A regular meeting of the Canton City Council was held on December 7th,
1982 in Council Chambers.
PLEDGE OF ALLEGIANCE OPENED THE MEETING, FOLLOWED BY THE INVOCATION GIVEN
BY CITY CLERK NANCY WHITES.
Mayor Edwards asked for roll call at 6:30 P.M. Present: Aldermen Kovache-
vich, Hammond, Savill , Sarff, Grant, Carl , Larsen, Horr. Absent: None.
MINUTES OF NOVEMBER 16TH MEETING. Alderman Larsen asked that the word
"mask" be included under the finance committee report for the expenditure
of $2,358.11 . Correction to be made also for the rental of a Xerox copier
for the police dept. , should read "$200.00" not $2,000.00. Motion by Ald-
erman Savill , second by Alderman Sarff, the minutes as corrected be accepted
and placed on file. Voice vote, motion carried.

Informational : The wiring for the city attorney' s office cost $305.00.

Council Action
Motion by Alderman Sarff, second by Alderman Savill , the city approach I .H.C.
and give them net 30 under they're terms, and a thirty day cancellable notice.
Discussion. Alderman Sarff explained the net 30 as follows: normally the bills
are mailed on the first and received on the second, when they begin they're
terms most vendors are on a net 30 days from the day they receive their invoice.
Anything that falls due between the 27th of the month and the first of the
month is going to be paid on the 15th of the month. Mayor Edwards and the City
Engineer Cliff Sagaser will be writing a letter to I .H.C. informing them of this
action by the council . Roll call . AYES: Aldermen Horr, Larsen, Carl , Grant,
Sarff, Savill , Hammond, Kovachevich. NAYS: None. Motion carried.
COMMUNICATIONS FROM CLIFF SAGASER - CITY ENGINEER. The contractor on the hud
program has planned for several days to be completed and will be at the end of
this day. His sub-contractor is still doing some concrete work. Several of
the aldermen have gotten calls concerning the oondit1,_o,n .o�f .Oa,k Street, the
city took action on it immediately. The contractor is paying for a hundred ton
of rock, and we will be putting this rock on Oak Street with city workers at no
cost to the city, other then their time.
The city has had recent water problems, there is two things we have decided
to do. 1 . The ditch on 4th avenue will be re-graded, almost the entire ditch,
and it will be re-graded on the east side which will eliminate alot of surface
water. 2. The old county sewer that lies east of 20th avenue is collapsing
in several places. Were going to work with the county and see if they'll go
out there with their big machine and make an open ditch out of several feet of
crushed pipe. This will help the problem to some extent.
It appears that we have several people who are not in the city limits that are
hooked into the county sewer which is a storm sewer, sewage is being dumped into
it. Cliff is going to make an effort of getting these people disconnected.

The sewer has been cleaned and some tv work has been performed. About 75%
of the cleaning has been completed. The consulting engineer is planning on
recommending to us (and Cliff concurs) constructing a new line along parallel
to the old one, down to the treatment plant. Resleeving the old line, taking
the entire north end and draining it into the new line.
Cliff was told by the tv workers of some of the illegal hook-ups of sump pumps-
when the smoke testing of the sewer was done. Cliff said that he hasn 't had a
chance to do anything as yet, and some of the errors are the city's.
COMMUNICATIONS FORM MAYOR EDWARDS. The retail trades of the chamber of commerce
have contacted the mayor as eleven to thirteen street light poles do not have
hookups for christmas decorations. These hook ups have been installed by
C.I.P.S. , as the retail trades voted to have it done at a cost not to exceed
$1 ,300.00. They're wanting the city to make a committment on this. The chamber
is wanting the city to pay half of the expense or at less $600.00. Motion by
�. Alderman Kovachevich, second by Alderman Sarff, this be referred to the finance
committee. Voice vote, motion carried.
Motion by Alderman Horr, second by Alderman Sarff, that the appointment of
C9 Alderman Willam Larsen to the Planning & Zoning Commission be confirmed. Voice
Q vote, motion carried.
Q At the recommendation of Police Chief Robert Molleck the following be appointed
to the auxiliary police; Paul Davis, Larry Howarter, Ragina A. Wilkins. Motion
by Alderman Sarff, second by Alderman Kovachevich, that these appointments to
the auxiliary police be confirmed. Voice vote, motion carried.
Police Chief Robert Molleck was asked to come up with some plaques for the Fire
& Police Commission members who have retired. Bob designed the plaques himself.
Alderman Kovacehvich spoke about the high utility rate. Because of the economic
conditions people are having a hard time of it. In March of 1981 the commerce
commission granted C.I.P.S, a rate increase which amounted to 13 million for the
elctricity and 4 million for the gas. A month before the November election this
year the commerce commission stated that something would have to be done about
the high utility rates. Three weeks after the election the commerce commerce
approved 83% of C.I .P.S. request. That's raising the electric rate $23.00 per
month and $4.00 on the gas. Alderman Kovachevich felt that we need elected
people on the commerce commission as they then have to answer to us.
Motion by Alderman Kovachevich, second by Alderman Larsen, that because of the
high unemployment the city send a letter to the commerce commision expressing
our objection to this recent rate increase. Voice vote, motion carried.
Motion by Alderman Larsen, second by Alderman Sarff, that Alderman Grant and
Alderman Horr be excused from voting as they are employees of C.I .P.S. Voice
vote, motion carried.
OLD BUSINESS:
ORDINANCE - AMENDING TITLE 3, CHAPTER 8, SECTION 6 OF ALCOHOLIC BEVERAGES FOR
CONSUMPTION ON THE PREMISES IN BUILDINGS FACING THE PUBLIC SQUARE. Second
reading, read by title. Motion by Alderman Carl , second by Alderman Hammond
the ordinance be placed on its passage. Roll call . AYES: Aldermen Kovachevich,
Hammond, Savill , Sarff, Grant, Carl , Larsen. NAYS: Alderman Horr. Motion
carried. Ordinance being #958.
ORDINANCE - AMENDING TITLE 5, CHAPTER 1 , RE-ESTABLISHING THE CITY OF CANTON
FIRE DEPARTMENTS'S AUTHORIZED STRENGTH. Second reading, read by title. Fire
Chief Robert Derenzy stated that he had discussion with the firefighters about
reducing the lieutenants from 6 to 5. The younger members feel its not fair
that they couldn't move up. They voted last night to have the union president
and the chief contact the mayor to see if this ordinance could be held until
the firefighters union could have a chance to meet with the negotiations commit-
tee. Mayor Edwards concurred to hold this until the committee's next meeting.
Motion by Alderman Carl , second by Alderman Horr, this ordinance be tabled until
the next council meeting. Voice vote, motion carried. The firefighters to
be at the next negotiations commitee meeting.

