December 16, 1969
Canton City Council held a regular meeting on Dec. 16, 1969 in the City Council
Chamber. Mayor Jennings called the meeting to order at 6;30 P. M. Present for
roll call; Aldermen Howard, Rupe, Svob, Farr, Hurst , Long, Edwards, Kroell,
Williams, Yerbic, Spencer, and George. Absent; Aldermen Sepich. and. Preece.
Pledge of Allegiance was followed by Invocation by Alderman Edwards.
Minutes of previous meeting; Motion by Alderman Kroell, seconded by Aldermen
Long that the minutes be accepted. as presented and placed on file and motion
carried by voice vote .
Petition; Request for a stop sign on South Main Street and Tamarack Street signed
by thirty-three property owners. Alderman Edwards explained, the necessity for some
means of slowing traffic at this intersection. Mrs. Marinich and Mr. John Polony
told of instances of accidents occuring and that something should. be done before
someone is killed. Motion by Alderman Edwards, seconded by Alderman Long that the
Traffic Committee and Chief of Police make a study of that corner and have the power
to take necessary steps by having an Ordinance drafted if needed. Carried by
voice vote. Petition No. 174.
Petition; Ministerial Association, represented by Mike Chianaka.s, presented petitions
with between 1500 and 2000 names requesting the regulation of the type of movies to
be shown in Canton. Mr. Malmgren, City Attorney, stated he was working on the
preparation of an ordinance which should be ready by January, 1970. Other cities are
having the same difficulty and working toward a solution. Motion by Alderman Yerbic,
seconded by Alderman Edwards to place the Petition on file. Petition No. 175•

Standing committees.
Alderman Kroell, Canton Promotion Committee, stated that the City of Canton had
participated in the expense of the Christmas lights with the A.C.I. and he was
disappointed with the poor lighting results -- there is no proper service for this
lighting. General discussion including Ron Avery from the C.I.P.S. Co. and Stanley
Klyber from the A. C. I. Mr. Klyber stated the decorations would. be placed so they
could be lighted next year. Motion by ,alderman Svob, seconded by Alderman Farr that
the Canton Promotion Committee and the Lighting Committee work with Mr. . Klyber on
this matter. Carried by voice vote.
Traffic Committee; Meeting set by Alderman Williams for Dec. 20, 8;30 A. M.
Lake Development Committee; 1. Alderman Edwards reported on a meeting on Dec. 9.
Tile landfill tractor will be used at Lake Canton to open a new road before it
is delivered to the landfill site. 2. Lake Development Committee purchased 4000
channel cat fish (7-10 inches) for the benefit of the Canton Fishing Club. These
fish to arrive in Canton Dec. 19, 1969.
Finance Committee; Alderman Edwards moves that purchase order requests be printed
for use in all departments, and all purchases must be signed by the Mayor, Finance
Chairman, Department Head. and. Chairman of the committee . Alderman Hurst seconds
this motion. Motion carried by voice vote.
Water & Sewer Co-mittee; Alderman Rupe stated he had a telephone conversation with
James Taylor, Abstractor, and assured the Council of a, report the first meeting in
January regarding Canton's water shed.
Lights Committee; Meeting of the Lights Committee to be held following the Council
meeting together with Mr. Avery and Mr. Klyber.
Alderman Long excused at 7;14 P. M.
Garbage Disposal Committee; Report by Alderman Hurst - tractor for the land fill
to be delivered December 23. He also stated that the old city dump was to be
locked and keys for same to be loaned out by the City Clerk, Street Superintendent
or him (anyone wishing to use the old. city dump to sign when receiving said. key).
Civil Defense Committee; Report of the tour and meeting held in the Civil Defense
headquarters the previous week and wished that organization to know how much their
work is appreciated.
Special committee reports.
Alderman Hurst recommended that the Planning & Zoning Commission propose an active
annexation system around the city to see that growth proceeds as the city desires.

