April 7, 1970
Canton City Council held a regular meeting on April 7, 1970 in the City
Council Chamber. Mayor Jennings called the meeting to order at 6:30 P. M.
Present for roll call: Aldermen Rupe, Svob, Farr, Sepich, Hurst, Edwards,
Kroell., Williams, Yerbic, Spencer, George, and Kovachevich. Absent: Alder-
man Howard. Alderman Long arriving at 6:35 P. M.
Pledge -of Allegiance was followed by Invocation by Alderman Edwards.
Minutes of previous meeting. Motion by Alderman Kroell, seconded by Alderman
Yerbic that minutes be accepted as presented and placed on file. Voice vote
carried.
Alderman Lang arriving in Council Chamber 6:35 P. M.
Dolson Outdoor Advertising Co: Motion by Alderman Edwards, seconded by Alder-
man Hurst to allow Mr. Steve Winkler, representing the Dolson Advertising Co.
to present a plan for advertising on the Main and Locust Street parking lot --
a sign one foot high by thirty-five feet in length to be sold as advertising, with
the City of Canton being allowed a sign about 4 feet by 35 feet for use of the
City for privilege of erecting the sign. Mayor Jennings recommended this matter
be referred to the Traffic Committee for study and reoort to the next meeting.
Bids: Anderson Place Lift Station. Motion by Alderman Sepich, seconded by
Alderman Hurst to move the reading of bids from latter part of agenda to this
time. ?Motion carried by voice vote. Bids read: Petersburg Plumbing and
Heating Co. $34,013.82; Natkin & Co. (Peoria) X25,810.00; Taylor 3rothers
Construction Co. (Dunlap) $30006.00. . ,lotion by Alderman Yerbic, seconded
by Alderman Kroell to refer these bids to the 11ater and Sewer Committee for
study and report back to the Council. :lotion carried by voice vote.
Bids= Fill Sand. Motion by Alderman Hurst that bids for fill sand be opened.
?lotion seconded by Alderman Farr. Voice vote carried. Bids read: Ghlee
,iatson Trucking '1.85 per ton; Robert rlheeler & Sons Trucking $1.95 per ton;
Dick's Trucking Service $1.70 per ton; Concrete Materials of Peoria X2.25
per ton; John Kohler $1.95- per ton. Motion by Alderman Hurst, seconded by
Alderman Rune to accent the low bid for the fill sand. Roll call vote. AYE:
Aldermen "Kovachevich, George, Spencer, Yerbic, Williams, Kroell, Edwards, Long,
'iurst, Sepich, Farr, Svob, and Rupe. NAY: None. Motion carried. Motion by
Alderman Hurst, seconded by Alderman George that the Mayor enter into a con-
tract with the low bidder and designate when the time is applicable for deli-
very. Motion carried by voice vote.
Petition. Request for Annexat;_on - Harold Lewis and Creta Wilson and Port
and Lorraine Bradley - lots No. 16 and 17 in 4 11. V. Young's Sub-Division.
Motion by Alderman Spencer, seconded by Alderman Sepich to refer this Petition
to the 711anning-2oning Commission for study and report to the Council. Voice
vote carried. Petition No. 181.
Bills for :-larch. Alderman Edwards reported the bill for fish for the Lake
was actually $377.00 for the City's share -- that the balance of the Ken-
tucky Live Fish Co. bill was f or fish that had been sold and paid for by
others. Motion by Alderman Hurst that all bills properly approved be allow-
ed for payment, seconded by Alderman George. Alderman Williams reported one
bill -- the Traffic Committee, Police and Legal Committee and Street and
Alley Committee to meet on April 9 and discuss same. Roll call vote. AVE:
Aldermen Rune, Svob, Farr, Sepich, Hurst, Long, Edwards, Kroell, Williams,
Yerbic, Spencer, George, and Kovachevich. NAY: None. Alderman Hurst re-
quested that the City Clerk send a letter to the American Pest Control that
the service to the Sanitary Landfill is no longer desired.
Reports of all officers, condensed form of same presented to each Alderman.
Alderman Long moves, Alderman Yerbic seconds motion to accept same and ;dace
on file. Roll call vote. AYE: Alderman Kovachevich, '...eorge, Speneer,}Yer-
bie, Williams, Kroell, Edwards, Long, Hurst, Sepich, Farr, Svob, and Rune.
NAY: None. Motion carried.
Standing Committee Reports.
Finance Committee. Alderman Edwards reported on Finance Committee recommien-
dations: 61% increase in wages for all employees, an increase in insurance
coverage, making the total increase to employees approximately 7 and one-
eighth percent. Motion by Alderman Edwards, seconded by Alderman Rupe that
the Payroll Ordinance be drafted. Roll call vote. AYE: Aldermen Rupe, Svob,

