HomeMy WebLinkAbout07-27-1971 Council Meeting Minutes 32 July 27, 1971 Canton City Council held a regular meeting on July 27, 1971 in the City Council Chamber. Mayor Jennings called the meeting to order at 6:35 P.M. Present for roll call: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst., Sepich, Edwards, Peak, Cook, Spencer, and Yerbic. Absent: Aldermen Ber- ry, Fulton, and Kovachevich. Pledge of Allegiance was followed by Invocation by Alderman Edwards. Minutes of previous meeting. Alderman Sepich moves, Alderman Edwards seconds motion that the minutes be accepted and placed on file and the mo- �i.on carried by voice vote. Petition and Ordinance; Annexation of the Albert D. Brown Sr. and Judith M. Brown property. No action taken. Petition No. 213. Petition. Variance in zoning - Gerald W. Wilson and Helen Wilson property. Discussion. City Attorney Malmgren to check on same. Petition No. 214. Petition for rezoning - Sheldon and Margaret Orwig property (Conservation Area to a Commercial area). Motion by Alderman Sepich, seconded by Alder- man Peak to refer to the Planning and Zoning Commission and the motion carried by voice vote. Motion by Alderman Farr, seconded by Alderman Howard recommending that a copy of all petitions be referred to the proper authorities to be studied before the Council meetings. Motion carried by voice vote. Petition - protest from North View Manor residents against the proposed apartment building to be built in that area (71 names). Motion by Alder- man Howard, seconded by Alderman Rupe to refer this Petition to the new business section on the agenda a2:d the motl >r. ca'rr:i.' i, ,%o'ce vote. petitioi ado. 215. «�dernaa Edwards moves, Alderman Hurst seconds motion to allow Jack Russell, who had been hauling lime to the water treatment plant, to speak to the Council. Alderman Howard objected to hearing Mr. Russell until Orval Kuhn was present and that this matter should not be discussed before opening of bids on August 3. Discussion. Roll call vote. AYE: Aldermen Cook, Peak, Edwards, Hurst, and Wilcoxen. NAY: Aldermen Yerbic, Spencer, Sepich, Farr, Howard, and Rupe. (5 AYES and 6 NAYS). Motion lost. Standing committee reports. Building and Grounds. Alderman Spencer moves that the low bid for covering the wall on the old camfort station site be aitarded to Dan Hull and that the Mayor and City Clerk enter into this Agreement. Motion seconded by Alderman Yerbic. Roll call vote. AYE: Aldermen Rupe, Howard, Farr, Wil- coxen, Hurst, S pich, Edwards, Peak, Cook, Spencer, and Yerbic. NAY: None. Agreement No. 1 9. Demolition of old Eagles Building. Motion by Alderman Spencer, seconded by Alderman Yerbic that the Mayor and City Attorney enter into an Agreement with the low bidder for demolition, Kilroy Groff, debris not to be hauled to the old city dump. Roll call vote. AYE: Aldermen Yerbic, Spencer, Cook, Peak, Edwards, Sepich, Hurst, Wilcoxen, Farr, Howard, and Rupe NAY: None. Agreement No. 196. Christmas Lighting Committee to meet in the Mayor's Office July 28, 1971, 9:30 A. M. announced by Alderman Howard. Communications to Council. Spillway. Letter from Crawford, Murphy & Tilly Engineering Firm regarding the proposed raising of the Canton Lake Spillway - recommending that a two- foot raise should be sufficient for a number of years. Motion by Alderman Rupe, seconded by Alderman Howard to notify the Crawford, Murphy & Tilly Engineering Firm to proceed with the proper notifications for this project. Roll call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Peak, Cook, Spencer, and Yerbic. NAY: None. Department of Conservation - re. Fish Population count in Canton Lake. Mr. Ken Russell reported the lake is well stocked and that fishing should be ex- cellent. He also requested a report of the stocking records since 1968. , 24 July 27, 1971 (2) Thank you note for flowers from the family of former City Atty., Joseph Martin. Request for Tay Day, Canton Friendship Festival Board, for August 21, 1971. Motion by Alderman Edwards, seconded by Alderman Peak to grant permission to hold tag day and the motion carried by voice vote. Motor Control Panel, Take Canton Water Plant. Change Order No. 1, in the amount of $578.00 read. Motion by Alderman Rupe, seconded by Alderman Farr to allow this additional expense. Roll call vote. AYE: Aldermen Yerbic, Spencer, Cook, Peak, Edwards, Sepich, Hurst, Wilcoxen, Farr, Howard, and Rupe. NAY: None. Old business. Alderman Sepich asked for a report from the City Attorney on the West Maple Street property and was informed that same has been partially cleaned up -- that the property is in the process of being sold. Discussion about the dirt that had been piled up from digging the basement (every rain causes the dirt to run off into neighbors yard). Motion by Alderman Sepich, seconded by Al- derman Hurst to authorize City Attorney Malmgren to get written permission to have this hole filled and the motion carried, voice vote. Mayor Jennings inquired about the weeds on the Riley property and was informed they were mowed on July 27. Discussion about weeds along the railroad tracks and Alderman Peak moves, Alderman Cook seconds motion that the TP&W and CB&Q railroads be issued warrants to mow the weeds along their tracks and this mo- tion carried by voice vote. Alderman Farr suggested that perhaps the fee for mowing weeds be increased again. Property on South Third Avenue. Motion by Alderman Edwards, seconded by Alder- man Peak to instruct the City Attorney to start condemnation proceedings on the eighth day if no effort has been made to clean up that property. (A seven-day notice