HomeMy WebLinkAbout07-07-1970 Council Meeting Minutes ' 226 July 7, 1970 Canton City Council held a regular meeting July 7, 1970 in -the City Council Chamber. Mayor Jennings called the meeting to order at 6:30 P. M. Present for roll call: Aldermen Howard, Rupe, Svob, Sepich, Hurst, Long, Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich. Absent: Alderman Farr. Pledge of Allegiance was followed by Invocation by Alderman Long. Minutes of previous meeting. Motion by alderman Kroell, seconded by Alderman Yerbic to accent minutes of previous meeting as presented and place on file. Motion carried by voice vote. Petition. Seventy signatures on a Petition presented to remove the parking restriction on the south side of East Pine Street from Fifth to Sixth Avenue. Motion by Alderman Long, seconded by Alderman Spencer that the Petition be referred to the Traffic Committee. Carried by voice vote. Petition No. 188. Bills for June 1970. Motion by Alderman Long, seconded by Alderman Sepich that all bills properly approved be allowed for payment. Roll call vote. AYE: Al- dermen Kovachevich, George, Spencer, Yerbic, Williams, Kroell, Edwards, Long, Hurst, Sepich, Svob, Rupe, and Howard. NAY: None. Monthly reports of officers. Motion by Alderman Long, seconded by Alderman Ed- wards that same be accepted and placed on file. Carried by voice vote. Standing Committee reports. Alderman Svob reported that the Finance and Fire Committees had met and planned to send two Aldermen to the Joliet Arsenol to pick up a panel truck for the Fire Chief's use but, since trucks were pretty well picked over, will postpone the trip until more trucks are avilable. Lake Development Committee. Alderman Edwards reported that one lot leasee had used a bulldozer to push over trees and then had them towed out into the lake. This information was confirmed by Orval Kuhn, Water Superintendent. Motion by Alderman Hotirard, seconded by Alderman Yerbic that the Lake Committee take what- ever action is necessary to prevent this practice. Carried by voice vote. Building and Grounds Committee to meet following the Council meeting was re- quested by Alderman Spencer. Disclaimer - City Attorney Malmgren reported that Attorney Chester Claudon had nresented same to him - regarding the William Ritchey tract of two lots. Malmgren stated there was an easement with the C.I.P.S.Co. and the City and recommended that this be referred to the City Engineer to check and report to the next Council meeting if necessary to retain said easement. Alderman Sepich moves, Alderman Long seconds motion to refer this matter to the City Engineer for report. voice vote carried. Special committee reports. Alderman Howard called for a meeting of the Aldermen having sewer problems in their ward to meet on July 28 with the Street and Alley Committee. Communications to the Council. Planning and Zoning Cermi.ssion recommendations approving the proposed water and sewer improvements. Alderman Rupe requested that the Mayor's Secretary write a letter to HUD (similar to the one dated May 29, 1970), a copy to Crawford, �,iurphy and Tilly Engineering Firm and one for the City's file. Planning and Zoning Commission reccmmendati_on for rezoning of the property of the Columbus Club from an R-2 Residential to a B-1 Local Business. Motion by Alderman Long to concur in the recommendation and refer to the Ordinance Cam- mittee to draft an Ordinance. Attorney James Elson stated it might be well to rezone the property to an R-4 Zoning. Alderman Long withdrew his motion. Mo- tion by Alderman Hurst, seconded by Alderman Svob that the Ordinance Committee be authorized to draft an Ordinance for rezoning from an R-2 to an R-4, Roll call vote. AYE: Aldermen Howard, Rupe, Svob, Sepich, Hurst, Lon;,, Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich. NAY: None. Planning and Zoning Commission recommendation for rezoning the property of Jehovah's Witnesses and Marjorie Lyons from an R-2 Residential to aaB-1 Local 29 7 July 7, 1970, Cont. (2) Business. Motion by Alderman Edwards, seconded by Alderman George to author- ize the Ordinance Committee to draft an Ordinance for the change of zoning from an R-2 to a B-1. Roll call vote. AYE: Aldermen Kovachevich, George, Spencer, Yerbic, Williams, Kroell, rdwards, Long, Hurst, Sepich, Svob, Rupe, and Howard. NAY: None. Zoning map. Alderman Hurst inquired about updating the zoning map and moves to authorize the Planning and Zoning Commission to get an estimate of cost of up- dating the zoning map and report to the Council. Alderman 'Edwards seconds this motion. Alderman Howard suggested that City 'Engineer Howard Gibbons might up- date the map from time to time. Mr. Gibbons stated the original map, kept in his office, is up to date at all times. Alderman Edwards withdrew his second of motion and Alderman Hurst withdrew his motion. Alderman Sepich regizted the City Attorney to check on the zoning pertaining to the proposed new Standard Oil. Station to be built on the site of the present station. Letters from State Representatives Gale Schisler, Wilbur H. Iauterbach, and J. Normal Shade - stating they were also opposed to the one-half cent tax as pro- posed. Request from the Canton Friendship Festival Board to hold a tag day on Aug. 21 and 22, 1970. Motion by Alderman Kroell, seconded by Alderman Sepich to grant G� this request and the motion carried by voice vote. Old business. Alderman Kroell stated he had received many calls complaining of parking lots that were not oiled or wetted down - these lots are privately owned. Motion by Alderman Sepich, seconded by Alderman Edwards that the Street Super- intendent and City Engineer investigate the need for repairs of Avenue 'D and Railroad track. Motion carried, voice