Alderman Spencer inquired. how far this annexation should extend and AVerman Hurst
said. to include the Lake Canton.
Mayor Jennings thanked the Street Department for the excellent work done on city streets
during the recent snow storm.
Mayor Jennings complimented the new Chief of Police, James Elam, and also the entire
Police force.
Inquiry by Alderman Hurst if there were any "No Parking on this side of Street"
signs available and stated. they had never been installed on West Maple Street.
Communications to Council .
Letter from Canton Planning Commission recommending the Proposed Comprehensive
Plan as -prepared by Scruggs & Hammond of Peoria, Illinois. Motion by Alderman
Hurst , seconded by Alderman Rune that this plan be adopted, made a mart of our
Ordinances and P. cony of the plan sent to the county officers who would be in
v need of this material . Roll call vote. AYE: Aldermen George , Spencer, Yerbic,
Williams, Kroell , Edwards, Hurst, Farr, Svob, Ripe and Howard. NAY: None.
Alderman Hurst recommended that the building code be updated.
Letter from the Canton Planning Commission recommending rezoning of property from
R-l. (Single Family Residence and 3-1 (Local Shopping District) to B-2 (General
Business District) -- ;property belonging to Mr. Venovich who wishes to build. a. trailer
court for retired persons. Motion by Alderman Hurst, seconded by Alderman George
that this request be referred. to the Ordinance Committee. Voice vote, carried.
Letter from Spoon River College thanking the Canton City Council for their interest
in the recent referendum.
Thank you note from the Robert Jennings family for flowers at the time of Mrs.
Hardin's death.
Thank you note from the First Christian Church for the assistance given in repair-
ing and placing the parking lot in good condition.
Notice from the Illinois Commerce Commission regarding the proposed 10% increase
in fares by the Crown Transit Co. Motion by Alderman Hurst, seconded by Alderman
Svob to refer the matter to the City Attorney if it was necessary to represent the
City at this meeting. Voice vote carried. Mr. Malmgren stated it was not necessary
that he attend this meeting.
Letter from the Department of Public Health regarding the condition of the Land Fill,
commending the City for the efforts in making this a good operation.
Letter of approval of inspection of 68-8, West Vine Street by the Division of High-
ways - inspection made on December 5, 1969.
Letter of approval of inspection of 68-A, E. Chestnut St. , Seventh and Eighth Ave.
by the Division of Highways - inspection made on December 5, 1969.
International Association of Fire Fighters, C,,nton Local No. 1897 and the Associated
Fire Fighters of Illinois, also Local No. 1897 - request for a meeting of the Canton
Firemen with the Mayor and. full Council on Dec. 22, 1969 at 6:30 P. M.
American Federation of State, County and 14unicipa.l Employees, AFL-CIO Union, Canton
Chapter of Local No. 463- request by the Police Department for a. meeting with the
Mayor and full Council on Dec. 22, 1969, 7:30 P. M.
Motion by Alderman George, seconded by Alderman Edwards that the above requests
by the Fire and Police Dept. for an audience with the Mayor end Council be granted.
Carried by voice vote.
Sanitary Water Board letter of approval of eight-inch sanitary sewer extensions
on Poplar Street and North First Avenue in "The Meadows" subdivision.
Copy of letter from Crawford, Murphy & Tilly Engineering Firm to Mr. J. E. Harland,
District Engineer for the Illinois Division of Highways regarding intersection
design study for Locust and Main Streets and Locust St. and First Avenue --
recommending parallel parlting spaces on the west side of Main Street, arid. leaving

parallel parking on the east side. Motion by Alderman Hurst , seconded by Alderman
George to accept the plan and inform the Division of Highways of this approval.
(Alderman Farr inquired about the possibility of two-way traffic on West Chestnut
Street) . Discussion. Roll call vote on the motion: Alderman Howard., Rupe, Svob,
Farr, Hurst, Edwards, Kroell, Williams, Yerbic, Spencer and George. NAY: None.
Letter from Attorney George K. Meuth re: Vahle vs. Zoning Board of Appeals, No.
69-2479 read. Mayor Jennings stated that Mr. Meuth was attending the Cuba Council
meeting a.nd would be heard later in the evening.
Suggestion for marking meter fines in the Police Department. Overparking 50¢, over
24 hour $1.00, after two notices complaint signed, citizen picked up and legal steps
taken. Mayor Jennings reported there were 4090 unpaid parking meter tickets, 3218
notices had been mailed, this month, seventeen notices to appear. before court, 525
unidentifiable tickets this month. Chief of Police Elam stated that after Jan. 1,
1970 warrants will be served. Alderman Spencer moves, Alderman Yerbic seconds motion
to draft an ordinance to the effect that more drastic measures will be taken to
collect these narking meter. fines. Voice vote. Carried.
Old business.
U" West Walnut Street (Ave. D to Corrora.te limits) improvements, 69-B up for second
reading. Motion by Alderman Howard, seconded by Alderman Hurst to read Ordinance by
Title only. Carried b voice vote. Title

