Nov. 16, 1071
Canton City Council held a regular meeting on Nov. 16, 1971 ih the City
Council Chamber. Mayor Jennings called the meeting to order at 6:30 P.M.
Present for roll call: Aldermen Rape, Farr, Hurst, Sepich, Edwards, Berry,
Peak, Cook, Spencer, Yerbic, Fulton, and Kovachevich. Absent: Aldermen
Howard and Alderman Wilcoxen. (Alderman Wilcoxen arriving at 6:43 P.M.)
Pledge of Allegiance was followed by Invocation by Alderman Edwards.
Minutes of previous meeting. Motion by Alderman Yerbic, seconded by Alder-
man Cook to accept same and place on file and the motion carried, voice vote.
Petition with nine signatures objecting to the placement of any mobile homes
in the vicinity of 13th Avenue, Myrtle and Vine Street. Discussion. Motion
by Alderman Hurst, seconded by Alderman Peak to refer this Petition to the
Zoning Officer;
Alderman Wilcoxen arrives in Council Chambers at 6:43 P. M.
Petition for Annexation - William Hahn property (Cl.ar tona), presented. This
being Petition No. 227. Ordinance for annexation '6f the William Hahn
property (Claratona) . Motion by Alderman Edwards, seconded by Alderman Farr
to suspend the rules. Roll call vote. ZYE: Aldermen Kovachevich, Fulton,
Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen, Farr,
and Rape. NAY: None. Motion by Alderman Berry, seconded by Alderman Ko-
vachevich to place the Ordinance on its passage. Roll call vote. AYE:
V Aldermen Rape, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook,
Xpencer, Yerbic, Fulton, and Kovachevich. NAY: None. This being Ordinance
No. 36o.
Petition protesting the Sam Lingenfelter property proceedings. Letter from
Mr. James Van Sickle read. Alderman Sepich requests that the objections to
Petition be read. Discussion. Motion by Alderman Sepich, seconded by Alder-
man Edwards that the City Attorney explain the Trailer Ordinances to the City
Council before voting takes place on the Li.ngenfelter Petition of Objections.
Voice vote carried. City Attorney Ma]mgren explained the Mobile Home Ordi-
nance. Motion by Alderman Sepich, seconded by Alderman Edwards to place the
Petition on file and the motion carried by voice vote. Petition IT0,228.
Motion by Alderman Farr, seconded by Alderman Yerbic that a copy of all
Petitions presented to the City Clerk's office should be presented to the
Mayor's office by noon of the day of Council meeting and the motion carried
by voice vote.
Standing Committee Reports. Alderman Kovachevich reports on Garbage Commjltee
meeting November 9, 1971. Recommendations: 1. All commercial haulers of one-
half ton trucks must have an annual permit fee to use landfill (fe4o be $50.00);
2 One-half ton to three-fourths tong truck, commercial haulers to pay annual
permit fee of $50.00 plus $1.00 per load for licensing fee of $60.00 per
quarter, $110.00 half year or $200.00 annual, $1.00 per load if not in business;
3. All commercial haulers three-fourths ton to two-ton permit fee of $50.00
and the option of paying $10.00 per load or licens=ing fee of $120.00 per quarter,
$220.00 half year or 11100.00 annual rate (no limit on loads); 4. All commercial
packer trucks and trucks above two-tons pay permit fee of $50.00 and the option
of paying $15.00 per load or licensing of $210.00 per quarter, $385.00 half year,
or $70040 annual rate; each vehicle shall have a separate permit fee and the
committee also recommended these rates go into effect Jan. 1, 1972. Discussion.
Alderman Spencer calls for a meeting of the Building and Grounds Committee and
any other interested parties, Wednesday, Nov. 17, 1971s 6:30 P. M.
Special committee reports.
Alderman Hurst reported on a meeting of the Special Committee on locating
Trailers. No decision made but recommendations that all Petitions be filed
with the City Clerk, then presented to the City Council who will refer same
to the Zoning Enforcing Officer.
Alderman Hurst calls for a meeting of the Special Committee following the
Building and Grounds Committee, Wednesday, Nov. 17, 1971
Traffic Committee to meet with Fulton County Road and Bridge Commission, Wed.,
Nov. 24, 1971 at 6:30 P. M. in Council Chambers, announced by Alderman Sepich.