vote. Alderman Sepich inquired about the work of clearing trees and limbs from the recent storm. Mr. Myers, Street Superintendent stated that about 100 loads of tree limbs had been hauled away and it would be about three more days before the work is completed. Alderman Hurst asked the City Attorney about the corner of Avenue D and West Maple Street -- City Attorney to draw up the contract. New business. Seventh and r final estimate, Geo. : . Hoffman & Jons for street improvement on East Ash Street, x;10,442.04. Motion by Alderman Sepich, seconded by Alderman Yerbic to allow payment on this Estimate. Roll call vote. AYE: Aldermen Howard, Rupe, Svob, Sepich, Hurst, Long, Edward, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich. NAY: None. Alderman Hurst inquired of the City Attorney the purpose of use of land at Youth Acres and was told the area was for the benefit and enhancement of youth. Alderman Howard reported the Campers Club (who have been using a portion of Youth Acres) have been active in keeping the grounds very neat but the Council should meet and decide whath)to be done and included this subject in his July 28 meeting. Alderman Edwards said he has received many com,)lairts, but Youth Acres is controlled by the Canton Comm inity Chest. Appointment of Ronald Haynes as Auxiliary Police. Motion by Alderman Edwards, seconded by Alderman Kroell to approve this appointment. Carried, voice vote. Appointment of Alderman :Monty Rupe to the Fulton County Planning and Zoning Commission. Motion by Alderman Hurst, sedonded by Alderman Yerbic to confirm this appointment and the motion carried by voice vote. T.P.& W. RR. Mayor Jennings stated one of the Police Sergeants reported a freight car was standing approximately eight feet into the street and he told the Sergeant to contact the railroad company and if no reply to get a wrecker to move the car -- freight car moved but it left the tracks. On July 3, the President of the T.P.& W. RR called the Mayor stating he would send the bill for the work of placing the car back on the tracks to the City and the Mayor said he 228 July 7, 1970, Cont. (3) would turn same over to the City Attorney. Alderman Edwards stated he condoned the Mayor's action. Dance. Mayor Jennings reported that a Mrs. Rodney had called regarding a dance band known as the "Momentaries" would play for three Saturday night dances free and asked for open dates from the Council. Alderman Hurst moves, Alderman Edwards seconds motion to allow the Mayor to contact the musicians for dates, City of Canton to provide Auxiliary Police. Alderman Howard suggested that the Mayor look over the advertising to be placed in newspapers. Voice vote, carried. Bicycles. Alderman George said bicycle riders are ignoring Yield Right-of-way and stop signs, ride their bikes on the wrong side of one-way streets and should be warned to obey the traffic laws, otherwise, the Police and Legal Committee will have to set up a °policy. Bids for gates and flood lights for parking lot on Main and Locust Street. Mo- tion by Alderman Hurst, seconded by Alderman Sepich to open these bids and the motion carried. Bids read: Bell & Gustus from Chicago; Keene Coin Handling Division from Chicago; and Acme Cash Register and Office Machine Co. from Peoria. Alderman Hurst moves, Alderman Long seconds motion to refer the bids to the Traffic Committee for study. Motion carried. Alderman Rupe called to answer the telephone. Motion by Alderman Spencer, seconded by Alderman Edwards to open bids for flood lights. Motion carried by voice vote. Bids read: Homer Electric and Kam- alager Electric. Alderman Svob moves, Alderman Yerbic seconds motion to refer the bids to the Building and Grounds Committee and the motion carried. Alderman Rupe returns to Council Chamber. Alderman Howard moves, Alderman Kovachevich seconds motion to recess for a few minutes to consider the bids and the motion carried, voice vote. Mayor Jennings called :for a recess at 7:42 P. Ii, and reconvened at 8:00 P. M. Alderman Long excused from Council Chamber at 7:42 P. M. Motion by Alderman Sepich, seconded by Alderman Kovachevich to accept the bid of the Acme Cash Register Co. for the gates for the parking lot. Roll call vote. AYE: Aldermen Kovachevich, George, Spencer, Yerbic, Williams, Kroell, Edwards, Hurst, Sepich, Svob, Rupe, and Howard. NAY: None. Motion by Alderman Spencer, seconded by Alderman Hurst to accept the bid of Kamlager Electric with the condition to have permission to fasten the lights to the adjoining building. Roll call vote. AYE: Aldermen Howard, Rupe, Svob, Sepich, Hurst, Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovache- vich. NAY: None. Alderman Edwards moves that the Ordinance Committee change Ordinance when: making up the Tax Levy Ordinance: Garbage Disposal from .114 to .17; Fire Protection from .10 to .15; and add Police .05. Alderman Hurst seconds this motion and it carried by voice vote. Bids for covering building by the Main and Locust Street parking lot. Alder- man Hurst asked to be excused from voting on bids since he had submitted a bid. Discussion regarding a member of the Council submitting a bid and Alderman Hurst requested that his bid be returned unopened. One bid read: Dan Hull. Motion by Alderman Spencer, seconded by Alderman Sepich to readvertise for bids and the motion carried. Mayor Jennings reported the IHC would be on vacation at the time of next Council meeting. Motion by Alderman George, seconded by Alderman Yerbic to postpone the Council meeting from July 21 to July 28, 1970 and the motion carried. Municipal League Convention to be held, starting Oct. 3, 1970, Springfield. Mayor Jennings asked the Aldermen to notify him or the City Clerk about reserva- tions.
