Home My WebLink About08-15-1961 Council Meeting Minutes1 51 Aug. 15, 1961 Canton City Council held their regular meeting Aug. 15, 1961, 7:10 P. M. in the City Council Chamber. Mayor Cook called for Roll. call. Present: Aldermen Sebree, Staley, Wright, Hurst, Long, Skinner, Gibbons, Abbott, Berry, Horton, George, and Bender. Absent: Aldermen Howard and Herbener. Pledge of Allegiance was followed by Ptayer by Alderman Long. Alderman Staley moves that the minutes of the previous meeting be accepted and placed on file, seconded by Alderman Gibbons. Roll call vote. AYES Aldermen Bender, George, Horton, Berry, Abbott, Gibbons, Skinner, Long, Hurst, Wright, Staley, and Sebree. 'SAY: None. Motion carried. Mayor Cook called for reports of Standing Committees. Mayor Cook called for reports of Special Committees. Alderman Long reported that a siren could be purchased for Civil Defense from �l Winston-Salem, N. Carolina for $450.00 (with matching funds from Civil Defense) . Discussion. Bond, , properly signed by the Finance Committee for William R. Hagaman, Police X patrolman was read. Alderman Long, seconded by Alderman Bender, moves to accept the bond and place it on file. Roll call vote. AYE: Aldermen Sebree, Staley, Wright, Hurst, Long, Skinner, Gibbons, Abbott, Berry, Horton, George, and Bender. NAY: None. Motion carried. Letter from the Department of Revenue acknowledging receipt of the City's Tax Ordinance No. 39 stating the City's first Service Occupation Tax would be re- ceived in November, 1961. Letter from the Canton Chamber of Commerce regarding the "off-street" parking lot and acknowledgment of the fine cooperation given by the Council, Chief of Police Lindzey, City Attorney Senift and Street Superintendent Myers. Mr. Stewart Reed, Executive Secretary, gave a verbal thanks for all the cooperation received. Mayor Cook called for Unfinished Business. Alderman George reported that the case of the Star Delivery and the City of Canton seemed 'to be deadlocked (Star Delivery refusing the plot of ground offered by the strip mine as being too far from the City), and recommended that definite action be taken. City Attorney Senift explained the procedures concerning a law suit. Discussion. Alderman Hurst moves that the Council direct the City Attorney to start legal proceedings against the Star Delivery Service for being in violation of the Zoning Ordinance. Motion seconded by Alderman Staley. Roll call vote. AYE: Aldermen George, Gibbons, Skinner, Hurst, Wright, Staley, and Sebree. NAY: Aldermen Bender, Horton, Berry, Abbott, and Long. (7 AYES and 5 NAYS) . Motion declared carried. Letter of resignation from Jack Grzanich read. Alderman Berry, seconded by Alderman Gibbons moves to accent the resignation. Oral vote. AYE: Unanimous. Letter from the Fire and Police Commission informing the Council of the appoint- ment of David W. McIntire as temporary Police Patrolman filling the vacancy by the resignation of Ronald L. Frankovich. William Hagaman has been appointed a permanent position of Police Patrolman. First reading regarding Sneed of Motor Ve .i_cle or Motorcycles on the streets around Wallace Park. Alderman Hurst moves to suspehd the rules, seconded by Alderman Wright. Roll call vote. AYE: Aldermen Staley, Wright, Hurst, Long, Skinner, Gibbons, Abbott, Berry, Horton, George, and Bender. NAY: Alderman Sebree. (11 AYES and 1 NAY) . Motion carried. Alderman Berry, seconded by Alderman Hurst moves to place the Ordinance on its Passage. Roll call vote. AYE: Aldermen Bender, George, Horton, Berry, Abbott, Gibbons, Skinner, Long, Hurst, Wright, and Staley. NAY: Alderman Sebree. (11 AYES and 1 NAY) . Motion carried. This being Ordinance No. 41. i i I 52 Aug. 15, 1961, Cont. First reading of an Ordinance pertaining to Parking Meters on the Square, amendment of Ordinance-No. 26. Laid over. Alderman Hurst inquired if property owner was planning to repair the burned-out building previously mentioned in the Council. After discussion, Alderman Hurst moves that the Police and Legal Committee investigate and employ the proper person (one agreeable to the Council and the property owner) to examine the building and report his findings to the Council. Alderman Wright seconded this motion. :toll call vote. AYE: Aldermen Sebree, Staley, Wright, Hurst, Long, Skinner, Gibbons, Abbott, '3erry, Horton, George and Bender. NAY: None. Motion carried. Alderman Berry reported that Dwayne Bishop wished to extend a water line to the Lincolnshire Addition -- that he had five street crossings to make, - therefore, thought the City Council would furnish the pipe for this line. Discussion. It was mentioned that the City had an agreement with Anthony Potesanos. Alderman Staley moves that the Water and Sewer Committee meet with the City Attorney and City Engineer and look over the agreement with Anthony Potesanos to see if the City- does owe hirh money. Motion seconded by Alderman George. Oral vote. AYE: Unanimous. Alderman Staley moves that the Council subpoena the person writing detrimental things about the City and find out if he was telling the truth, seconded by Alder- men Abbott. Discussion. Alderman Abbott withdrew his second and Alderman Staley withdrew his motion. Alderman Hurst then moves to invite the person to the Council meeting to give any information he may have that will lead to a conviction. Motion seconded by Alderman Bender. Oral vote. AYE: Unanimous. Alderman Staley requested a five-minute recess for discussion on the Lincolnshire addition water main. Permission granted by Mayor Cook at 8:45 P. M. Mayor Cook called the Council to order at 9:05 P. M. Alderman Sender reported the result of the Water and Sewer Committee -- that the City did not have the proper funds to pay for the water pipe as requested by the Contractor, Dwayne Bishop and that such expense would be entirely up to him. Discussion. Alderman Bender moves that the City Engineer, Attorney Claudon and other persons who were informed to get the full details on what can be done regarding this matter. Alderman Berry inquired what decision had been made regarding Lawrence Horton, Jr. bid for the concession at Lake Canton. Alderman Bender reported that he had been unable to take care of same and asked for an extension of,time -- until the next Council meeting. Alderman Gibbons reported that he favored discontinuing high-power motor boats on Lake Canton -- since they have not worked out properly, and recommended a meeting of the Water and Zewer, Committee with Chief Operator, Orval Kuhn. Alderman Berry moves to adjourn, bit withdrew his motion. Mayor Cook announced that he was entering an Iowa City Iiosnital and might be there for a couple of weeks -- all City business to be.rbferred to Alderman Staley, Mayor Pro tem. Alderman Hurst stated that he had sent a letter to the State requesting Canton as the site of the new State Hospital proposed for somewhere in this vicinity. Mr. Stewart Reed, Executive Secretary of the Canton Chamber of Commerce, dis- played a boo: 11 History of Canton" prepared to present to Governor Kerner and the Director of Public Welfare. He suggested that letters from interested people should accompany this book and suggested a letter from the City Council., be included. Alderman Staley recommended that City .Attorney Senift draft same. Further discussion resulthd in a proposed interview with the Govenor and Director of Public Welfare, with Alderman Staley, Mayor pro tern to represent the City. Alder- man Wright moves that Mr. Reed, the Pres. of the Chamber of Commerce, City Atty., and Alderman Staley's expenses be paid. Motion withdrawn. Alderman Hurst stated that the County had proposed a home for the aged and thought something could be worked out for both. Alderman Berry moves to adjourn, seconded by Alderman Hurst. Oral vote.
