June 15th, 1982
A regular meeting of the Canton City Council was held on June 15th, 1982
in Council Chambers.
PLEDGE OF ALLEGIANCE OPENED THE MEETING, FOLLOWED BY THE INVOCATION GIVEN
BY MAYOR EDWARDS.
Mayor Edwards asked for roll call at 6:30 P.M. Present: Aldermen Kovachevich,
Hammond, Savill , Sarff, Grant, Carl , Horr, Absent: None. 1 resigned,
MINUTES OF JUNE 1ST MEETING, Alderman Hammond asked for a correction under
the report of Lake Building & Grounds, the word "wax" should read "latch."
The same to be corrected. Motion by Alderman Carl , second by Alderman
Horr, the minutes of June 1st meeting as corrected be accepted and placed
on file. Voice vote, motion carried,
BILLS FOR MAY, Motion by Alderman Kovachevich, second by Alderman Hammond,
all bills for May be approved for payment. Roll call . AYES: Aldermen
Horr, Carl , Grant, Sarff, Savill , Hammond, Kovachevich, NAYS: None. Motion
carried. 7 ayes 0 nays 0 absent, 1 resigned.
COMMITTEE REPORTS:
Finance.
Council Action
Motion by Alderman Sarff, second by Alderman Hammond the city clerk to seek
quotes from other suppliers of copy machines. Discussion. The city clerk
gave council a list of cost for a #3450 Xerox copier, and its capibilities.
The features for this machine is better quality copies, sorter, reduction,
and over size availability,

COMMUNICATIONS FROM CITY ENGINEER CLIFF SAGASER, Gary Heinking from Crawford,
Murphy & Tilly spoke to council about the internal t,v, use of the sewer
system, and sewer monitoring. This will begin on June 24th, Our grant will
go down to 55%,
Emil Cook from Crawford, Murphy & Tilly had reported to Cliff that the
original second low bidder for the slaker was General Piping, Cliff
reported that they will have the adjusted price by this week and the bond-
ing company attorney, city attorney and consulting engineer, and the city
engineer will meet with them. Their price (General Piping) is $117,000.00,
which is under estimate.
M.F.T. for 1982, we've decided on the streets, total cost is less than
$67,000.00, we appropriated $100,000.00. In addition will also overlay
Avenue A, Pine Street from the end of first avenue to main street and come
up main. Cost will be $40,000.00 to $44,000.00. We have $75,000.00 to
$80,000.00 of Public Benefit monies to be used towards the cost of the project.
Hud street work, Cliff wants to set the date of July 2nd to receive bid of
letting, its for 8 blocks of the project. Cost if $20,000.00 per block.
In comparsion to $36,000.00 per block spent last year. The reason for
ecomomical cost, a bam base that was used last year. Were using a rock
base with a much higher quality surface, compared to last year.

Peoria Asphalt took over Hoffman Asphalt on the first avenue project.
If the city would sweep the street tomorrow, they will put asphalt on
first avenue the next day.
There are two generators at the water plant which are not producing enough
electricity together. Wanting to buy one generator which will replace
the other two, has a gurantee for two years, cost $50,205.00 with a down
payment of $10,000.00 and pay $900.00 a month.
North Main Street SewerProject, Cliff was lead to believe that we were
holding $5,000.00 to $6,000.00 for the contractor, and was working under
this belief until the last few days. City obligated themselves to do
the seeding. The contractor is out of state and is paid in full . Cliff
suggested fixing the driveways at a cost of $3,437.00, with the city doing
concrete work and rock and one culvert. Cost would then be $4,000.00 to
put drives in shape. Cliff wants approval to have Jim Boyd fix the driveways,
and to hire someone to do the seeding.
Motion by Alderman Sarff, second by Alderman Savill , to continue the program
�- Cliff outlined for this project. Discussion. Alderman Sarff wants letting
out for bid from landscaper. Cliff will check on this and have bids for
Ur July 2nd. Motion by Alderman Carl , second by Alderman Hammond bids be
Q received on July 2nd and open the bids. Voice vote, motion carried.
Q COMMUNICATIONS FROM CITY ATTORNEY. Jim Malmgren reported to council on
Special Service Area #6. The Illinois State Statutes requires that certified
copies of these ordinances and the one resolution be filed in the year in
which the first levy would take place, in this case in the year 1980.
As far as the official records in the city's possession, and as far as
the County Clerk's records show, these documents were not filed at anytime
in the year 1980. This was brought to the City's attention beginning in
the fall of 1981 , after the City had forfeited on the first payout on these
bonds. The City then filed all of the required documents, taxes were levied
and extended in the year 1981 , they were picked up in the tax bills in the
year 1982. Part of the statue relating to the establishment of special
service areas requires that there be a notice published in the local
newspaper and also that written notice be sent to the taxpayers in the
special service area. If you cannot prove that you gave that notice,
you may have a special service area which is void from the very beginning.
Thorough and numerous searches through the city records, shows that we
have no way of showing that that notice was given. This is not to say that
notice was not given, it merely means that we cannot prove that it was
given. A number of the people who reside or own property in Special
Service Area #6 have paid their taxes under protest, sighting as a reason,
Special Service Area #6 as invalid and void. This brings to court the
question of whether or not we have a valid special service area. The
court is going to have to rule yes or no. . If the court rules yes, then the
people will be required to pay taxes or to take a chance of having their
property purchased at a tax sale or they will have to appeal the decision
of the court. If the decision is yes, the City will not be looking at the
potential default on future bonds. If the decision is no, that is to say
we have a void special service area, then the City will immediately be
put in a position of being in default on $110,000 worth of bonds together
with whatever interest may have accrued at that point. (.See City Clerk