NEW BUSINESS:
RESOLUTION - APPROVING A "WATER PURCHASE CONTRACT" BETWEEN THE CITY OF
CANTON, AND THE CITY OF CUBA. First reading, read by title. Cliff Sagaser
City Engineer suggested the following changes: page 2 of the contract,
section 3, first sentence, remove the words "furnish, and maintain at its
own expense." Second paragraph of section 3, the number 12 to be stricken
and the number "6" inserted. The third paragraph of section 3, the word
"basis" be added, after the word monthly. Page 3, section 3, at the end of
the sentence, make a sentence by adding the words "meter to be approved by
seller." On the same page, section C3, the words "at the current metered
rate" be eliminated and the words, "rates in accordance with seller's ordi-
nance. Jim Mlamgren City Attorney suggested the following change on page 3
C4. First paragraph the word "reasonably" be inserted before the word
necessary.
Motion by Alderman Sarff,second by Alderman Savill , the resolution be adopted
as corrected. Discussion. Roll call . AYES: Aldermen Horr, Larsen, Carl ,
Grant, Sarff, Savill , Hammond, Kovachevich. NAYS: None. Motion carried.
Resolution being #974. Contract being #428.
RESOLUTION - SETTING PUBLIC HEARING TIME, DATE AND PLACE CONCERNING THE CITY
OF CANTON'S INTENT TO APPLY FOR DESIGNATION OF AN "ENTERPRISE ZONE." First
reading, read by title. Jim Malmgren City Attorney reported that in talking
with DCCA the legislature approved senate bill #1299.as amended by the governor's
amendatory veto. The approval would have come on or about the 3rd of this
month. The governor has yet to sign the bill making it a law. The statute
requires that there be at least one public hearing prior to the passage of an
ordinance authorizing the application. In this case it would have to be a
joint public hearing between the county and city because the property lies
within the county,or there would have to be 2 public hearings. The city
attorney did confer with the states attorney and he agrees that the most
practicable solution is to hold a joint public hearing in the city's council
chambers, because the place of the public hearing must be held in the enterprise
zone. Mayor Edwards felt that we should have copies made for our Planning &
Zoning Committee. Cliff stated that there are no houses in the enterprise
zone or any upstairs apartments. Changes can be made as we go stated the mayor.
We can add on at a later date. Motion by Alderman Savill , second by Alderman
Sarff, the resolution be adopted. Discussion. Roll call . AYES : Aldermen
Kovachevich, Hammond, Savill , Sarff, Grant, Carl , Larsen, Horr. NAYS: None.
Motion carried. Resolution being #975.
Alderman Sarff asked if the city had heard any word on the railroad crossings
being closed? Mayor Edwards replied that nothing had been heard as of yet.
Alderman Carl asked about the condemnation suit. The city attorney stated
that nothing was heard from it at this time, but there's a motion pending
that the defendant has filed. Jim will be taking it to a hearing.
The mayor reported that it has been asked of the city to have a branch court
in Canton. The mayor and city attorney did meet with several judges and a
decision will be made in a few weeks.
ADJOURNMENT: Motion by Alderman Sarff, second by Alderman Hammond to adjourn.
Voice vote, motion carried. Council adjourned at 7:54 P.M.
