Aug. 3, 1971
Canton City Council held a regular meeting Aug. 3, 1971 in the City Council
Chambers. Mayor Jennings called the meeting to order at 6:43 P. M. Present
for roll call: Aldermen Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry,
Peak, Cook, Spencer, Yerbic, and Kovachevich. Absent: Aldermen Rupe and
Fulton.
Pledge of Allegiance was followed by Invocation by Alderman Howard.
Minutes of previous meeting. Motion by Alderman Yerbic, seconded by Alderman
Cook to accept the minutes of the previous meeting as presented and place on
file. Motion carried voice vote.
Bills for July. Motion by Alderman Edwards, seconded by Alderman Yerbic to
allow payment on all bills properly approved. Roll call vote. AYE: Aldermen
Kovachevich, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wil-
coxen, Farr, and Howard. NAY: None.
Reports of Officers presented. Motion by Alderman Yerbic, seconded by Alder-
man Farr to accept same and place on file and the motion carried voice vote.
Petition - Annexation and Rezoning - Sam S. Lingenfelter property. Motion by
Alderman Sepich, seconded by Alderman Peak to refer this Petition to the Plan-
ning and Zoning Commission and the motion carried voice vote. Petition No.216.
Standing Committee reports.
Alderman Edwards asked to have a meeting in the Mayor's office immediately
after the Council meeting,
Alderman Spencer reported that Mrs. Grzanich, a resident in the vicinity of
the Frew property (9th and Maple St.), wished to address the Council and per-
mission was granted. Mrs. Grzanich listed a number of complaints aginst
this property that were in violation of the City ordinance and also very un-
pleasant to the neighbors. Mayor Jennings referred this matter to the City
Attorney and Chief of Police to see that this property is cleaned up immedia-
tely. Motion by Alderman Spencer, seconded by Alderman Yerbic that the City
Attorney and Chief of Police see that the property is cleaned (Alderman Spencer
stated he had reported these violations several times) . Voice vote on the mo-
tion carried.
Oil and Chipping of city streets. Alderman Howard reported that the City Eng-
ineer and Street Superintendent had made up a map of work needed on several of
the city streets. Notice for bids on this work to be advertised at once.
Finance Committee. Alderman Edwards announced a meeting of the Finance Com-
mittee for Monday Aug. 9, 6:30 P. M. to discuss the Tax Levy Ordinance.
Alderman Spencer asked to have an informal Council meeting regarding the pro-
posed new comfort station on the same date as the Finance Cw nittee meeting.
Special Committee reports.
Communications to Council.
Letter from the Planning and Zoning Commission recommending, for the second time,
rezoning a portion of Northview Manor (Sec. 2) from an R-1 Residential to an R-4
Multiple Family Residence. The Ordinance accompanying this letter was referred
to a later position on the Agenda.
Letter from the Planning and Zoning Commission recommending that North Fourth
Avenue be extended as soon as possible. Alderman Howard moves, Alderman Wil-
coxen seconds motion that the City Council go on record that North Fourth Ave.
_will be extended as soon as possible. Motion carried by voice vote.
Old business.
No Parking Ordinance up for second reading. Motion by Alderman Sepich, seconded
by Alderman Kovachevich that the Ordinance be read by Title only and this motion
carried, voice vote. Title read. Motion by Alderman Sepich, seconded by Alder-
man Hurst to amend Section 3 to read: "North side of East Pine Street" instead
of either side. Motion carried, voice vote. Motion by Alderman Sepich to
place the Ordinance on its passage. Roli call vote. AYE: Aldermen Howard, Farr,
Wilcoxen, Hurst, Sepich, Berry, Peak, Cook, Spencer, Yerbic, and Kovachevich.
NAY$ Alderman Edwards. (11 AYES and 1 NAY). Motion carried. Ordinance # 349.

