ORDINANCE NO. 1404
AN ORDINANCE RE-ZONING CERTAIN PROPERTY IN THE CITY OF CANTON,
FULTON COUNTY, ILLINOIS.
WHEREAS, a Petition for Re-Zoning, signed by the owner of
record, contract seller and contract purchasers of all the real
estate hereinafter described, was filed before the Planning apd
Zoning Commission of the City of Canton, Illinois, requesting that
said real estate be re-zoned from AG-1 (Agricultural) to an I-1
(Light Industrial District) zoning classification; and
WHEREAS, the real estate which is the subject of this Petition
is legally described as follows and is generally located at Rural
Route #2, Route 9 West, in the City of Canton, Fulton County,
Illinois:
Part of the Southeast Quarter of Section 29 and part of
the Southwest Quarter of Section 28, all in Township 7
North, Range 4 East of the Fourth Principal Meridian,
Fulton County, Illinois, being more particularly
described as follows:
Beginning at a point on the East line of said Southeast
Quarter of Section 29, being North 0°48'14" East, 1135.30
feet from a stone at the Southeast corner of said
Southeast Quarter; thence South 88°00'50" West 185.26
feet; thence North 0°59'37" West, 1470.03 feet to a R-O-W
marker on the South line of Illinois State Route 9;
thence North 89°45'10" East, 378.14 feet along the said
South R-O-W line to a concrete marker; thence South
42°24'02" East, 25.54 feet to a specific point; thence
South 0°48'14" West, 1252.12 feet to the point of
beginning, containing 7.612 acres, more or less.
WHEREAS, CANTON STATE BANK is the owner of record and contract
seller and JACK G. ROMINE and ROSALIE A. ROMINE are the contract
purchasers of the real estate to be re-zoned and there are no other
owners of record; and

WHEREAS, the real estate to be re-zoned is within the
corporate limits of the City of Canton, Illinois; and
WHEREAS, there are no electors residing on the real estate
sought to be re-zoned; and
WHEREAS, all petitions, documents and other necessary legal
requirements are in full compliance with the statutes of the State
of Illinois and the ordinances of the City of Canton, Illinois, and
proper notice of the filing of the Petition for Re-Zoning was given
as provided by law; and
WHEREAS, a public hearing was held before the Planning and
Zoning Commission of the City of Canton, Illinois on October 11,
1993, pursuant to proper notice published in the Canton Daily
Ledger, a secular newspaper having a general circulation in the
City of Canton, County of Fulton and State of Illinois; and
WHEREAS, on October 11, 1993, the Planning and Zoning
Commission of the City of Canton, Illinois recommended to the City
Council of the City of Canton, Illinois that the real estate
described above be re-zoned from AG-1 (Agricultural) to an I-1
(Light Industrial District) zoning classification; and
WHEREAS, the highest and best use of the real estate described
above is for industrial purposes; and
WHEREAS, it is in the best interest of the City of Canton,
Illinois that said real estate be re-zoned from AG-1 (Agricultural)
to an I-1 (Light Industrial District) zoning classification.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Canton, Illinois, as follows:

1. That the City Council finds as facts the recitals
hereinabove set forth.
2. That the real estate described above be re-zoned from AG-1
(Agricultural) to an I-1 (Light Industrial District) zoning
classification.
3. That the Zoning Administrator of the City of Canton,
Illinois is hereby directed to make the appropriate changes to the
zoning maps of the City of Canton to reflect this re-zoning.
4. That this Ordinance shall be in full force and effect upon
its passage by the City Council of the City of Canton, Illinois,
and approval by the Mayor thereof.
PASSED by a majority vote of the City Council of the City of
Canton, Illinois, and APPROVED by the Mayor thereof this 19th day
of October , 1993, upon a roll call vote as follows:
Ayes: Aldermen Coay, Molleck, Phillips, Meade, Bohler, May, Chapman,
