A Special Meeting of the City Council was held on Friday, ivtarch 23b 1962
at 7x05 P. M. in the City Council Chamber.
Pledge of Allegiance was followed by Prayer by Alderman Howard.
Roll call. Present: Aldermen Howard, Sebree, Wright, Herbener, Hurst,
Long, Skinner, Abbott, Berry, George, and Bender. Absent: Aldermen Staley,
Gibbons, and Horton.
Alderman Herbener moves (after the Clerk read the purpose and object of the
meeting)that the Council consider the ordinance pertaining to the closing
of East Maple Stteet, seconded by Alderman Bender. Alderman Hurst called
for point of order, stating that Alderman Herbener was out of order and that
the Council should follow the agenda;. Roll call vote on Alderman Herbener's
motion. AYES Aldermen Bener, George, Berry, Abbott, Skinner, Long, Herbener,
Sebtee, and Howard. NAY: Aldermen Hurst and Wright. (9 AYES and 2 NAYS) .
Motion carried. 'Discussion.
Alderman Wright requested a five-minute recess. Granted at 7:10 P. M.
Mayor Cook called the Council to order at 7:15 P. M. Alderman Hurst moves
that the Council reconsider the ordinance that was defeated at the previous
Council meeting, seconded by Alderman Berry. Discussion. City Attorney
read a portion of the Cityfs ordinance book and the new State Statues per-
taining to the passage of said ordinance and said. that twelve members of the
Council must be present before the ordinance could be reconsidered. Mr.
Froehling, Attorney for the International Harvester Co. discussed the bearing
that, factory had on the City and suggested that -the ordinance be reconsidered
at the next meeting. Alderman Hurst requested that Alderman Staley be brought
to the Council Chamber, but Alderman Howard said it would be better not to
send for him. City Attorney Senift teported that the ordinance would not be
valid, therefore) Alderman Hurst withdrew his motion and Alderman Berry with-
drew his second of same.
Roberts Rules of Order up for discussion.
Aldermn ,Howard was granted permission to andwer the telephone and was excused
from the Council meeting at 7:40 P. M.
Alderman Hurst moves that the members of the Council donate their $10.00 re-
ceived for the evening to the City but was declared out of order.
'Discussion pertaining to Roberts Rules of Order. Alderman Herbener stated
that the rules for the City are listed in the Ordinance book and automatically
overrules Roberts Rules of Order. Referring to Resolution No. 304, Mr. Senift
stated that it is a part of that rule and can only be changed by a two-thirds
vote on a resolution or ordinance. Discussion on this Resolution. While
Alderman Herbener had the floor, Alderman Hurst moves to adjourn. Mayor Cook
declared that Alderman Hurst was out of order. At the close of the discussion,
Alderman Bender moves to adjourn and Alderman Berry seconds same. Voice vote.
AYE: Unanimous. Canton City Council adjourned at 7:55 P. M.
