Aug. 4, 1970
Canton City Council held a regular meeting on Aug. 4, 1970 in the City
Council Chamber. Mayor Jennings called the meeting to order at 6:35 P.M.
Present for Roll Call: Aldermen Howard, Rupe, Svob, Farr, Sepich, Hurst,
Long, Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich.
Absent: None.
Pledge of Allegiance was followed by Invocation by Alderman Howard.
.Minutes of previous meeting. Motion by Alderman Kroell, seconded by Alder-
man Yerbic that the minutes be accepted as presented and placed on file and
the motion carried by voice vote.
Petition: Request for rezoning property 430 N. 12th Ave. from R-1 to B-2
commercial by Clyde R. Chapman. Motion by Alderman Hurst, seconded by Alder-
man Rupe to write to Mr. Chapman suggesting he make application to the
Planning and Zoning Commission for study and also to inclose check for $35.00
to pay for a public hearing. Voice vote carried. Petition No. 190.
Petition and Resolution from Andrew and Lauretta Gebhardt for separation of
street assessments on 68-C when this tract of land is sold in parcels. Mo-
tion by Alderman Hurst, seconded by Alderman George to refer this Petition
to the Planning and Zoning Commission. Voice vote, Carried. Petition No. 191.

b- Petition containing 79 signatures requesting removal of parking from one side
of East Pine Street from Fifth to Sixth Avenue presented. Motion by Alderman
Edwards, seconded by Alderman Spencer that this Petition be referred to the
Traffic Committee and the motion carried by voice vote. Petition No. 192.
Report$ of Officers. Alderman Farr moves, Alderman Yerbic seconds motion that
same be accepted and placed on file. Carried voice vote.
Bills for July. Motion by Alderman Edwards, seconded by Alderman Sepich that
all bills properly approved be allowed for payment. Roll call vote. AY'

Standing Committee re-?orts.
Building and Grounds Committee Chairman Spencer moves to accept the proposal
presented by the Division of Highways regarding agreement for purchase of
portion of the Main and Locust Street parking lot for highway use -
and that the Mayor and City Clerk be authorized to enter into this agreement.
Alderman Farr seconds this motion. Roll call vote. AYE: Aldermen Howard,
Rupe, Svob, Farr, "epich, Hurst, Lone, Edwards, Kroell, Williams, Yerbic,
Spencer, George, and Kovachevich. NAY: N1 ne. This being Agreement No. 172.
Insurance: Alderman Edwards moves, Alderman Hurst seconds motion that the
Mayor appoint an Insurance Committee to review the insurance policies for the
City. Motion carried by voice vote. MMayor Jennings appoints Alderman Rupe,
Edwards, Howard, and Long to this committee. Motion by Alderman Edwards,
seconded by Alderman Long that the appointments be accepted and the motion
carried by voice vote.
Traffic Committee meeting announced by Alderman Sepich - August 10, 1970, 6:30 P.M.
Negotiating Committee to meet with the Council immediately following the
Council meeting announced by Alderman Farr.
Inquiry by Alderman Rupe regarding correspondence from Crawford, :Murphy and
Tilly or HUD. Mayor Jennings stated that letters have been sent to HUD.
Meeting of Street and Alley Committee for Monday, Aug. 10, 7:30 P. M.
announced by Alderman Howard.
Youth Acres. Alderman Howard stated that Campers have asked for the Council
to meet with the Youth Acres committee to arrive at a new lease - and asked
that City Attorney Malmgren draft a new lease prior to S;:pt. 1,;or the Council
members.
Alderman Edwards reported that since the old city dump was closed, trees and
brush have been hauled to a place at Lake Canton and he thought trash would
soon be hauled to that area. Inquiry from Assistant Fire Chief, Eugene Law-
ver about burning the brush and Mr. Lawver said. when the burning was to be

