HomeMy WebLinkAbout07-28-1970 Council Meeting Minutes 230 July 28, 1970 Canton City Council held a regular meeting on July 283 1970 in the City Council Chamber. Mayor Jennings called the meeting to order at 6:35 P. M. Present for roll call: Aldermen Svob, Farr, Sepich, Hurst, Long, Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich. Alderman Howard arriving at 6:38 P. M. Absent: Alderman Rupe. Pledge of Allegiance was followed by Invocation by Alderman Long. Minutes of previous meeting. Motion by Alderman Kroell, seconded by Alderman Yerbic to accept same and place on file and the motion carried by voice vote. Standing Committee reports. Special Committee reports. Communications to Council. C B & Q RR letter to City Attorney Halmgren explaining reason for tie-up of railroad crossing on May 27, 1970 and also stating steps are being taken to eliminate this situation. T P & W RR letter to Ill. Commerce Commission stating tracks have been repaired. Division of Highways regarding municipalities giving permission to quote "estim,ites'l when publishing "Notice to Contractors Bulletin". Plotion by Alderman Long, seconded by Alderman Edwards to accept the above three letters and place on file and the motion carried by voice vote. Request from members of the A.C.I. to hold a style show in Jones Park on August 21, 1970 read. Motion by Alderman Yerbic, seconded by Alderman Kroell that the request be granted and motion carried, voice vote. Invitation to "Top of the Tower", Peoria Heights, Ill., extended to the city officials and wives. Motion by Alderman Edwards, seconded by Alderman Yerbic to accept same and place on file. Voice vote carried. Old business. On behalf of the residents on East Nagle :street and Van Buren Court, Alderman Kroell expressed their ap,-)reciation of the new street covering. Alderman Kroell stated that a diesel motor on the C B 8f Q RR tracks runs all night and the fumes from same annoy the residents; also complaints of weeds on T. P. 8 1,1. RR. and Fourth Avenue. Motion by Alderman Hurst that the City Engineer be authorized not to issue any permits for street openings until the pavement on West Fine and Main Street has been repaired. Alderman Williams seconds this motion. Roll call vote. AYE: Aldermen Kovachevich, George, Spencer, Yerbic, Williams, Kroell, Edwards, Long, Hurst, Sepich, Farr, Svob, and Howard. NAY: None. Youth Acres - Campers Club. Alderman Howard stated he would set a meeting for members of the camping group with the Councilmen for 7:30 P. M., Mon. Aug. 3. Inquiry by Alderman Sepich why corner of ' est Walnut Street and Avenue D was not taken care of when West Walnut Street was resealed. Street Superintendent Eldon Myers stated he authorized holding up on this corner until the outcome of letting of bids on the West Walnut Street paving project. New business. 1969-1970 Audit as prepared by George Hocker. Motion by Alderman Edwards, seconded by Alderman Long that same be approved and placed on file. Roll call vote. AYE: Aldermen Howard, Svob, Farr, Sepich, Hurst, Long, Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich. NAY: None. Meeting of the Police and Legal Committee immediately following the Council meeting announced by Alderman George. Condemnation of B vydGrimm property, Chestnut Street and Fifth Avenue. Alder- man Williams again reported that this building is very dangerous because children play in this house and windows are broken but portions of the glass still remaining in the frames and trucks passing causes vibration -- some child may get seriously injured. Alderman Edwards asked City Attorney if the windows could be boarded but Mr. Malmgren reported that would be an invasion 23 'r July 28, 1970, Cont. (2) of property rights and that the liability hinges on the property owner. Main and Locust Street - Option from Division of Highways for a portion of the parking lot to be used in connection with Main ?