for this work has already been sent) . Motion carried by voice vote. Police radios. Alderman Hurst inquired what word had been received about the police radios and Chief of Police said they were to be shipped this week. Ordinance - Annexation of portion of W. V. Young's Subdivision. No represen- tgtives were present and Alderman Sepich moves, Alderman Hurst seconds motion to hold same over until the next meeting. Lotion carried by voice vote. New business. North View Manor -- also the Petition of Protest from the residents in that area. Alderman Rupe asked permission for Attorney James Elson to explain to the Council the project Mr. Richard Miller had proposed. Permission granted. Other persons addressing the Councils Mr. Rodenbeck, Michael Klobuchar, Alder- men Rupe and Howard. Motion by Alderman Edwards, seconded by Alderman Sepich that due to the fact that the public was not aware that the public hearing per- taining to the rezoning of this property was to be held, that the matter be re- ferred back to the Planning and Zoning Commission to hold another public hearing. More discussion - Richard Miller and Dr. Richard. Mansfield spoke to the group. Roll call vote on the notice. AYE: Aldermen Farr, Wilcoxen, Hurst, Sepich, Edwards, Cook, Spencer, and Yerbic. NAY: Aldermen Rupe, Howard, and Peak. (8 AYES and 3 NAYS). Carried. 'Discussion as to whether a public notice should be advertised, the ?Tanning and Zoning Commission to decide on Aug. 2, 1971, 7:00 P. M. Motion by Alderman Farr, seconded by Alderman Wilcoxenu to instruct the City Clerk to notify Mr. Donald Schmidt, Chairman of the Planning and Zon- ing Commission that this matter has been referred back to the Planning and Zon- ing Commission for another hearing and the motion carried, voice vote. The pro- testers to choose a representative from their group to represent them at the meeting with Planning and Zoning Commission. ( e"Z- t f icJ s Alderman Edwards reported unsanitary conditions at 241 Fulton Place and 744 South Second Avenue -- some attempts to clean up have been made but there is an old pick-up truck filled with trash that has been in the yard for six years. A hole in the back yard was ordered to be filled in several months ago and is still open. Chief of Police and Traffic Committee to check on tall hedge on the corner of Walling Court and Fulton Place -- same obstructing view. 325 July 27, 1971, Cont. (3) Alderman Howard suggested that the Chief of Police and Fire Chief be placed directly under the heading of the City Council instead of the Fire and Po- lice Commission and stated that at the next Council meeting he would make a motion that an Ordinance be drafted to remove these officers from the Fire and Police Commission. Ordinance - no parking. Alderman Edwards recommended that same lay over. Ordinance - Fire and Police salary. Alderman Farr recommended that the Or- dinance lay over. Alderman Howard moves, Alderman Yerbic seconds motion to suspend the rules. Roll call vote. AYE: Aldermen Yerbic, Cook, Edwards, Hurst, Howard, and Rupe. NAY: Aldermen Spencer, Peak, Sepich, Wilcoxen, and Farr. (6 AYES and 5 NAYS). Motion lost. Mayor Jennings asked Alderman Edwards to take his seat at 8:49 P. M. so he could make a telephone call. Estimate No. 7, McDougal Hartmann for work on West Walnut Street, $64,857.87, approved by Crawford, Murphy & Tilly Engineering Firm. Mr. Jerry Williams U- gave a report on the progress of the work on Walnut Street - 69% completed. in Alderman Edwards reported on curbing in front of the Reffett property. Alder- man Sepich moves, Alderman Hurst seconds motion to allow the estimate for pay- ment. Roll call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, V Sepich, Edwards, Peak, Cook, Spencer, and Yerbic. NAY: None. V Mayor Jennings returning to his chair at 8:57 P. M. Resolution of Intent for street improvement of Second Avenue (Locust to Elm), Third Avenue (Locust to Elm), Chestnut Street (Second to Fifth). Alderman Spencer moves, Alderman Yerbic seconds motion to adopt this Resolution. Roll call vote. AYE: Aldermen Yerbic, Spencer, Cook, Peak, Sepich, Wilcoxen, Farr., Howard, and Rupe. NAY: Aldermen Edwards and Hurst. (9 AYES and 2 NAYS). Resolution No. 570. (62 CS - 72 A). Agreement for Engineering Services on street improvement, Section 62CS 72 A (listed in above paragraph). Alderman Sepich moves, Alderman Yerbic seconds motion to enter into an Agreement with Crawford, Murphy & Tilly Ehgineering Firm for their services. Roil call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Sepich, Peak, Cook, Spencer, and Yerbic. NAY: Aldermen Hurst and Edwards. (9 AYES and 2 NAYS) . Carried. Agreement No. 19M. Discussion regarding oil and chips for city streets - Street Superintendent Ayers named several streets in poor condition. He6 i.ng of that committee set for 9:30 A. M. July 28, 1971. Alderman Spencer inquired about repair of hole on Eleventh Ave. C.I.P'.S. Co. to do this work. Appointment of Richard G. Letteney, Aux. Policeman. Alderman Howard moves that the appointment be accepted but the motion dies for lack of a second. Alderman Hurst recommends upgrading the auxiliary police personnel by re- questing examinations for the position. Alderman Sepich moves for the tempor- ary appointment of Richard G. Letteney (who will be asked to take the exam- ination) . Motion was seconded by Alderman Wilcoxen and the motion carried, voice vote. Bids - parking lot, White Court. None received. Mayor Jennings reported the proposed comfort station (the old Caruso Bldg.) agreement is satisfactory and was signed as of this date. Agreement No. 192.
