Dec. 1, 1970
Canton City Council held a regular meeting Dec. 1, 1970 in the City
Council Chamber. Mayor Jennings called the meeting to order at 6:30
P. M. Present for roll call: Aldermen Howard, Rupe, Svob, Farr, Sepich,
Hurst, Edwards, Williams, Yerbic, Spencer, George, and Kovachevich.
Absent: Aldermen Long and Kroell.
Pledge of Allegiance was followed by Invocation by Alderman Howard.
Minutes of previous meeting. Motion by Alderman Spencer, seconded by Al-
derman Yerbic to dispense with reading of minutes, approve same and place
on file. Motion carried by voice vote.
Bills for November. Motion by Alderman Edwards, seconded by Alderman
Spencer that all bills properly approved be allowed for payment. Roll call
vote. AYE: Aldermen Kovachevich, George, Spencer, Yerbic, ailliams, Ed-
wards, Hurst, Senich, Farr, Svob, Rupe, and Howard. NAY: None.
Reports of all officers. Motion by Alderman Farr, seconded by Alderman Svob
to accept same and place on file. Motion carried voice vote.
Standing Committee reports.
Street and Alley.y Alderman Howard reported on a trip to Springfield to in-
spect used trucks -- one that the committee had selected, to be put in
V good shape for $2450.00. Alderman Howard moves, Alderman Williams 6econds
motion that the Mayor and City Clerk enter into an agreement for the purchase
of a 1965 IHC truck equipped with snow plow and salt spreader -- entire
cost to be $2450.00. Roil call vote. AYE: Aldermen Howard, Rupe, 87ob,
Farr, HU3rsty;-Edt+ards,, Williams, Yerbic, Spencer, George, and Kovachevich.
NAY: Alderman Sepich. (11 AYES and 1 NAY).
Police and Legal. Alderman Farr reported on a meeting with xambers of the
Policemen's Union - that no more benefits could be arranged for them until
May, 1971.
Traffic Committee. Alderman Sepich called for a Traffic Committee meeting
to be held Dec. 14 - a joint meeting with the Police and Legal Committee.
Alderman George requested that the Mayor, City Attorney, Police Chief, and
the three Sergeants be present at this meeting. Alderman Hurst stated that
since most of the Garbage Disposal Committee members were on the above com-
mittees, he would call for a Garbage Disposal meeting at the same time --
to report on a one-man operation garbage truck.
Junk-car Committee. Alderman Edwards reported that Mr. Bull and Mr. Williams
are doing a very good job removing junk cars and moves that the City Clerk run
an ad to notify people with junk cars to call the Police Station that their
cars will be surrendered and title given. Alderman George seconds this motion.
Roll call vote. AYE: Aldermen Kovachevich, George, Spencer, Yerbic, Williams,
Edwards, Hurst, Sepich, Farr, Svob, Rupe, and Howard. NAY: None.
Alderman Sepich suggested that a "load limit" Orainance be drafted.
TP&W RR. A letter from members of the Mt. Carmel Church addressed to Alder-
man Howard, Chairman of Streets and Alleys, opposing the closing of Railroad
Street from Fourth to Fifth Avenue because of hardship caused to gain entrance
to the church parking lot and the public would use the alley for a public
thoroughfare. Mr. Polich from the TP&W RR Company stated the railroad company
would honor thl_s request and leave Railroad Street open and no parking of rail-
road cars between Fourth and Fifth Avenue. Motion by Alderman Howard, seconded
by Alderman Svob to authorize the Mayor and City Clerk to enter into an agree-
ment with the TP&W RR for the building of the proposed "wye track". Roll call
vote. AYE: Aldermen Howard, Rupe, Svob, Farr, Sepich, Hurst, Edwards, Williams,
Yerbic, Spencer, George, and Kovachevich. NAY: None. Alderman Howard thanked
the railroad company and the members of the Mt. Carmel Church for the fine way
-the arrangement was handled. Mr. Polich, thanked the City Council and members
of the church also.
Special Committee reports.
Mayor Jennings introduced Gary Kay, 557 N. Ilth Ave., Star Scout, Troup 124
who was attending the Council meeting.

Communications to Council.
Department of Public Works and Buildings - regarding the local governments
ability to participate in purchasing materials through the State.
Pollution Control Board notice that the Commonwealth Edison Co. has made
application for a permit to operate a nuclear steam electric generating fac-
ility at Goose Lake Township. Opinions concerning this permit and its effect
on rivers and streams in the area given by Aldermen Hurst, Williams, Howard,
and Farr. Motion by Alderman Hurst, seconded by Alderman Howard to authorize
the Mayor and one other representative to attend this hearing set for Dec. 7,
1970 - expenses to be paid. Roll call vote. AYE: Aldermen Kovachevich,
George, Spencer, Yerbic, Williams, Edwards, Hurst, Sepich, Farr, Svob, Rupe,
and Howard. NAY: None.
Old business.
Ordinance, rezoning Lot 14 in th6 A. N. Hick's Addition (Delbert Dunn) up
for second reading. Motion by Alderman Hurst, seconded by Alderman Yerbic
to read by Title only. Voice vote carried. Title read. Motion by Alderman
Hurst, seconded by Alderman Yerbic to place the Ordinance on its passage.
