton, Yerbic, Spencer, Cook, Peak,
Berry, Edwards, Sepich, Hurst, Farr, Howard, and Rupe. NAY: None. 48 CS and

Resolution Street Lights - Bradley Corner & E. Chestnut St; West Olive, Avenue B,
and Av enue G. Motion by Alderman Berry, seconded by Alderman Sepich to adopt
the Resolution. Roll call vote. AYE: Aldermen Rupe, Howard, Farr, Hurst, Sep-
ich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Fulton, and Kovachevich. NAY:
,Non$.. Resolution No. 581.
Mayor Jennings asked the Lights Committee to inspect Fourth Avenue and Liberty
Place for need of street lights and report to the Council.
Estimate No. 5 (and final) Boat Launching Dock, Canton Concrete Products, in
the amount of $5,239.22 presented. Motion by Alderman Hurst, seconded by Alder-
man Cook that the bill be authorized for payment and direct the engineers to
see about extra funds on this project. Roll call vote. AYE: Aldermen Kovache-
vich, Fulton, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Farr,
Howard, and Rupe. NAY: None.
Bonds: Transamerica Insurance Co., each for $1,000.00 properly approved by the
Finance Committee for Charles D. Wright, Fire and Police Commissioners Ralph
Arnett, Auxiliary Police, and Ann Moore, Meter maid. Motion by Alderman Ed-
wards to accept same and place on file, seconded by Alderman Peak. Roll call
vote. AYE: Aldermen Rupe, Howard, Farr, Hurst, Sepich, Edwards, Berry, Peak,
Cook, Spencer, Yerbic, Fulton, and Kovachevich. NAY: None.
C A T V. Mr. Stuariv Harris, representing the Cable Television reported on
work standstill beyond their control and that as soon as possible, the service
would be completed.
Appointment of Attorney Kenneth Bath to the Canton Youth Commission. Motion
by Alderman Fulton, seconded by Alderman Yerbic to accept this appointment and
the motion carried voice vote.
Mayor Jennings reported on the Association of Commerce and Industry and their
need for a new office building and suggested that the Council consider the
south side of the old Canton Wholesale Building (114 N. Main St.). Motion by
Alderman Spencer, seconded by Alderman Yerbic that the City Attorney check in
to the legality of same and the motion carried voice vote.
City lot on the corner of East Locust Street and Bixth Avenue. (formerly pur-
chased for use as a Fire and Police Station) could be sold. Alderman Sepich
moves, Alderman Cook seconds motion that the City sell this lot as advised by
the City Attorney after the first of the new year. Voice vote carried.
Ccmmfort Station. Alderman Spencer moves that the drawings and plans for a com-
fort station be confirmed and proceed with building same. Alderman Hurst seconds
this motion. Roll call vote. AYE: Aldermen Kovachevich, Fulton, Yerbic, Spen-
cer, Cook, Peak, Berry, Edwards, S_pic#, Hurst, Farr, Howard, and Rupe. NAY:
None. Alderman Spencer then moves, Alderman Hurst seconds motion that the
Council advertise for bids for the installation of the plumbing in the Comfort
Station - bids to be received by 5:00 P. M., Dec. 21, 1971 - in the City Clerk's
office. Roll call vote. AYE: Aldermen Kovachevich, Fulton, Yerbic, Spencer,
Cook, Peak, Berry, Edwards,. S,pich, Hurst, Farr, Howard, and Rupe. NAY; None.
Water and Sewer Committee meeting announced by Alderman Rupe for 6:30 P. M.,
Tuesday, Dec. 14.
Garbage Disposal Committee meeting, 7:30 P. M., Tuesday, Dec. 14, announced by
Alderman Kovachevich.

Bicycle Ordinance presented to Council. Motion by Alderman Fulton, seconded
by Alderman Peak that same. be read by Title only. Voice vote carried.
Title read. Ordinance to lay over.
City Attorney Malmgren asked the Council to advise the City Clerk of any items
to be placed on the Agenda by noon on the day of Council meetings.
Alderman Edwards announced the Oak Lawn Carolers program to be held Friday,
Dec. 101 1971, tickets for same 50¢, proceeds to go for children in Canton who
would otherwise have no Christmas.
Motion by Alderman Fulton, seconded by Alderman Yerbic to adjourn. Voice vote
carried. Canton City Council adjourns at 8:50 P. M.
