May 1, 1962
Canton City Council held a regular meeting on May 1, 1962 in the Council Chamber.
Mayor Cook called the meeting to order at 7:08 P. M.
Roll call. Present: Aldermen Howard, Sebree, Staley, Wright, Herbener, Hurst,
Long, Skinner, Abbott, Berry, Horton, George, and Bender. Absent: Alderman
Gibbons.
Pledge of Allegiance was followed by Prayer by Alderman Long.
Alderman Staley moves and Alderman Horton seconds that the minutes of the
previous meeting be accepted as presented and placed on file. Roll call vote.
AYE; Unanimous.
Petition for street improvement on Mulberry Place from °ark Court to Ave. D.
Alderman Hurst, seconded by Alderman Herbener moves to refer this Petition to
the Board of Local Improvements. Roll call vote. AYE: Unanimous.
Bills for the month of April were read by the clerk. Alderman Herbener stated
that the Sherwin-Williams bill should be removed from the Street Department and
added to the Parking Meter Department. Alderman Bender requested that the
Western Waterproofing Co. bill be held until work completed to satisfaction.
Discussion of bill for Police department for destroying dogs. Mayor Cook recom-
mended that the Ordinance committee draw up an ordinance pertaining to catching
dogs. Police department not to catch any more dogs unless on complaint- of an
emergency. Alderman Wright recommended full time dog catcher. Roll call on
payment of bills. AYE: Unanimous.
111onthly reports of all officere were read. Alderman Bender, seconded by Alder-
- man Skinner, moves to accept same and place on file. Roll call vote. AYE:
Unanimous.
Annual reports of all officers were read. Alderman Herbener, seconded by Alder-
man Skinner moves that these reports be accepted and placed on file. Voice vote
AYE: Unanimous.
Mayor Cook called for reports of Standing Committees.

Alderman Herbener reported that the Appropriation Ordinance would be readynthe
first reading at the next meeting. Alderman Herbener then moves that the Council
authorize the Finance Committee to employ George Hocker' to audit the city books.
Motion was seconded by Alderman Staley. Roll call vote. AYE: Unanimous.
Richard Small gave a thorough report on the progress of work at the Canton Beach,
stating that $547.17 had been spent, leaving a balance of $852.81 in the beach
fund. He asked permission to use the upper end of the lake for an aqua show to
be held on July 11 the operning date (July 4 as a rain date) . Discussion. Alder-
man Staley moves that in view of all the work the JayCee's had done for the City,
permission should be granted for use of the lake on July 1 or 4. Motion seconded
by Alderman Skinner. Roll call vote. AYE: Unanimous.
Mr. Stewart Reed, Sec. of the Canton Chamber of Commerce, inquired about the
extension of water to the Mid-Century Telephone Co. Alderman Herbener moves
and Alderman Staley seconds that the City extend water to that area. Roll call
vote. XYE: Unanimous. City Engineer Gibbons instructed to check on the needs.
Mayor Cook called for Communications:
Request from the V. F. W. Auxilliary to hold an ice cream social Aug. 17, in
Jones Park. Alderman Hurst, seconded by Alderman Long moves to grant the re-
quest. Voice vote. AYE: Unanimous.
Request from the Cootiette Club to hold an ice cream social on Aug. 31 in Jones
Park. Alderman George, seconded by Alderman Bender, moves to grant permission.
Voice vote. AYE: Unanimous.
Request from the Junior Sportsman League to hold a tag day June 2. Alderman
George, seconded by Alderman Horton, moves to grant permission. Voice vote.
AYE: Unanimous.
Resignation of Donald P. Schmidt from the Zoning Board of A6 eals read. Alder-
man Herbener, seconded by Alderman Bender, moves to accept the resignation.
Voice vote. AYE: Unanimous.
Resignation of Lester Hill from the Planning Commission read. Alderman Bender,

Request for replacement of Assistant Chief Robert Essex (expired Apr. 29, 1962)
read. Alderman Long, seconded by Alderman Skinner, moves to refer same to the
Police and Fire Commission. Voice vote. AYE: Unanimous.
Request for firemen to work during vacations read. Alderman Bender moves and
Alderman Long seconds the Council authorize that vacation relief be referred to
the Police and Fire Commission. Voice vote. AYE: Unanimous.
Letter from the law firm Ramsey & VanSickle showing a certified copy of an
Order entered by the County Court of Fulton County, Illinois on Apr. 23, 1962
concerning a compliance with the State Statutes in regards to the annexation
of territory to a city -- Ludlum-Orwig property; Alderman Staley moves and
Alderman Wright seconds that these properties be annexed to the City of Canton.
Roll call vote. AYE: Unanimous.
Alderman Wright moves and Alderman Staley seconds that the Petition for street
Chi improvement on the end of VanDyke Drive be referred to the Board of Local Imp-.;
C11 rovements for consideration. Roll call vote. AYE: Unanimous.

