HomeMy WebLinkAbout02-04-1964 Council Meeting Minutes 226 Neb. 45 1964 Canton City Council held a regular meeting on Feb. 43 1964 in the City Council Chamber. In the absence of Mayor Cook, City Clerk Crawford called the meeting to order at 7:10 P. M. and announced that a motion George order to select a Mayor pro tem. Al seconds a motion that the Finance Chairman, Alderman Howard be named to that office. Voice vote. AYE: Unanimous. Mayor Howard, pro tern, called for Roll call. Present; Aldermen Sebree, Wright, Duncan, Hurst, Whitehead, Skinner, Long, Abbott, Gibbons, Horton, Jennings, Bender, and George. Absent; None. Pledge of Allegiance was followed by prayer by Alderman Long. Alderman Long moves and Alderman Bender seconds a motion that the minutes of the previous meeting be accepted and placed on file. Roll call vole. AYE: Unanimous. Petition with thirty signatures of residents in the vicinity of the Star De- livery, 435 S. Fifth Ave. complaining of extremely dangerous health and safety conditions. Alderman Wright moves that the Petition be accepted- .placed on file and referred to the Traffic and Street and Alley.Committees. Motion was seconded by Alderman George. Discussion regarding including the Planning and Zoning Commission into this motion. Alderman George withdrew his motion and Alderman Hurst seconds the original motion. AYE: Aldermen Howard, Wright$ Duncan, Hurst, Whitehead, Long, Abbott, Gibbons, Horton, Jennings, and Bender. NAY: Aldermen Sebree, Skinner, and George. (11 AYES and 3 NAYS). Moti on carried. Bills for the month-of January were read. Discussion regarding the Poggiolllder- bill- - an amount that had accumulated over a period of several years. man George moves that all bills properly approved, be allowed for payment. Alderman Gibbons seconds this motion. Roll call vote. AYE: Unanimous. Reports of all officers were read. Alderman Bender moves and Alderman George seconds a motion to accept same and place on file. Voice vote. AYE: Unanimous. Mayor Howard, Mayor pro tem., called for reports of standing committees. Alderman Wright requested permission to introduce two men from Elmwood, Mr. McFall and Mr. Lott, after muting to the Council the proposed interchange to be made east of the Route 78 instead of at route 78. Mr. McFall stated that money had been allocated and plans were stoned to file suit against the proposed interchange which would cause communities, along route 78 to be isolated. He asked that the City of Canton present a Resolution to the Dept. of Public Works and Buildings or the Federal Dept. of Public Works and B1dgs., recommending the interchange be located at junction of route 78. Alderman George moves and Alderman Wright seconds a motion to refer this matter to the City Attorney to ascertain the legalities and present a Resolution to the next Council meeting. Voice vote. AYE: Unanimous. Alderman Jennings reported that the Traffic Committee had met and asked that Alderman Hurst introduce two guestsfrom the Canton Ju4ior Chamber of Commerce, Mr. Fouts and Mr. Reith. Mr. Reith, speaking on behalf of the Junior Chamber of Commerce reported the pledge of ome.. tree for the Jones Park and suggested that other• organizations might follow suit. Alderman Jennings reported that if ar;y persons or organizations are interested in such a project, they may contact the Pavley Nursery for an accurate charge for trees and shrubs, at the present time there is need for fifteen Marine Locust and two sugar maple trees. Some trees have been purchased -- twenty foot tall and four inches in diameter -- same to be shipped in the next few days. Alderman Jennings extended thanks, on behalf of the entire Council, to the Canton Junior Chamber of Commerce for their generosity. Alderman Bender reported that the new water and sewer rate schedules have been compiled and asked the Council members to inspect same. He compliment Mayor's re Gibbons, City Engineer for compiling the data and Mrs. Betty Tandy, secretary, for typing and making up the book. Mayor Howard, pro tem., called for communications to the Council. C 22 7 Letter from Crawford Mur Feb. 4, 1964, Cont. (2) phy & Tilly, regarding the location of the oxidation pond and suggesting three alternate sites. Alderman Bender stated that sith No. 1, the Lowe Estate -- the City•Attorney should contact the owners and if he needs help such as Mr. James Taylor, for investigation of the legal part, same should be allowed. Alderman Duncan reported that on this date he had contacted the Lowe family but they} were not willing to sell at farm-prices and stated that the City could start condemnation proceedings if desired. Dis- cussion as to the number of acres needed for the oxidation pond. Mr. Ritchie, from the Crawford, Murphy & Tilly Engineering Firm, stated the need for about forty acres so that the City would not be isolated in that area -- a portion of the land could be leased for f and then farming. He stated there are twelve acres of pasture land that would be suitable -- an oxidation pond covers approximately six acres but this would allow for expansion in later years. -The mater and