� Locust Street improve- ments - offer of $8,700.00 for approximately 4,321 square feet. Alderman Yerbic moves, Alderman Williams seconds motion to refer this option to the Building and Grounds Committee for study and report to the next Council meeting. Motion carried by voice vote. Easement - vad.at'lon - William Ritchey property in Tvergreen Estates (10t easement betwen lots 5 and 6). Request for vacation of this easement on the property and also letter from the City Engineer recommending that the easement could be abandoned. Alderman Farr suggested moving the easement to either side of the Ritchey lots (inasmuch as Mr. Ritchey had build his new home on both lots) . Motion by Alderman Farr that this easement be moved. Discussion. Motion withdrawn by Alderman Farr. Motion by Alderman Hurst, seconded by Alderman Farr that the Easement Committee be authorized to con- tact Mr. Ritchey if it would be agreeable to move the easement to one side of his property. Voice vote carried. Rezoning - First reading of an Ordinance pertaining to rezoning the Knights of Columbus Club from an R-2 to R-4. Motion by Alderman Hurst, seconded by Alderman George to suspend the rules. Roll call vote. AYE: Alderman Kova- chevich, George, Spencer, Yerbic, Kroell, Edwards, Long, Hurst, Svob, and Howard. NAY: Aldermen Williams, Sepich, and Farr. (10 AY,,S and 3 NAYS). Motion carried. Motion by Alderman Hurst, seconded by Alderman George to place the Ordinance on its passage. Roll call vote. AY7: Aldermen Howard, Svob, Farr, Sepich, Hurst, Fong, Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich. NAY: None. This being Ordinance No. 312. Rezoning: First reading of an Ordinance rezoning Jehovah's Witness and Marjorie Lyons property from R-2 to B-1. Motion by Alderman Hurst, seconded by Alderman George to suspend the rules. Roll call vote. AYE: Aldermen Kovachevich, George, Spencer, Yerbic, Kroell, Edwards, Long, Hurst, Farr, Svob, and Howard. NAY: Aldermen Williams and Sepich. (11 AY`.,S and 2 NAYS) . Motion carried. Motion by Alderman Edwards, seconded by Alderman George to place the Ordinance on its passage. Roll call vote. Garbage Disposal Tax Increase - First reading of an Ordinance to increase Garbage Tax to .20%. Alderman Edwards explained the reason for the three ordinances pertaining to increase in tax rates and that same should be done in order to work out the tax levy ordinance. Motion by Alderman Hurst, seconded by Alderman Edwards to suspend the rules. Roll. call vote. AYE: Aldermen Ko- vachevich,, George, Spencer, Yerbic, '+,dwards, Long, Hurst, Farr, and Howard. NAY: Aldermen Williams, Kroell, Sepich, and Svob. (9 AYES and 4 NAYS). Carried. Motion by Alderman Hurst, seconded by Alderman 7dwards to place the Ordinance on its passage. Roll call vote. Fire Protection Tax Rate Increase Ordinance - First reading of an Or dinance pertaining to increase in the Fire Protection Tax rate - to .15%. Motion by Alderman Edwards, seconded by Alderman Hurst to suspend the rules. Roll call vote. AYE: Aldermen Kovachevich, George, Spencer, Yerbic, Edwards, Long, Hurst, Farr, and Howard. NAY: Aldermen Williams, Kroell, Sepich, and Svob. (9 AYES and 4 NAYS) . Motion carried. Motion by Alderman Hurst, seconded by Alderman Yerbic to place the Ordinance on its passage. Roll call vote. Police Protection Tax Rate Increase Ordinance - First reading of an Or dinance pertaining to increase in the Police Protection Tax rate - to .05%. Motion by Alderman George, seconded by Alderman Edwards to suspend the rules. :Roll call vote. AYE,: Aldermen Kovachevich, George, Spencer, Yerbic, Edwards, Long, Hurst, Farr, and Iioward. NAY: Aldermen 1illiams, Kroell, Sepich, and Svob. (9 AYES and 4 NAYS) . Motion carried. Motion by Alderman George, seconded by Alderman