COMMUNICATIONS FROM MAYOR EDWARDS. Mayor Edwards appointed Garry Hinderliter
Assistant Department Head to Waste Water Treatment Superintendent Larry
Dutton. Mayor Edwards also appointed Barbara J. Kuzinar to the Handi-
capped committee. Motion by Alderman Sarff, second by Alderman Hammond,
that the appointments be confirmed. Voice vote, motion carried.
Mayor Edwards discussed the Community Profile on file with the Department
of Commerce and Community Affairs. There was some confusion as to whether
the Community Profile for Canton was complete. The Mayor stated that the
profile is complete and on file with the Department of Commerce and
Community Affairs.

reading, read by title. Motion by Alderman Kovachevich, second by

ORDINANCE - AMENDING TITLE 6, CHAPTER 1 , SECTION 1 RELATING TO THE
NOMENCLATURE OF RANK STRUCTURE WITHIN THE CITY POLICE DEPARTMENT. Second
reading, read by title. Motion by Alderman Sarff, second by Alderman
Grant, the ordinance be placed on its passage. Roll call . AYES: Alderman
Horr, Carl , Grant, Sarff, Savill , Hammond and Kovachevich. NAYS: None.
Motion carried. 7 ayes, 0 nays, 0 absent & 1 resigned. Ordinance being

ORDINANCE - AMENDING TITLE 8, CHAPTER 9, BY ADDING SECTION 9 AS HEREINAFTER
SET FORTH. Second reading, read by title. Motion by Alderman Carl , second
by Alderman Kovachevich, the ordinance be laid over until the next council
meeting. Voice vote, motion carried.
ORDINANCE - AMENDING TITLE 8, CHAPTER 1 , SECTION 4 BY REVISING SUBPARAGRAPH
(J) . Second reading, read by title. Motion by Alderman Carl , second by
Alderman Kovachevich, the ordinance be laid over until the next council
meeting. Voice vote, motion carried.
NEW BUSINESS:
RESOLUTION - ASCERTAINING THE PREVAILING RATE OF WAGES FOR LABORERS,
MECHANICS AND OTHER WORKMEN EMPLOYED IN ANY PUBLIC WORKS. First reading,
read by title. Motion by Alderman Horr, second by Alderman Savill the
resolution be adopted. Discussion. Roll call . AYES: Alderman Kovachevich,
Hammond, Savill , Sarff, Grant, Carl and Horr. NAYS: None. Motion carried.

ORDINANCE - ALLOWING A SPECIAL USE PERMIT FOR PROPERTY OF DIXIE K. SAUNDERS

RESOLUTION - APPROVING CERTAIN "OFFERS TO PURCHASE REAL PROPERTY" First
reading, read by title. Motion by Alderman Grant, second by Alderman
Sarff, the resolution be adopted. Roll call . AYES: Alderman Horr, Carl ,
Grant, Sarff, Savill , Hammond, and Kovachevich. NAYS: None. Motion carried.

EXECUTIVE SESSION - PROPERTY ACQUISITION. Motion by Alderman Kovachevich,
second by Alderman Horr, to go into executive session. Voice vote, motion
carried. Council recessed at 8:02 P.M. for the purpose of executive session.