Communications to Council.
Environmental Protection Agency letter regarding follow-up inspection
of municipal landfill.
Central Region Municipal Association Dinner Party, Dec. 10, Elks Club,
Macomb. Reservations to be made with City Clerk by Dec. 1 (Reservations
$4.25 - money to be sent to Macomb by Dec. 1) .
Illinois Inspection and Rating Bureau regarding an inspection to be made
in Canton soon.
Engineer of Local Roads and Streets regarding fees for services.
Burlington-Northern Railroad - regarding use of tracks in south part
of city. Motion by Alderman Yerbic, seconded by Alderman Spencer to place
the above letters on file and the motion carried by voice vote. Alder-
man Edwards recommends that a copy of the Burlington Northern Railroad
letter be sent to the Fire and Police Department and Alderman Hurst.
Alderman Berry makes a motion, seconded by Alderman Peak that the City
Attorney be instructed to invite the engineers from the Burlington-
Northern Railroad and the T P & W RR to attend the next City Council
meeting and the motion carried by voice vote.
Resignations of LeRoy Gillam, Kenneth Bath and Denzel Sines from the
Canton Youth Commission. Motion by Alderman Sepich, seconded by Al-
derman Farr to accept these resignations and the Motion carried by voice
vote. Mayor Jennings recommends that an informal meeting with the Canton
Youth Commission be held Monday, Nov. 22, 1971, 6:40 P. M. in the City
Council Chambers. Alderman Edwards recommends everyone be notified by
postcard.
Old business.
Second reading of Ordinance - renaming portion of W. Maple Street. Mo-
tion by Alderman Sepich, seconded by Alderman Hurst to read Ordinance
ky Title only and motion carried by voice vote. Ordinance read by Title.
Motion by Alderman Sepich, seconded by Alderman Hurst that the Ordinance
be placed on its passage. Roll call vote. AXE': Aldermen Kovachevich,
Fulton, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wil-
coxen, Farr, and Rupe. NAY: None. This being Ordinance No. 361.
Alderman Berry reporting on a meeting of the Lights Committee, recommends
that the City Attorney be instructed to draw a Resolution for street
lights at Bradley corners and E. Chestnut St., dead end on West Olive
on the west side of road in front of Mrs: Johnson; south of Bradley cor-
ners, Avenue B between Tamarack and Beech Street. Motion by Alderman
Berry that a Resolution be drafted for the above street lights, seconded
by Alderman Edwards and the motion carried, voice vote.
Resolution - Rules and Order of Business of Council. Motion by Alder-
man Farr, seconded by Alderman Wilcoxen to adopt this Resolution. Roll
call vote. AYE: Aldermen Rupe, Farr, Wilcoxe;L, Hurst, Sepich, Edwards,
Berry, Peak, Cook, Spencer, Yerbic, Fulton, and Kovachevich. NAY: None.
Motion carried. This being Resolution No. 575• Recommendation that a
copy of this Resolution be sent to all law firms in Canton including the
City Attorney,
Alderman Hurst makes a motion that the Ordinance Committee study the Or-
dinance pertaining to length of time elected officials may address the
Council, seconded by Alderman Kovachevich and the motion carried by voice
vote.
Alderman Kovachevich asked City Engineer Gibbons about the stakes on Ash
Street between 8th and 9th Ave.

New business.
Alderman Fulton requested permission to make a telephone call at 7:55 P. M.,
returning to Council Chamber at 7:58 P. M.
Bonds, Transamerica Insurance Co., $1,000.00, approved by the Finance Committee,
for Thomas Hardin, Terry Cremer, Michael Elam, Amelia Tucker and David Bobzin
presented. Alderman Edwards calls for a policy meeting with the City Attorney
and Chief of Police in the Mayor's Office after the Council meeting. City Atty.
Malmgren recommends to accept bonds with the condition that the City Clerk ask
Mr. Robert Fouts if he has power of attorney to sign for Transamerica Insurance
Company. Motion by Alderman Farr, seconded by Alderman Wilcoxen to accept these
bonds under the above mentioned conditions. Roll call vote. AYE: Aldermen
Kovachevich, Fulton, Yerbic, Spencer, Cook, peak, Berry, Edwards, Sepich, Hurst,
Wilcoxen, Farr, and Rupe. NAY: None. Motion carried.
Estimate No. 4. Canton Concrete Products - Boat Launching in the amount of
$3,270.85. Motion by Alderman Hurst, seconded by Alderman Edwards to allow
payment on this Estimate. Roll call vote. A I+.: Aldermen Rupe, Farr, Wilcoxen,
Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Fulton, and Kovache-
vich. NAY: None. Motion carried. Discussion about seeding around Lake Canton
road.

First reading of Annexation Ordinance of Sam Lingenfelter property. No action.
First reading of Traffic Ordinance. Alderman Hurst makes a motion that the
V Ordinance be amended to strike out the word "West Pine Street" and insert "East
Pine Street" in all cases, seconded by Alderman Sepich and the motion carried
b-r voice vote. No action taken.
First reading of Landfill Ordinance. Alderman Kovachevich makes a motion that
Section 8cof the Ordinance be amended to read "$700.00 for 12-month period" in-
stead of "#780.00 for a 12-month period", seconded by Alderman Hurst. Motion
carried by voice vote. Mayor Jennings recommends that this Ordinance be one
of the business transactions at the Informal Council meeting Monday, Nov. 22,1971.
Alderman Kovachevich makes a motion to authorize the Mayor to be able to sign all
applications for the landfill and have the authority to appoint certain persons
to attend meetings, seconded by Alderman Yerbic. Roll call vote; AYE: Alder-
man Ka=b rich, Fulton, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich,
Hurst, Wilcoxen, Farr, and Rupe. NAY: None. Motion carried.
Discussion of pay telephone at the Canton Youth Center.
1,114ni movies. Discussion. Motion by Alderman Edwards, seconded by Alderman
Peak that the Ordinance Committee and City Attorney bring an Ordinance to the
Council governing such an operation in the City of Canton. Motion carried by
voice vote.
Lot on First Avenue. Discussion. Alderman Sepich makes a motion that the
Mayor investigate the possibilities of the lot on First Avenue and report back
to the Council, seconded by Alderman Fulton. Motion carried by voice vote.
City Clerk (FHA requests). City Attorney Malmgren =ecommends that the City
Clerk not issue certification letters for the FHA in the future.
Parking and new building on Linn Street. Alderman Berry requests that the
traffic committee look into the parking in a driveway between fifth and Sixth
Avenue in front of the Laundry and Kroell Electric Co. Alderman Hurst suggests
that the Traffic Committee look into the parking in front of the building on
Linn Street.
Motion by Alderman Yerbic, seconded by Alderman Wilcoxen to adjourn and motion
carried by voice vote. Canton City Council adjourns at 8:47 P. M.