Edwards to place the Ordinance on its passage. Roll call vote. AYE: Aldermen Howard, Svob, Farr, ePich, Hurst, Long, Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich. NAY: None. This being Ordinance No. 316. July 28, 1970, Cont. (3) No Parking - First reading of an Ordinance "No Parking". Permission given to 1,1r. and -Trs. Neil Aldrich, 522 E. nine :'t., objecting to the "no parking" on East Pine Street from Fifth to Sixth Avenue. Lengthy discussion by the Aldermen. Motion by Alderman Hurst, seconded by Alderman Long to amend the Ordinance by striking out Section One (17. Pine St.) . Roll call vote. AYE: Aldermen Kovachevich, George, Yerbic, .Edwards, Long, Hurst, and Svob. NAY: Aldermen Spencer, Williams, Kroell, Sepich, Farr, and Howard. (7 AY1S and 6 NAYS) . Carried. Motion by Alderman Sepich, seconded by Alderman Spencer to eliminate the complete Ordinance. More discussion. Alderman Spencer with- drew his second and Alderman Sepich withdrew his motion. Alderman Howard then moves, Alderman Spencer seconds motion to withdraw entire Ordinance, as amended. Privileged motion by Alderman Williams and seconded by Alderman Hurst to defer action on the Ordinance until the next meeting. Roll call vote on this motion. AYE: Aldermen Svob, Farr, Hurst, Long, Edwards, Kroell, Williams, Yerb-'c, George, and Kovachevich. NAY: Aldermen Howard, Sepich, and Spencer. (10 AYES and 3 NAYS) . Motion carried. Vacating portion of East Locust Street - First reading of an Ordinance vacating a portion of 7'ast Locust Street (133 feet at North Fourteenth Avenue), property to be titled to abutting owners and could then be taxed by the County. Motion by Alderman George, seconded by Alderman Yerbic to suspend the rules. Roll call vote. AYE: Aldermen Kovachevich, George, Spencer, Yerbic, Williams, Kroell., Edwards, Lon;;, Hurst, Farr, Svob, and Howard. NAY: Alderman Sepich (12 AYES and 1 NAY) . Motion carried. Motion by Alderman George, seconded by Alderman Yerbic to place the Ordinance on its passage. Roll ea]_1 vote. AYE: Aldermen Howard, Svob, Farr, Sepich, Hurst, Long, Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich. NAY: Non6. Ordinande No. 317. Mayor Jennings renorted that work on -the Main and Locust Street parking lot was progressing and would soon be blacktopped. Alderman t,dilliams thanked Alderman Sepich for the fine work in getting the mail box moved from Avenue A and Elm Street. Inquiry about car dealer using the lTain and Locust Street parking lot at this time and what would be done when lot is ready for operation. Discussion. llIo- tion by Alderman Edwards, seconded by Alderman Hurst to refer the matter to the Traffic and Building and C'7rounds Committee and report back to next Council- meeting. Voice vote carried. Meeting of the Building and Grounds Committee announced by Alderman Spencer for Tharsday July 30, 1970, 6:00 P. m. Meeting of the Negotiating Committee with members of the Council after the meetin;s scheduled for ;Tonda , Aug. 3, 1970 announced by Alderman Farr. Inquiry from Alderman George regarding the 'ldo -'arking" on North Seventh Ave. south from Corporation Street. Alderman "llliams reported the Ordinance, as passed in J .me, 1970 was indefinite and should have been cleared before pass- age (Ordinance, should have read "from Locust Street south to the TPA d RR) . Alderman George moves, Alderman Kovachevich seconds motion that the Ordinance be referred to the Traffic Committee and the motion carried by voice vote. Resolution -- Applicati_on to the Tublic Housing Administration for nrelimin- ary loan not to exceed '-20,000.00 for surveys and planning in connection with elderly and lour income housing projects not to exceed 200 dwelling units (100 elderly and 100 low income). Motion by Alderman Farr, seconded by Alderman C'eorge to adopt this Resolution. Roll call vote.