Alderman Herbener reported that an investigation of the record of the Keeling
Court property did not show any dedications or easements for storm sewer on
that property. He then moves that the Plumbing Inspector and City Engineer
make an examination to find where the sewer is plugged and report back to the
next meeting. Alderman Howard seconded this motion. Roll call vote. AYE:
Unanimous.
Alderman Hurst reported that a water line on Quality Hill was only twelve or
fifteen inches deep (on roadway) -- same froze last winter -- same should
be lowered or the street raised. Street Superintendent Eldon Payers and
Plumbing Inspector Harold White to make investigation.
Alderman Horton reporting on car rental -- Lock's Auto Co. asking $125.00
plus oil changes -- he then moves that the Council take bids from other
dealers to'see if a better price could be obtained. Alderman Bender seconded
the motion. Alderman Staley recommended that the Police and legal advertise
for the specifications for size and type car they decide. Alderman Bender
withdrew his second and Alderman Horton withdrew his motion. Alderman Horton
then moves that the Police and Legal advertise to take bids from different
dealers for different units of cars. Alderman Herbener seconded this motion.
Roll call vote. AYE: Unanimous.
Resolution acknowledging May 1 as Law Day in the United States read. Alderman
Herbener moves that the Council adopt this Resolution by a rising vote. Motion
was seconded by Alderman Bender. Rising vote. AYE: Unanimous. This being
Resolution No. 312.
Alderman Hurst reported that the sanitary and storm sewers near Wallace Park
overflow and cause odors and recommended that action be taken to alleviate
this odor. DeFoamer to be placed there by the superintendent of the Sewerage
'Disposal Plant.
Alderman George inquired about the paving of Taylor Court and was informed
that action was being taken regarding same.
Resolution requesting access to Interstate Highway 74 read. Alderman Herbe-
ner explained the purpose of the Resolution and said that the Traffic Com-
mittee has been asked to meet with the Highway Department. Alderman Herbener,
seconded by Alderman Bender, moves to adopt the Resolution. Voice vote. AYE:
Unanimous. This being Resolution No. 313.
An Amendment to Ordinance No. 57 read. (Change of hours of operation for
self-service laundries and cleaners) . Alderman Howard,moves to suspend the
rules, seconded by Alderman Bender. Roll call vote. AYE: Unanimous. Alder-
man Howard moves and Alderman Bender seconds to place same on its passage.
Roll call vote. AYE: Unanimous. This being Ordinance No. 58.

Alderman Hurst moves to advertise for bids for oil and chips for city dirt
streets, seconded by Alderman George. Alderman Staley stated that the
Council should consider having the property owners pay a part of this expense.
Alderman Herbener respectfully asks the council to vote against the motion --
that they should consider the cityts finances -- until the next meeting
when they can present a definite amount. Discussion. Alderman Skinner recom-
mended that each Alderman investigate his own ward and report the number of
dirt streets -- then meet with the Finance Committee and advertise for bids --
then use the percentage basis- in all wards. Roll call vote on the motion. AYE:
Aldermen Wright, Hurst, Berry,"Horton, and George. NAY: Aldermen Howard,
Sebree, Staley, Herbener, Long, Skinner, Abbott, and Bender. (5 AYES and 8
NAYS). Motion defeated.
Alderman Wright moves that the Mayor draft a letter to be sent to the Board
of Supervisors recommending that the road between Canton and Glasford be re-
paired and maintained. Motion was seconded by Alderman George. Voice vote.
AYE: Unanimous.
Discussion on the ten-day sick leave. Alderman Howard suggested that same be
left to the discretion of the department heads with the Mayor's approval.
Subject to be considered by the Ordinance Committee.
Alderman Hurst suggested that the Building and Grounds Committee be authorized
to purchase an aluminum type of shelter to be placed in Jones Park. Alder-
man Skinner moves that the Building and Grounds Committee investigate the
cost of an aluminum shelter for Jones Park and report to the Council. ;Motion
seconded by Alderman Hurst. Roll call vote: AYE: Aldermen Bender, George,
Horton, Berry, Abbott, Skinner, Long, Hurst, Herbener, Wright, and Howard.
NAY: Aldermen Staley and Sebree. (11 AYES and 2 NAYS) . Motion carried.
Mayor Cook announced the next order of business would be his appointments.
Alderman Berry moves that each appointment be voted upon separately and a
reason given for appointing a new person to fill an office. Alderman Hurst
asked him to amend his motion to vote only on new appointments. Alderman
Berra withdrew his motion. Alderman Staley moves and Alderman George seconds
to vote individually on each new appointment replacing an old appointee.
Roll call vote. AYE: Unanimous.

