Canton City Council held a regular meeting on Aug. 18, 1964 August 18, 1964
in the City Council Chamber.
Mayor Cook,, called the meeting to order at 7:03 P.M.Present for roll call: Aldermen Sebree,
Howard, Duncan, Hurst, Whitehead, Skinner, Long, Abbott, Gibbons, Horton, Bender, and
George. Arriving at 7:05 P,M.: Aldermen Wright and Jennings.
Pledge of Allegiance was followed by Prayer by Alderman. Long.
Alderman Long moves and Alderman George seconds a motion to accept the minutes of the
previous meeting, as presented, and place on file. Roll call vote. AYE: Aldermen
George, Bender, Horton, Gibbons, Abbott, Long, Skinner, tidhitehead, Hurst, Duncan
Howard, and Sebree. NAY: None. ,
Aldermen Wright and Jennings arriving in the Council Chamber 7:05 P. M.
Mayor Cook called for reports of standing committees.
Alderman George asked for the Board of Local Improvements to make an investigation on
the work on Mulberry Place before the street improvement is completed. Alderman
Wright asked to have VanDyke Drive checked also.
Mr. Ritchie from the Crawford, Murphy & Tilly Engineering Firm stated that plans and
specifications are ready for the approval of the Public Health Agency and then to be
advertised for bids. The Quality Hill plans and StJeCifications are complete and are
to be submitted to the Sanitary Water Board on Aug. 19 for approval (and since the
plans and specifications are on same basis as previous plans), he suggested that ads
CZ for bids could be published, providing easements have been secured, suggested date to
open bids, Sept. 10 so that Crawford, Murphy & Tilly could check on same and give
their report to the Council on Sent. 15. The Johnstone Construction Co. are willing
to make an extension of the contract for sewer work in the north part of the city
same price for one portion of work and $1.00 per foot additional fee for that Portion
where a lot of shrubbery interferes wlt:i work. The Crawford, Murphy & Tilly Firm
recommends signing an additional contract for that work providing the right-of-ways
can be obtained. Alderman Jennings inquired about one property owner on East Olive
Street digging a sewer line out in the middle of the street and recommended that
this violation be corrected. Alderman Howard moves that the violator be notified by
the City Attorney and that the uJual procedures be taken to collect the sewer tap,
etc. and that the road be repaired as it should be and report to the next Council
meeting. Alderman Gibbons seconds this motion. Roll call vote on the motion. AYI''-
Aldermen Sebree, Hmvrard, <<lright, Hurst, Whitehead, Skinner, Long, Abbott, Gibbons,
Horton, Jennings, Bender, and George. NAY: Alderman Duncan. (13 AYES and 1 NAY).
Alderman Jennings inquired about the sewer extension in the Sixth Ward -- Mr.
Ritchie said that he had talked to ,Kr. Edward Sexton and that approval of the Board
of Supervisors was pending (their next meeting to be Sept. 8) . Alderman Jennings
inquired about the lagoon -- T�r. Ritchie stated that the East Chestnut Street and
lagoon project are in one and that it is necessary to get a right-of-way for the
pumping station. Ile stated there were eight or nine acres of corn on the lagoon
site that would have to be paid for to the former owners. Alderman Bender moves and
Alderman Jennings seconds a motion to advertise for bids for the standpipe, same to
be' received until Sept. 10, 1964, 5:00 P. M. Alderman Hurst moves to amend the mo-
tion that all bids be in by Sept. 8. Alderman IIri,ht seconds this motion. Roll call
vote on the amendment: A' : Aldermen George, Bender, Jennings, Horton, Gibbons,
Abbott, Skinner, Whitehead, Hurst, Wright, Howard, and Sebree. NAY: Aldermen Long
and Duncan. (12 AYES and 2 NAYS) . Motion carried. Roll call vote on the motion.
AYE: Unanimous. Alderman Howard moves that the City Council authorize the Mayor
and City Clerk to sign an extension on the contract with the Johnstone Construction
Co. for Stonegate Drive at an additional $1.00 per foot. Discussion regarding ease-
ments that are not signed. No second to the motion. Alderman Howard then moves that
the Water and Sewer Committee investigate to see what the hold-up on the Stonegate
Drive easements were. Motion withdrawn. Alderman Hurst moves that the City Attorney
be directed to start condemnation suit against Mr. Potesanos, the Builders Supply Co.
and the Canton Developers. Aldenian George seconds this motion. The City Attorney
advised laying the sewer on the alternate route, leaving_ the non-signers out and that
then these persons would soon sign up. Alderman George withdrew his second of the
motion and Alderman Hurst withdraws his motion. Alderman IaVard moves that pending
on the attaining of easements, the Council authorize the extra money for footage for
Stonegate sewer a xtens:ion. Alderman Skinner seconds this motion. Roll call vote.
AYE: Unanimous. Mr. Ritchie stated that a "change-order" would be drawn for this
work.
Alderman Hurst reported that the Mayors of Farmington, Fairview, Cuba, St. David, and
,iorris attended the meeting held regarding the use of sanitary land fills. Alderman
Hurst reported that these communities represent over 5000 population and a recommended

Alderman Hurst asked the Traffic Committee what plans had been made regarding the band
stand in Jones Park. Alderman Jennings stated it was a question whether to repair and
paint the band stand or to remove the top. Alderman Bender given permission to be ex-
cused from the Council Chamber at 9:10 P. Me Alderman Long reported one bid had been
received for painting and repairing but. same was too high, Alderman Wright moves to
advertise for bids for removal of top of band stand, then withdraws his motion and
moves regarding the removal of top of band stand and asks for the feeling of the Coun-
cil with the idea that in the future shrubbery will furnish the shell for the band-
stand. Alderman. Jennings seconds this motion. Roll call vote. AYE:

Levy ordinance up for second reading. Alderman Long moves to dispense with the
entire reading of said ordinance. Alderman Skinner seconds same, No call for vote,
Tax Levy Ordinance read: headings, the total amounts appropriated and the total
amounts to be levied. Alderman Hurst moves and Alderman Long seconds a motion to
accept the Ordinance as read for second time and vote for the passage of same. Roll
call vote. AYE: Unanimous. This being Ordinance No.115.
Alderma;i Long moves that bids for oiling and chipping be opened. Alderman Jennings
seconds this motion. Roll call vote. AYE: Unanimous. Bids opened: We L. 14iller
Co., $7,220.00 and the Pschirrer Coal and Asphalt Co. $6,650.00. Alderman George
moves and Alderman Duncan seconds a motion to accept the lout bi d and refer to the
Street and Alley Committee. Roll call vote. AYE: Unanimous.
Alderman George moves, Alderman Duncan seconds a motion to adjourn. Voice vote.