Petition and Ordinance ready for second. reading - Annexation of the Dprren Oaks
property on E. Chestnut St . Motion by Alderman Hurst , seconded by Alderman Farr to
read Ordinance by Title only. Carried, voice vote. Alderman Williams moves, Alderman
George seconds motion to place this Ordinance on its passage. Roll call vote. AYE:
Aldermen Howard, Rupe , Svob, Farr, Hurst, Edwards, Kroell, Williams, Yerbic, Spencer,
and George. NAY: None. Petition No. 176 and Ordinance No. 287.
Motion by Alderman Hurst , seconded by Alderman George that the Council adopt a policy
that sewer.. and water will not be installed in properties outside corporate limits until
building conforms to zoning, a building permit is obtained and the proper license fees
paid. Roll call vote. AYE: Aldermnen George, Spencer, Yerbic, Williams, Kroell,
Edwards, Hurst , Farr, Svob, Rupe, and Howard. NAY: None.
New business.
Resolution for Public Benefit Assessments for Sections 48-CS and 51--CS (Principal
$23,612.00 and Interest $2,894.70), total $26,506.70 from Motor Fuel Tax Funds.
Motion by Alderman George , seconded by Alderman Hurst to adopt this Resolution.
Roll call vote. AYE: Aldermen Howard, Rupe, Svob, Farr, Hurst, Edwards, Kroell.,
Williams, Yerbic, Spencer and George . NAY: None. Resolution #51-5.
Resolution for Public Benefit Assessments for Sections 45-Cy. and 46-CS (Principal
$91 ,011.23, Interest $17,816.33), Total $108,827.56 from Motor. Fuel Tax Funds.
Motion by Alderman Farr, seconded. by Alderman George to adopt this Resolution. Roll
call vote. AYE: Aldermen George, Spencer, Yerbic, Williams , Kroell, Edwards, Hurst,
Farr, Svob, Rupe, and. Howard. NAY: None. This being Resolution No. 516.
Estimate No. 8, Normoyle-Berg & Associates, Division 11 and 12, in the amount of
,74, 863.85 due at this time - aprroved. by Resident Engineer. Motion by Alderman
Hurst, seconded by Alderman Farr that this estimate be allowed for payment . Roll call
vote. AYE: Aldermen Howard, Rupe, Svob, Farr, Hurst , Edwards, Kroell, Williams,
Yerbic, Spencer and George. NAY: None.
First reading of an Ordinance pertaining to fees -nail to the Zoning Enforcing Officer -
10`9 to be uaid for collection of outside contractor license fees. Alderman Hurst moves
and Alderman George seconds to insert 'May 6, 1969" and this motion carries by voice
vote. Motion by Alderman Hurst to suspend the rules . Alderman Kroell seconds motion.
Roll call vote. AYE: Aldermen George , Spencer, Yerbic, Williams, Kroell, Edwards,
Hurst , Farr, Svob, Rupe and Howard. NAY: None. Motion by Alderman Edwards, seconded
by Alderman Hurst to place the Ordinance on its passage. Roll call vote. AYE:
Aldermen Howard, Rupe, Svob, Farr, Hurst , Edwards, Kroell, Williams, Yerbic, Spencer,
and George. Nay: None. This being Ordinance No. 288.
Youth Commission. Mayor Jennings appoints E. Stanley Klyber as Chairman of a local
Youth Commission to work with the Chief of Police. Alderman Howard moves, Alderman

Hurst seconds motion that the appointment be accepted. Mr. Klyber stated this
Commission works with the Youth referred to them by the Chief of Police as Big
Brothers or Sisters and in some cases saves these young people from being sent to
institutions. Motion carried by voice vote.
Mr. James Henderson extended an invitation to the Elected Officials to attend the
Golden Gloves Tournament at the new Armory - gratis - seats reserved for them.
Alderman Farr stated the City should. have a. Zoning Ordinance for the protection of the
City's Water shed. City Attorney Malmgren stated the Illinois Statutes gives the city
the right to protect water shed un to twenty miles if necessary. Motion by Alderman
Farr, seconded by Alderman Hurst to refer this matter to the Water amd. Sewer and
Ordinance Committee to work with the City Attorney. Carries, voice vote.
Mr. George Meuth arrives in Council Chambers and addressed. the Council concerning
the Vatiile vs. Zoning Board of Aprea.ls, stating the City must file an answer and send
the entire record to the court. Alderman Howard. moves, Alderman George seconds motion
to refer this matter to the Mayor, and Police and Legal Committee for appointment
of en attorney to represent the city, setting a -price, and reportto the Council (City
Attorney Wm. Malmgren unable to represent the City of Canton because of his committment
to the orrosition) . Roll call vote on the motion. AYF: Aldermen George, Spencer,
Yerbic, Williams , Kroell, dwa.rds, Hurst, Farr, Svob, Rupe and Howard. NAY: None.
Sidewalks on North Main Street. Mr. Ronald Wilcoxen had requested permission to speak
to the Council. Alderman Hurst moves, Alderman Farr seconds motion to grant this
permission. Carried by voice vote, Mr. Wilcoxen stated there were three properties
on the west side of North Main Street (1420, 14.30 and 1460) that had not participated
in building sidewalks on that street and asked the Council if they could do any thing
to get results. After a, discussion, it was decided that Aldermen Farr, Svob, Rue
and Howard. should contact these property owners to see if they will agree to build
sidewalks.
Bids for gas, oil, fuel oil, etc. next item on the agenda. Motion by Alderman Hurst,
seconded by Alderman Yerbic that the City Clerk be instructed to open the bids .
Voice vote carries. Alderman Hurst moves an(I Alderman Howard seconds motion that
the Clerk read bids for gasoline and fuel oil only. Motion carried by voice vote.
Bids read. Alderman Yerbic moves , Alderman George seconds motion to refer the bids
to the Garbage Disposal Committee for study and resort back to Council. Carried
by voice vote.
Alderman Yerbic moves, Alderman Svob seconds motion to Adjourn, and it ca.rA.ed by
voice vote. Canton City Council adjourns at 9:10 P. M.
