ORDINANCE NO. ~ ~-n~
AN ORDINANCE APPROVING THE CONVEYANCE OF A STRIP
OF LAND IN CONJUNCTION WITH A PRIOR AGREEMENT FOR
SALE OF LAND FOR PRIVATE DEVELOPMENT
WHEREAS, the City of Canton has previously undertaken a program
for the redevelopment of the Central Business District of downtown Canton;
has previously adopted a Redevelopment Plan and Project (as amended)
pertaining to the Redevelopment of the Central Business District; and
pursuant to that plan on February 4,1986, approved an Ordinance relating to
a contract for sale of land for private development (Ordinance No.1100) with
Irwin Rushford; and
WHEREAS, the City of Canton, pursuant to this agreement,
conveyed in two separate conveyances, portions of land which comprised all
of Lots 56 and 57 in Jones' Second Addition to the City of Canton, Fulton
County, Illinois except for the following portion of Lot 57:
The South two and one-half (2 U2) feet of the West Half of Lot
57 in Nathan Jones' Second Addition to the City of Canton, Fulton
County, Illinois
WHEREAS, the City of Canton intended to convey all of the portions
of these parcels for private development and could not have intended to
retain a small strip of land as above-described; and
WHEREAS, the City of Canton has heretofore determined the
necessity and reasonableness of conveying the above-described land to
complete the full transfer of Lots 56 and 57;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS, as follows:
1. That the following described land be conveyed to the National
Bank of Canton, Trustee of the Irwin Rushford Trust:
The South two and one-half (2 U2) feet of the West Half of Lot
57 in Nathan Jones' Second Addition to the City of Canton, Fulton
County, Illinois
2. That the Mayor, City Attorney, City Clerk, City Treasurer and all
other City Officers are hereby authorized and instructed to take such other
and further measures as may be reasonably necessary to implement the terms
and conditions of said conveyance, including executing and delivering the
requisite deed and other papers necessary to conclude such transaction.
3. That this Ordinance shall be in full force and effect immediately
upon its passage by the City Council of the City of Canton, Fulton County,
Illinois, and approval by the Mayor thereof.
PASSED by the City Council of the City of Canton, Fulton County,
Illinois at the regular meeting this 21st day of september
1993, upon a roll call vote as follows:
