April 17, 1962
Canton City Council held a regular meeting on April 17, 1.962 in the City
Council Chamber. Mayor Cook called the meeting 'to order at 7:06 P. M. Roll
Call. Presents Aldermen Howard, Sebree, Staley, Wright, Herbener, Hurst, Long,
Gibbons, Berry, Horton, George, and Bender. Absent: Aldermen Skinner and
Abbott.
Pledge of Allegiance was followed by Prayer by Alderman Long.
Alderman Staley moves and Alderman Long seconds that the minutes of the previous
meeting be accepted as presented and placed on file. Voice vote. AYE: Unanimous.
A Petition requesting street improvement on the alley between Fifth, Sixth Avenue,
Maple Street and Anderson Place. Alderman Horton moves and Alderman Berry seconds
that this Petition be referred to the Board of Local Improvements. Roll call vote.
AYE: Unanimous.
Mayor Cook called for reports of Standing Committees:
Alderman Herbener set a date, April 25, for the Council as a whole to meet with
the Finance Committee to draw up appropriations for the coming year.
Meeting of the Municipal League of the Central Region to be held in Rushville
on April 18. All officials invited to attend.
Mayor Cook called for Special Committee Reports;
Mayor Cook called for Communications:
Letter from Crawford, Murphy & Tilly to the Phillips Petroleum Co. requesting
their attention to the proposed abandonment of a portion of the track used by
their plant in order to complete plans for street improvement. Alderman Herbe-
ner moves that same be referred to the Street and Alley Committee and report
back to the next meeting. Motion seconded by Alderman George. Voice vote.
AYE: Unanimous.
Request from the Canton Chamber of Commerce to use the north portion of Jones
Park May 3, 4, and 5 for "Kiddy Rides" in contunction with the "Divident Dayst'.
Alderman George, seconded by Alderman Bender, moves to grant this request. Roll
call vote. AYE: Unanimous.
Mayor Cook called for New Business:
Resolution for the transfer of funds: $8,500.00 from the Public Comfort Station
to the General Fund; '$5,000.00 from the Parking Meter Fund to the Road and
Bridge Fund; $10,000.00 from the Sales Tax Fund to the General Fund. Alderman
Bender, seconded by Alderman Gibbons moves to adopt this Resolution. Roll call
vote. AYE: Unanimous. This being Resolution No. 311.
Alderman Hurst introduced Mr. Byron Lssex who addressed the Council on his ideas
of the proposed widening of Fifth Avenue. Mr, Paul Jaeger asked permission to
sneak to the Council -- stating reasons why the people were reluctant to agree-
ing to the street improvement -- because they had not been fully informed.
Alderman Herbener asked that there be no more discussion on this project until
the committee has made a report. Discussion. Mayor Cook asked that he be given
time to meet with the committee. Alderman Hurst moves that the Council discuss
the widening of Fifth Avenue at this meeting. Mayor Cook informed Alderman Hurst
that he was the only one who could promote this project and declared Alderman
Hurst out of order.
Mr. Birkey, representing the C. I. P. S. Co. stated that the employees ideas as
expressed by Mr. Jaeger were not necessarily the viewpoint of his company and
should not be considered as such.
First reading of an Ordinance pertaining to Lake Canton. Alderman Bender,
seconded by Alderman George, moves to suspend the rules. Alderman Berry inquired
why the License Committee had not been contacted when the fees were set for the
Ordinance. Alderman Gibbons recommended that the Ordinance be tried for one year
and then reconsider if same needs improvements. Roll call vote. AYE: Unanimous.
Alderman Bender, seconded by Alderman George, moves to place the Ordinance on its
Passage. Alderman Herbener moves to amend the ordinance -- Sec. 2-C (2)
indicating "more" than Two Hundred Dollars (instead of "Less"). Motion seconded
by Alderman Long. Roll call vote on the amendment: AYE: Unanimous. Roll call
vote on the passage of the Ordinance. AYE: Unanimous. This being Ordinance

Alderman Staley reported a storm sewer was plugged in his ward. Discussion.
Alderman Herbener moves that the City Attorney check to see if an easement
is registered in the Fulton County Records and if so, the Finance Committee
be allowed to spend up to $25.00 to check to see who has plugged the tile and
have same taken care of. Alderman Staley seconds this motion. Roll call vote.
AYE; Unanimous.
First reading of an Ordinance pertaining to self-service laundries. Alderman
Howard, seconded by Alderman Bender, moves to suspend the rules. Alderman
Berry objected to the license fee. Roll call vote. AYE: Aldermen Howard,
Sebree, Staley, Wright, Herbener, Hurst, Long, Gibbons, Horton, George, and
Bender. NAY: Alderman Berry. (11 AYES and l NAY). Motion carried. Alder-
man Hurst moves to adjourn, seconded by Alderman Wright. Mayor Cook called
for Roll Call Vote. AYE: Aldermen Horton, Berry, Hurst and Wright. NAY:
Aldermen Bender, George, Gibbons, Long, Herbener, Staley, Sebree, and Howard.
(4 AYES and 8 NAYS) . lotion defeated. Alderman Howard, seconded by Alder-
man Bender moves to place the Ordinance on its passage. Alderman Staley,
seconded by Alderman Gibbons, moves to amend the ordinance to include self-
service cleaners. Roll call vote on the amendment: AYE: Aldermen Howard,
C Sebree, Staley, Wright, Herbener, Hurst, Long, Gibbons, Horton, George, and
Bender. NAY: Alderman Berry. (11 AYES and 1 NAY) . Motion carried. Roll
call vote on the motion as amended. AYE: Aldermen Bender, George, Horton,
Gibbons, Long, Hurst, Herbener, Wright, Staley, Sebree, and Howard. NAY:
Alderman Berry (11 AYES and 1 NAY). Motion carried. This being Ordinance
No. 57.
Alderman Hurst inquired about the Zoning Ordnance case against the Star
Delivery. City Attorney Senift reported a meeting with the Star Delivery
personnel, Street and Alley Committee and the Aldermen from the Seventh Ward.
Star Delivery planned to reduce their business and it seemed a good chance
of getting the affair settled to the satisfaction of all those attending
this meeting. He said he heard that some time ago an agreement was made
with the Star Delivery firm to keep the mud and dirt off the city streets
and they could continue to stay in business. Mr. Senift stated that this
agreement might have some bearing on a lawsuit.
Alderman Herbener moves to adjourn, seconded by Alderman Bender. Voice vote.
AYES Unanimous. Canton City Council adjourned at 9:25 P. M.