Ordinance regulating the pay for Fire and Police personnel when accepting the
duties of their superior officers up for second reading. Motion by Alderman
Howard, seconded by Alderman Yerbic to read the Ordinance by Title only and
the motion carried voice vote. Motion by Alderman Farr, seconded by Alderman
Yerbic to place the Ordinance on its passage. Roll call vote. AYE: Aldermen
Kovachevich, Yerbic, Spencer, Cook, Berry, Sepich, Wilcoxen, Farr, and Howard.
NAY: Aldermen Peak, Edwards, and Hurst. (R+o -ea��-vats. AU+) (`'9AYES and
3 NAYS). This being Ordinance No. 350.
Ordinance - Annexation of the Albert Brown property up for second reading. Mo-
tion by Alderman Howard, seconded by Alderman Yerbic to read the Ordinance by
Title only and this motion carried, voice vote. Motion by Alderman Hurst, sec-
onded by Alderman Wilcoxen to place the Ordinance on its passage,. Discussion
about the extension of Wrest Walnut Street. Roll call vote on the motion. AYE:
Aldermen Howard, Farr, Wilcoxen, Hurst, Senich,9 Edwards, Berry, Peak, Cook, Spen-
cer, Yerbic, and Kovachevich. NAY: None. Ordinance No. 351.
Motion by Alderman Sepic}A, seconded by Alderman Yerbic that the Planning and
Zoning C amnission make recommendations regarding street names for the newly
annexed territory (also that the territory south of Bradley corners be included).
Voice vote carried.
Alderman Edwards requested that the speeding sign should be relocated on South
Main Street since the recently annexation of property on that street.

Appointment of a Council member to the Planning & Zoning Commission to replace
Alderman Howard who recently resigned. Mayor Jennings made the appointment of
Alderman Spencer. Motion by Alderman Hurst, seconded by Alderman Kovachevich
that the appointment be accepted and the motion carried by voice vote.
Ordinance Annexation and rezoning Sutton and Moore property ready for second
reading. Motion by Alderman Howard, seconded by Alderman Wilcoxen to read Ord-
inance by Title only and the motion carried voice vote. Motion by Alderman
Hurst, seconded by Alderman Farr to place the Ordinance on its passage. Roll
call vote. AYE: Aldermen Kovachevich, Yerbic, Spencer, Cook, Peak, Berry, Ed-
wards, Sepich, Hurst, Wilcoxen, Farr and Howard. NAY: None. Ordinance #352.
Alderman Spencer inquired if the C.S.P.S.Co. had repaired the hole on East Chest-
nut Street and Eleventh Avenue. Mayor Jennings stated he had talked to Mr.
Murray, this date, and was told the work would be done immediately.
New business.
First reading of an Ordinance rezoning portion of Northview Manor, Section 2,
from an R-1 Residential to an R-4 Multiple Family Residence. Discussion. The
question was raised about the Ordinance bung presented to the Aldermen twenty-
four hours prior to the Council meeting. Motion by Alderman Howard, seconded
by Alderman Hurst to suspend the rules. Roll call vote. AYE: Aldermen Howard,
Hurst, Berry, Peak, Cook, Spencer, Yerbic, and Kovachevich. NAY: Aldermen Farr,
Wilcoxen, Sepich, and Edwards. (8 AYES and 4 NAYS) . Motion carried. Motion by
Alderman Hurst, seconded by Alderman Peak to place the Ordinance on its passage.
Discussion about the feasibility of this proposed rezoning. Motion by Alderman
Hurst, seconded by Alderman Howard to allow those persons who wished to give a
ten minute presentation with a three minute rebuttal and the motion carried by
voice vote. Mr. James Elson, representing Richard Miller, stating that every-
thing that needed to be said was taken care of during the Planning and zoning
Commission hearing and he had no further statements. Mrs. Donald Mortvedt rep-
resented the residents opposing this proposed rezoning. Roll call vote on the
motion for passage of the Ordinance. AYE: Aldermen Cook, Peak, Edwards, and
Hurst. NAY: Aldermen Kovachevich, Yerbic, Berry, Sepich, Wilcoxen, Farr, and
Howard. (4 AYES and 8 NAYS). Motion lost.