Roll call vote. AYF; Aldermen Howard, Rupe, Svob, Farr, Sepich, Hurst,
Edwards, Williams, Yerbic, Spencer, George, and Kovachevich. NAY: None.
This being Ordinance No. 32'l.
Estimate No. il, Normoyle-Berg & Associates for Division 11 and 11, storm
sewer and channel relocation in the amount of $ld,305.42. Motion by Alder-
man Edwards to allow payment on this estimate. Roll call vote. AYE: Al-
derman Howard, Rupe, Svob, Farr, Sepich, Hurst, Edwards, Williams, Yerbic,
Spencer, George, and Kovachevich. NAY: None.
New business.
Estimate No. 4. Natkin & Co. for work on the Anderson Place Lift Station --
amount of $6,348.18 presented. Motion by Alderman Sepich, seconded by Alder-
man Edwards to allow payment on this estimate. Roll call vote. AYE: Alder-
men Howard, Rupe, Svob, Farr, Sepich, Hurst, Edwards, Williams, Yerbic, Spen-
cer, George, and Kovachevich. NAY: None.
Estimate No. 2, McDougall-Hartmann & Co., work on the West Walnut .street im-
provement - amount of $262053.25 presented. Report on progress on street
improvement by resident engineer Gary Williams from the Crawford, Murphy &
Tilly Engineering rlirm. Motion by Alderman Yerbic, seconded by Alderman
Hurst to refer this estimate to the Board of Local Improvements for approval
and payment. Roll call vote. AYE: Aldermen Kovachevich, George, Spencer,
Yerbic, Williams, Edwards, Hurst, Sepich, Farr, Svob, Rupe, and Howard. Nay;
None.
Illinois Municipal League proposed Resolution for approval of the Constitution
to be voted on Dec. 15, 1970. Aldermen Howard, Edwards, George, Williams, and
Hurst expressed their ideas on the proposed constitution. Motion by Alder-
man Hurst, seconded by Alderman Williams that the Resolution be tabled. Roll
call vote. AYE: Aldermen Howard, Rupe, Svob, Farr, Hurst, Edwards, Williams,
Spencer, and Kovachevich. NAY: Aldermen Sepich, Yerbic, and George. (9 AYES
and 3 NAYS). Motion to table carried.
Extension of roadway on North Fourth Avenue from Birch Street to Country Club
Road, Mr. Malmgren, City "ttorney reported that Mr. Walt Sebo requested that
a survey be made before the Country Club gives a deed to this parcel of land.
Motion by Alderman Hurst, seconded by Alderman Sepich that Anderson and
Associates be employed to survey this land. Roll call vote. AYE: Aldermen
Kovachevich, George, Spencer, Yerbic, Williams, Edwards, Hurst, Sepich, Farr,
Svob, Rupe, and Howard. NAY: None.
First reading of an Ordinance pertaining to zoning one and one-half miles
around Canton. Motion by Alderman Hurst, seconded by Alderman Sepich that
the appropriate fees be inserted and that the Ordinance lay over. Motion
carried, by voice vote.
First reading of Ordinance pertaining to water and sewer extension -- not to
be done until a building permit has been obtained. Motion by Alderman Hurst,
seconded by Alderman Farr to suspend the rules. Roll call vote. AYE: Alder-
men Howard, Rupe, Svob, Farr, Sepich, Hurst, Edwards, Yerbic, Spencer, George,
and Kovachevich. NAY: Alderman Williams. (11 AYES and 1 NAY) . Motion by
Alderman Hurst, seconded by Alderman Sepich to place the Ordinance on its

passage. Roll call vote. AYE: Aldermen Kovachevich, George, Spencer,
Yerbic, Williams, Edwards, Hurst, Sepich, Farr, Svob, Rupe, and Howard.
NAY: None. This being Ordinance No. 328..
Resolution authorizing Mayor Robert F. Jennings to represent the City of
Canton in the purchasing procedure with the State. Motion by Alderman
Kovachevich, seconded by Alderman George to adopt this Resolution. Roll
call vote. AYE: Aldermen Howard, Rupe, Svob, Farr, Sepich, Hurst, Ed-
wards, Williams, Yerbic, Spencer, George, and Kovachevich. NAY.: None.
This. being Resolution No. 546.
Municipal Election for 1971. Motion by Alderman Edwards, seconded by Al-
derman Williams authorizing the City Clerk, to make public the dates of the
upcoming election for Aldermen and Petition filing dates. Roll call vote.
AYE: Aldermen Kovachevich, George, Spencer, Yerbic, Williams, Edwards,
Hurst, Sepich, Farr, Svob, Rupe, and Howard. NAY; None.
Alderman Williams inquired about up-dating the present Ordinance books and
was told to make the recommendation when the new appropriation Ordinance was
being prepared.
Mr. Raymond Pickett, representing the Mt. Carmel Church,, - thanked the City
Council for assistance with the Agreement with the T P & W RR.
Motion by Alderman George, seconded by Alderman Kovachevich to adjourn.
Voice vote carried. Canton City Council adjourns at 7:55 P. M.
