AN ORDINANCE VACATING PART OF A NORTH-SOUTH ALLEY LYING BETWEEN EAST
LINN STREET AND EAST HOLLY STREET, ALL LYING AND BEING WITHIN THE
CORPORATE LIMITS OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS:
WHEREAS, Chapter 24, See. 11-91-1, et sequi, Illinois Revised
Statutes, provides in part that, whenever the corporate authorities
of any municipality in the state of Illinois determine that the
public interest will be subserved by vacating any street or alley, or
part thereof, within their jurisdiction in any incorporated area,
they may vacate that street or alley, or part thereof, by ordinance;
and
WHEREAS, the corporate authorities of the City of Canton, Fulton
County, Illinois, have determined that the public interest will be
subserved by vacating a part of a North-South alley lying between
East Linn Street and East Holly Street, all as hereinafter more fully
described and as set forth on the plat, Exhibit A, hereto; and
WHEREAS, the below-described part of the alley and the
properties thereto contiguous are wholly within the jurisdiction and
corporate limits of the City of Canton, Illinois; and
WHEREAS, the corporate authorities of the City of Canton,
Illinois, have determined that the relief to the public from further
burden and responsibility of maintaining the below-described part of
the North-South alley constitutes a public use or public interest
authorizing the vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, Fulton County, Illinois, as follows:
1. That the Canton City Council hereby finds the foregoing
recitals to be fact.
2. That the following portion of a North-South alley lying
between East Linn Street and East Holly Street in the
City of Canton, Illinois, be and the same hereby is
vacated:
Beginning at the Northeast corner of Lot 2, in Block
3, of A. J. Whitnah's Addition to the City of Canton,
Fulton County, Illinois; thence Southerly 150 feet
along the East lot line of said Lot 2, to the Southeast
of Lot 6, thence Easterly 14 feet, more or less, to the
Southwest corner of Lot 5, thence Northerly along the
West line of Lot 5, 150 feet to the Northwest corner of
Lot 1, thence Westerly 14 feet, more or less, to the
Northeast corner of Lot 2, said corner being the Point
of Beginning.

3. The aforesaid vacation is specifically made subject to an
easement(s) in perpetuity under, over, and across the afore-
said vacated alley for purposes of maintaining, placing,
constructing, or reconstructing public utilities to include,
but not limited to, the following: Gas and electric
transmission lines; water and sewer lines; cable television
lines; or any present or future utilities of whatsoever
nature or description. The easement(s) hereby reserved
shall be the same dimensions as those portions of the
aforesaid alley vacated and shall run in favor of the City
of Canton, all existing easement holders, and all holders
of future easements and each of their respective successors
and assigns.
5. The City Clerk of the City of Canton, Illinois, is hereby
directed to cause a certified copy of this ordinance to be
filed with the office of the Fulton County Recorder of Deeds
immediately upon the passage and approval of this ordinance.
6. This ordinance shall be in full force and effect immediately
upon its passage by the affirmative vote of at least three-
fourths of the aldermen holding office in the City of Canton,
Fulton County, Illinois, at a regular meeting this 2lstday
of APr11992 upon a roll call vote as follows:
AYES: Aldern~tz Coay, Sarff, Steck, Bohler, Meade,
Barnett, May.
NAYS: None.
ABSENT: Alderrn~n Molleck.