First reading of an Ordinance rezoning property belonging to Sheldon Orwig from
a Conservation Area to a B-4 Businesa. Motion by Alderman Edwards, seconded by
Alderman Sepich to suspend the rues. Roll call vote. AYE: Aldermen Howard,
Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, and
Kovachevich. NAY: None. Motion by Alderman Yerbic, seconded by Alderman Kovach-
evich to p A}�is Ordinance on its passage. Roll call vote. AYE: Aldermen
Kovachevic Yarbic, Cook, Peak, ferry, Edwards, Sepich, Hurst, Wilcoxen, Farr,
and Howard. NAY: None. This being Ordinance No. 34. Discussion of appearance
of the proposed auto repair location.

Motion by Alderman Hurst, seconded by Alderman Wilcoxen that the "Junk Car"
Committee prepare an Ordinance controlling appearances of junk car lots. This
motion carried, voice vote.
Resolution providing for payment by the City of a portion of traffic signals
for the proposed Locust Street and Fifth Avenue (60 CS) . Motion by Alderman
Howard, seconded by Alderman Farr to suspend-the rules. Roll call vote. AYE:
Aldermen Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook,
Spencer, Yerbic, and Kovachevich. Motion by Alderman Howard, seconded by Al-
derman Farr to adopt this Resolution. Roll call vote. AYE: Aldermen Kovache-
vich, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen,
Farr, and Howard. NAY: None. Resolution No. 571.
Inquiry by Alderman Hurst the outcome of the bidding on improvements on Locust
and Main Street. Mayor Jennings stated he was trying to learn what will be done.
Fourth Ward. Alderman Berry reported there were several individuals who haul gar-
bage and leave their trucks standing in the city streets and wished the Chief of
Police to check on same. Motion by Alderman Berry, seconded by Alderman Edwards
to refer this matter to the Garbage Disposal Committee and the motion carried
by voice vote.
Building Permits. Alderman Edwards stated that the Ordinance pertaining to
Building permits should be changed and moves that the proper committee be in-
structed to check the Ordinance to see if small or necessary repairs can be
made without permits. Alderman Berry seconds this motion. Mayor Jennings
appointed Aldermen Hurst, Howard, and Edwards to this special committee. Voice
vote on the motion by Alderman Edwards carried.
Bids - Hauling lime. Motion by Alderman Howard, seconded by Alderman Yerbic
that the City Clerk be instructed to open the bids. Motion carried by voice
vote. Bids received: G. A. Weaver & Sons and a letter from Jack Russell sta-
ting that his original bid still stood. Motion by Alderman Spencer, seconded
by Alderman Yerbic to refer these bids to the Water and Sewer Committee and
the motion carried by voice vote.

Bids - Water main extension. Motion by Alderman Kovachevich to instruct the
City Clerk to open the bids and seconded by Alderman Howard. Motion carried,
voice vote. Bid opened - Livio Poggioli. Motion by Alderman Howard, seconded
by Alderman Farr to refer same to the Water and Sewer Department and the motion
carried by voice vote.
Fire and Police Chiefs. Motion by Alderman Howard, seconded by Alderman Cook
to draft an Ordinance removing the Fire and Police Chief from the Fire and Po-
lice Commission jurisdiction and also to guarantee job security they should
have. Roll call vote. AYE: Aldermen Howard, Hurst, Peak, and Cook. BAY:
Aldermen Farr, Wilcoxen, Sepich, Edwards, Berry. Spencer, Yerbic, and Kovache-
vich. (4 AYES and 8 NAYS) ,
Alderman Farr moves to direct the Ordinance Committee to draft an Ordinance
that Ordinances be referred to the Aldermn twenty-fours prior to a Council
meeting except in case of emergency. Alderman Wilcoxen seconds this motion.
Voice vote. (11 AYES with Alderman Hurst voting NAY).
First reading of an Or dinance "No Parking on Linn Street between Sixth and
Seventh Avenue". Same to lay over.
Motion by Alderman Kovachevich, seconded by Alderman Howard to adjourn. Voice
vote carried. Canton City Council adjourns at 8:30 P. M.