Farr, Sepich, Hurst, Long, Edwards, Kroell, Williams, Spencer, George,
and Kovachevich. NAY: Alderman Yerbic. (7.1 AYES and 1 NAY) . Motion
carried.
Alderman Edwards reported that the Buckheart Mine had donated twenty
barrels for use for the lake and wished to thank them for this courtesy.
Alderman Svob reported the recommendations for the recognition of the
City of Canton Firemen -- and moves that the City Council recognize the
local firemen as members of the Internat-i,onal Association of Firefighters.
Discussion. Roll call vote. AYE: Aldermen Kovachevich, George, Spencer,
Yerbic, Williams, Long, Hurst, Farr, and Svob. NAY: Aldermen Kroell, Ed-
wards, Sepich, and Rupe. (9 AYES and 4 NAYS). Motion carried.
Traffic in vicinity of College. Alderman Williams reported a meeting had
been held regarding same and something would be worked out in near future.
Alderman George -- regarding Police Patrolmen's Union, moves that a
Resolution be drawn that the Canton Police Department, Chapter of Local
463, Council Gila., American ='ederation of State, County and Municipal Em-
ployees of AFL-CIO be the bargaining agency for the local Police Depart-
ment with the City. Alderman Farr seconds this motion. Discussion. Roll
1fJ call vote. A27E: Aldermen Svob, Farr, Williams, Yerbic, Snencer, George,
and Kovachevich. NAY: Aldermen Rupe, Sepich, Hurst, Long, Edwards, and
Kroell. (7 AYES and 6 NAYS). Mayor Jennings reported the motion carried.
Water and Sewer delinquent bills. Alderman Rupe reported in the future,
thirty days will be allowed to pay a water bill and if same is not paid
by that time, the water will be turned off -- bills will be printed so
that no further notice will be necessary. j
Canton Motorcycle Club and the Y.M.C.A. Leases. Motion by Alderman Ed-
wards, seconded by Alderman Hurst that the leases be read. Carried by
voice vote. Lease read. Motion by Alderman Edwards, seconded by Alder-
man Rupe that the Mayor be instructed to enter into the Agreement for
this lease. Roll call vote. AYE: Aldermen Kovachevich, George, Spencer,
Yerbic, Williams, Kroell, " dwards, Long, Hurst, Sepich, Farr,SV6b, and
Rupe. NAY: :gone. Agreement - lease No 164.
Motion by Alderman Edwards, seconded by Alderman George that the Mayor be
instructed to enter into the Agreement for the Lease with the Y.M.C.A.
Roll call vote. AYE: Aldermen Rupe, Svob, Farr, Sepich, Hurst, Long,
Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich. NAY:
None. Lease Agreement No. 165.
Outside Contractors Ordinance. Alderman George moves, Alderman Williams
seconds motion to have an Ordinance drafted to update the "Outside Con-
tractors" Ordinance. Motion carried by voice vote.
Inquiry by Alderman Hurst regarding the Ordinance pertaining to strip
mines. City Attorney Malmgren reported he may have same ready for the
next Council meeting.
Special Committee reports.
Fulton County Safety Dinner to be held April 14, 1970. Alderman Farr
urged the Aldermen to make reservations early for same.
W. Vine Street. Alderman Farr stated he was very unhappy withthe condition
of street improvement on ,Jest dine Str_;et and asked for another state in-
spection. In the meantime copy of letter from Crawford, Murphy and Tilly,
Consulting Engineers to the Division of Highways was read.
Alderman Hurst moves and Alderman Edwards seconds motion to allow Mr. Wil-
coxen to speak to the Council. Permission granted by voice vote. Mr. Wil-
coxen made inquiry as to when the sidewalks would be installed on !forth
Main Street.
Communications to Council.
Resignation of Fred Linder from the Planning ,..: Zoning Commission and the
Greenwood Cemetery Board. Motion by Alderman Hurst, seconded by Alderman
Long that the resignation be accepted and placed on file. Voice vote.