done the fire truck would be there. ;lotion by Alderman Edwards, seconded by
Alderman Lon; that when the burning was done, the firemen and street saperin-
tendent should work together on this project. voice vote carried.
Alderman George reported that for April, -lay and June 1970 the fines received
from the Circuit Clerk amounted to $3,250.00 and the expenses incurred for
the police attending the court sessions amounted to $850.00 sothe Cit,,,, was not
losing I this arrangement.
Special Committee reports.
Communications to Council.
Illinois Commerce Commission notice of Central Illinois Public Service Co.
nublic hearing to be held in Springfield on August 25, 1970, 10:00 A. M. Mr.
Ron Avery from the C.I.P.S.Co explained the procedure taken by their company
regarding priorities -- they have four classes of ratings for priorities and
try to give the best service possible, therefore the need for priorities. llo-
tion by Alderman Sepich, seconded by Alderman Yerbic to refer the matter to
the City Attorney for advice and re>>ort back to the next Council. meeting.
Request from Mike Chianakas to allow the Day Camp girls to pick up litter around
the Square, Friday afternoon, August 7, 1970• Nancy Page in charge of the pro-
ject. Alderman Howard inquired about the liability to the City for this group.
Motion by Alderman Yerbic, seconded by Alderman Edwards to authorise the YMCA
to sponsor this program and the motion carried by voice vote.
Alderman Edwards reported the Betterment Committee suggested getting rid of
the weeds around the parking meters around and near the square and said Rev.
Curry would furnish a group to spray or destroy the weeds. 'Discussion.
Old business.
Letter from iflr. Craig from the TP&W RR to the City Attorney that the lots on
Fourth Avenue would be cleaned on August 1t. Meeting of the Mayor, City Attor-
ney, and City Engineer with Mr. Craig set for Thursday, Aug. 6, 1970, 10:00 A.M.
Inquiry by Alderman Sepich about the Voorhees property, Maple Street and Ave. D,
also W. Walnut Street paving project. An agreement to be drawn for conveyance of
needed real estate for the corner of Avenue D and Maple Street - terrace and
remaining ground to be seeded as needed and two permanent markers to be installed
for the land records of Fulton County. Motion by Alderman Hurst, seconded by
Alderman Sepich that the Mayor and City Clerk be directed to enter into agree-
ment and that Street and Alley Department start work as soon as possible. Voice
vote, carried. No further report on W. Tlalnut Street paving project. 1;1�-%i.F
No Parking Ordinance. Second reading. Motion by Alderman Long, seconded by
Alderman Sepich to read Ordinance by Title only, as amended. Voice vote.
Carried. Title read. Motion by Alderman Sepich, seconded by Alderman Hurst
to place the Ordnance on its passage, as amended. Roll call vote. AYE:
Aldermen Kovachevich, George, Spencer, Yerbic, Williams,, Kroell, Long_;, Hurst,
Sepich, Farr, Svob, Rune, and Howard. NAY: Alderman Edwards. (13 AYES and
1 NAY) . This being Ordinance No. 318.
Easement - William Ritchey property -- held over.
Vew business.
Invitation from Alderman Kroell for the Councilmen and wives to attend the
opening of the First Federal Savings Co., Aug. 9, 1970 - 2:00 - 4:00 P. M.
Estimate No. 10, Normoyle-Berg & Associates for Division 11 and 12 in the
amount of :�19,877.50 presented. Motion by Alderman Sepich, seconded by Al_-
derman Hurst to allow this Estimate for payment. Roll call vote. AY',: Al-
demen Howard, Rupe, Svob, Farr, Sepich, Hurst, Long, Edwards, Kroell, Williams,
Yerbic, Spencer, George, and Kovachevich. DUM None. Alderman Hurst re-
quested that the Street and Alley Committee investigate the work 'before f:i_nal
payment is made and was told by the Mayor that HUD will also inspect the work.
Boyd Grimm property, E. Chestnut St. and Fifth Avenue. Letters to the City
Attorney from i°larcus ?ahiting, Administrator, and also Eugene Taylor, Attorney
for the case that the property was to be made safe as soon as possible, and
that the property is for sale. 11otion by Alderman Hurst, seconded by Alder-
man Sepich to hold off condemnation proceedings for thirty days. Roll call.

Edwards, Long, Hurst, Senich, Darr, Svob, Rupe, and Howard. NAY: None.
Motion by Alderman Hurst, seconded by Alderman Sepich that the City Attorney
instruct the administrator and Attorney of this intention. Carried, voice
vote.
State Highway Maintenance. Mayor Jennings stated a block on South Fifth Ave.
needed resurfacing and the Division of Highways informed him the state was
paying the City to take care of same, and the Mayor said he thought the City
was spending too much money for maintenance of the State Highway through Can-
- ton. City Attorney Malmgren said the City should find out what the State
allows and what it actually costs for this maintenance. Alderman Farr moves,
Alderman Hurst seconds motion that the City Attorney send a letter to Mr. J. E.
Harland and also Mr. Celeni regarding same. Carried by voice vote.
Betterment Commission. Mayor Jennings reported that group as doing a fine
job and asked the Council members for a standing at
of recognition.(unanimous) .
Old cars on streets. Discussion as to what to do about them and the City
Attorney said the City should first start with a complaint. Chief of Police
James Elam reported someone wanted to rent the old city dump for a used car
lot and that the City could use that property for storage of these cars - a
watchman to be there at all times. Alderman Rune inquired about the liability
on these cars picked up. Alderman Howard moves, Alderman Farr seconds motion
to refer the problem to the City Attorney, Chief of Police, Traffic and Gar-
bage Committees. Alderman Edwards not in favor of a junk yard at the old city
dump. Voice vote on motion carried.
Betterment Commission invited to attend the com ittee meetings to be held on
Monday, Aug. 10.
Electrical Commission ApT)ointments; Mayor Jennings announced the members of
this commission and that one more member was to be added as soon as he returned
to the city: Herbert Kamlager, Alder:Ytan Kroell, and Clarence Homer. This
Committee to choose a qualified electrical inspector and refer to the City
Council for approval.. Motion by Alderman Long, seconded by Alderman Edwards
that the appointments be confirmed. Voice vote carried.
Tax Levy Ordinance - First reading. Same to lay over.
Bids - covering of wall on Locust and Plain Street parking lot. Motion by
Alderman Spencer, seconded by Alderman Hurst to open bids. Voice vote carried.
Bids opened: Dan Hull, Canton $3,078.50; Western Waterproofing Co., Spring-
field, °$2272.00. Motion by Alderman Farr, seconded by Alderman George to re-
fer the bids to the Building and Grounds Committee for study and report to
next Council meeting and the motion carried by voice vote.
Motion by Alderman Howard, seconded by Alderman Rune to adjourn. Voice vote
carried. Canton City Council adjourns at 8:08 P. M.