Sewer Committee to make a report to the next Council meeting. Alderman Long excused at 8:40 P. M. Dedication of Street by the Edson VanSickle family read. Alderman Wright stated that referrring this to the Planning and Zoning- Commission at the last Council meeting was actually a duplication of the original dedication. Dis- cussion regarding plotting the -land (the ten acres for the Presbyterian- Church C= is unplotted�} -- but when the entire tract comes into the City, it must be -' platted. Resolution concerning same. Alderman Hurst asked what the urgency of accepting t' ng a street that is not in the City limits which will probably have a request for street improvembnts in the near future, when streets in his ward are in a desperate need of repair. Alderman Jennings moves and Alder- men Duncan seconds a motion to accept the dedication and adopt the Resolution. Further discussion. Roll call vote on the motion. AYE: Aldermen Sebree, Howard, Wright, Duncan, Skinner, Abbott, Gibbons, Horton, Jennings, Bender, and George. NAY: Alderman Hurst and Whitehead. (11 AYES and 2 NAYS). Motion carried. This being Resolution No. 375. Reverend Anderson, Minister of the Presbyterian Church, thanked the Council for the passage of the Resolu- tion and stated that the Church would not be likely to ask for a paving im- provement during 1964 and said this evening was a historic moment. Alderman Wright requested that the City lerk be com- munications from the City Council to the Planning to refer all formal letter -- nn�g and Zoning Commission -_by so that there would be a clear channel to that committee. It was also suggested that the City Attorney, the Mayor, or his Secretary be deWignated for this work. Mayor Howard, pro tem., stated that Mayor Cook will notify the Council how this will be handled. Second reading of an Ordinance pertaining to vacation of streets. Alderman Wright moves and Alderman George seconds a motion to strike out that portion of Section one "all of Jefferson Court from Walnut Street to Mulberry Place". Voice vote. AYE: Unanimous. Alderman Hurst asked the Council to remember that there would be only one street leading to that area and there would be need to keep same dry, oiled and chipped. Alderman Gibbons moves and Alder- man George seconds a motion to place the Ordinance on its passage. Roll call vote. AYE: Aldermen George, Bender, Jennings, Gibbons, Abbott, Skinner, Hurst, Duncan, Wright, Howard, and Sebree. NAY: Alderman Horton and Whitehead. (11 AYES and 2 NAYS). Motion carried. This being Ordinance No, 102. Bond in the amount of $1,000.00,(School Patrol Guard) and the bond approved by Finance Committee, for John H. Anderson, School Patrol Guard read. Alderman Wright moves and Alderman Jennings seconds a motion that same be accepted and placed on file. Voice vote. AYE: Unanimous. Appointment of John H. Anderson, School Patrol Guard and the temporary appoint- ment of Miss Roxey Ann McMillen as Radio Operator on second shift (while Mr. Grose is ill). Alderman Wright moves and Alderman George seconds a motion that the appointments be accepted. Voice vote. AYE: Unanimous. Alderman George recommended that Alderman Skinner, Chairman of the Street and Alley Committee, call Mr. Birkey of the C.I.P.S.Co. to see that holes in pave- ment are recovered after the company had completed their work. First reading of an Ordinance pertaining by bi-monthly payrolls. Alderman Jennings stated that anyone voting against a weekly payroll is doing more harm than voting against a raise, and moves that'the Council not accept this Ordi- nance. Alderman Horton seconds this motion. Alderman Howard, pro tem., explains 228 Feb. 4, 1964, Cont. (3) the reason for the ordinance. Alderman Horton withdrew his second of the motion and Alderman Jennings withdrew his motion. Alderman Jennings then moves to table the ordinance, seconded by Alderman Horton. Alderman Gibbons recommended that the ordinance bezeferred to the Finance Committee. Roll call vote to Table the Ordinance. AYE: Aldermen Hurst, Whitehead, Skinner, Abbott, Horton., Jennings -Bender, and George. NAY: Aldermen Sebree., Howard., Wright, Duncan, and Gibbons. (8 AYES and 5 NAYS). Motion to table the ordinance carried. Alderman Wright moves and Alderman Jennings seconds a motion to instruct the City Clerk to open sealed bids on. pushing dump. Voice vote. AYE: Unanimous. Alder- man George reported that a Mr._-Hall had a D-4-Caterpillar Tractor that he would sell-to the City Dr $1500.00. Bids read. Alderman Hurst moves and Alderman Dun- can, deconds a motion to accept the lowest bid with the stipulation that the re- quired amount of insurance be provided. Alderman Wright asked o hadehthe " ltoer- nate Bid" of Livio Poggioli read again, but,was refused — same Alderman Wright for reading. Mayor Howard, pro temp stated that such mockery would not be permitted, in the City Council Chamber and ignored this bid. Rolbbons call vote on the motion. AYE: Aldermen George, Bender, Jennings, , ,, Abbott, Skinner, Whitehead, Hurst, Duncan, Howard., and Sebree. PASSING: Alderman Wright. (12 AYES and 1 PASS). Motion carried.