Alderman Berry moves to keep Oren Brown as Cemetery Superintendent.
Alderman Herbener stated Alderman Berry was out of order. Alderman
Staley reported that he had received many compliments on Mr. Brown
and could see no reason to replace him since he was doing very good
work. Alderman Herbener moves to accept the appointment of city per-
sonnel as presented with the exception of the two new appointees --
Cemetery Superintendent and Police File Clerk. Motion seconded by
Alderman Howard. Roll call vote. AYE: Unanimous. Alderman Bender,
seconded by Alderman Abbott, moves to accept Matt Bohler as Cemetery
Superintendent. Alderman Wright stated he would not vote in favor of
Bohler until he had Oren Brown's side of the story. Alderman Staley
requested the floor and was refused. Alderman Wright moves to appeal
to the Council that Alderman Staley be allowed the floor, seconded by
Alderman Berry. Roll call vote. AYE: Unanimous. Alderman Staley
thanked the Council and gave his opinion of cooperation of the Alder-
men and the Mayor and that they should start working together. Alder-
man Herbener stated that he regretfully thought this discussion had
reached the place of a personal matter, and said that personal feel-
ings has no place in this matter. He stated he thought Mayor Cook
was doing as he thought best and that he would approve same. Roll
call vote. AYE: Aldermen Bender, Abbott, Skinner, Herbener, and
Howard. NAY: Aldermen George, Horton, Berry, Long, Hurst, Wright,
Staley, and Sebree. (5 AYES and 8 NAYS) . Motion lost. Mayor Cook
stated that he would appoint Matt Bohler as Cemetery Superintendent
for thirty days.
Alderman Herbener moves and Alderman Howard seconds the appointment
of Mike Klobuchar on the Fire and Police Commission (replacing
Clifford Fouts whose term had expired). Roll call vote. AYE: Unanimous.
Alderman Berry, seconded by Alderman Sebree, moves to accept the
appointment of Lois Sprague as File Clerk in the Police Department.
Alderman Wright and also Alderman Staley spoke in behalf of Veda Belle
Benac -- stating that her work had been satisfactory and that she

should not be replaced. Roll call vote: AYE: Aldermen Bender, Abbott,
Skinner, Herbener, Sebree, and Howard. NAY:
Aldermen George, Horton, Berry, Long, Hurst, Wright, and Staley. (6 AYES and
7 NAYS). Motion lost. Mayor Cook appointed Iois Sprague as File Clerk for
thirty days.

Alderman Long, seconded by Alderman Bender, moves that the appointements be
accepted. Alderman Wright moves to amend the motion'to accept all appointements
except the Mayor pro tem, seconded by Alderman Hurst. ' Roll call vote. AYE:
Aldermen Staley, Wright, Hurst, Skinner, Horton, and George. NAY: Aldermen
Howard, Sebree, Herbener, Long, Abbott, Berry, and Bender. (6 AYES and 7 NAYS) .
Motion lost. Alderman Herbener asked that as a point of personal privilege to
vote on them separately. Alderman Staley, seconded by Alderman Wright moves to
elect Alderman Herbener as Mayor pre tern. Roll call vote. AYE: Aldermen Howard,
Sebree, Staley, Wright, Hurst, Long, Skinner, Abbott, Berry, Horton, George, and
Bender. PASSING: Alderman Herbener. NAY: None. Motion carried.
Alderman Bender, seconded by Alderman Wright moves to adjourn. Voice vote.
AYE: Unanimous. Canton City Council adjourned at 10:48 P. M.