T.P.Rx.W. RR Co. answer to City Attorney Malmgren's request for repairs
on railroad crossings in the City. Alderman Williams suggested that
the City Attorney be given authority to take whatever action is necessary
to make repairs, especially on First Avenue. Mayor Jennings reported
that the C3.Q RR and the TP&W RR are making arrangements for a switch
yards for both to use.
Planning and Zoning -- Preliminary 71at for Eastanore Addition presented
by Attorney Eugene Taylor. Alderman Hurst moves, Alderman Rupe seconds
motion to approve the plat providing that 54 feet right-of-way is shown
and the Planning Commission re,,-)ort is returned within thirty days regard-
ing Lot No. 40 (which has been held pending its use for a roadway). Dis-
cussion regarding the street width. Alderman Rupe withdrew his second of
motion and the Mayor asked for another second to Alderman Hurst's action
not received. Mayor declared the motion lost because of lack of a second.
The plat of the Eastmore Addition was presented after reading the letter
of recommendation for approval from the Planning and Zoning Commission.
Department of Public Health -- Trailer Parks. Report of Trailer Park in-
spection made on March 17, 1970 - list ..ng discrepancies. Chief of Police
Elam and Health Officer Paul debergall to make another inspection of the
Trailer Courts on April 9 and give each court a copy of the rules.
Poppy -Day -- American Legion Auxiliary, request to hold Poppy day from
noon May 8 to noon May 9, 1970 and the request for use of three parking
meter stalls in front of McLuckies Store for the 40 & 8 locomotive. Mo-
tion carried by voice vote.
Letter from Attorney James VanSickle to City Attorney William Malmgren re-
garding Ordinance for rezoning the George Florea property from an R-2 to
R-3 residential property. Ordinance read. Alderman Hurst moves, Alder-
man Edwards seconds motion to suspend the rules. Roll call vote. AYE:
Aldermen Kovachevich, George, Spencer, Yerbic, Kroell, Edwards, Long, Hurst,
Farr, Svob, and Rupe. NAY: Aldermen Williams and Sepich. (11 AYES and
2 NAYS) . Alderman Hurst moves, Alderman George seconds motion to place the
Ordinance on its passage. Roll call vote. AYE: Aldermen Rupe, Svob, Farr, l`
Sepich, Hurst, Long, Edwards, Kroell, Williams, Yerbic, Spencer, George, and

Motion by Alderman Long, seconded by Alerman George that the plat for East-
more Addition be accepted with restrict.-�ons. Roll call vote. AYE: Alder-

Hurst, Sepich, Farr, Svob, and Rupe. NAY: None.
Thank you note for flowers from Mrs. May George. Alde , n George also
thanked the Council for the thoughtfulness shown.
Alderman Hurst moves, Alderman Svob seconds motion to send the plat of
Eastmore Addition back to the Planning and Zoning Commission to make recom-
mendations within 120 days. Voice vote. AYE: Carried.
Old business.
Inquiry from Alderman Hurst regarding dirt to be placed on W. Railroad St.
Ordinance for Electrical Energy and Municipal pumping with the C.I.P.S.Co.
up for second reading. Motion by Alderman Farr, seconded by Alderman Svob
to read same by Title only. Voice vote carried. Title read. Motion by
Alderman Long, seconded by Alderman Hurst to place the Ordinance on its
passage. Roll call vote. AYE: Aldermen Rupe, Svob, Farr, Sepich, Hurst,
Long, Edwards, Kroell, Williams, Yerbic, Spencer, George, and Kovachevich.
NAY: None. Ordinance No. 300.
Agreement with the C.I.P.S.Co. up for second reading. Motion by Alderman
Long, seconded by Alderman Edwards to read same by Title only. Voice vote
carried. Title read. Motion by Alderman Long, seconded by Alderman Svob
that same be accepted and placed on file. Roll call vote. AYE: Aldermen
Kovachevich, George, Spencer, Yerbic, Williams, Kroell, Edwards, Long,

Resolution for Engineering services with Crawford, Iurphy & Tilly, Consulting
Engineers for Section 45CS (E. Chestrut St. paving) and Resolution for request
for motor Fuel Tax Funds for Engineering services for same. Motion by Alder-
man George, seconded by Alderman Hurst that the Resolutions be adopted. Roll
call vote. AYE: Aldermen Rupe, Svob, Farr, Sepich, Hurst, Long, Edwards,
Kroell, Williams, Yerbic, Spencer, George, and Kovachevich. NAY: None. Res-
olutions No. 525 and 526.

Resolution authorizing the Mayor to act on behalf of the City of Canton in
connection with Federal Crant applications. Motion by Alderman Sepich, sec-
onded by Alderman Hurst to adopt this Resolution. Roll call vote. AYE: Alder-
men Kovachevich, George, Spencer, Yerbic, Williams, .Kroell, Edwards, Long,
Hurst, Sepich, Farr, Svob, and Rupe. NAY: None. This being Resolution No.629.
Alderman Edwards thanked the City Clerk for the preparation of condensed forms
of the officers reports and presenting each Alderman with copy. of same.
Lo Mayor Jennings recommended that the newly appointed-Alderman Kovachevich assume
the duties of the previous Alderman A. Pryce Preece. who had resigned because of
illness. Alderman George moves, Alderman Svob seconds motion that Alderman
Kovachevich assume the- res^onsibilities of A. Pryce Preece. Voice vote carried.
Motion by Alderman Spencer, seconded by Alderman Yerbic to adjourn. Voice vote
carried. Canton City Council adjourns at 8:50 P. M.
